Abstract:
Co-production of public services is an increasingly popular tool in public man- agement, although it is still a new phenomenon in Poland. Despite the attention research- ers give to co-production, some significant gaps remain. In this article, author attempts to examine the legal possibility of implementing co-production by the Polish local government by local initiative and Solecki Fund. The article aims to examine how major Polish cities gathered in Union in Polish Metropolises used local initiatives. The next step in research is to find out how Solecki Fund is spread among rural areas according to statistical data. It is proved that only a handful of local governments in Poland are truly engaged in co-produc- tion. However, Solecki Fund can be shown as an excellent example of citizens’ engagement. It is presented a possible agenda on what can be done to make co-production more popular and used on a regular basis not only in metropolitan but also rural areas.

Abstract:
The “right to truth” relates to the obligation of the state to provide information about the circumstances surrounding serious violations of human rights. Despite its increas- ing recognition, the concept raises questions as to its scope and implementation as well as its existence as a free-standing right. Similarly, “memory laws” relate to the way states deal with their past. However, there are certain „memory laws” that, while officially serving as a guarantee for accessing historical truth, lead to its deformation. As a result, an “alterna- tive” truth, based on the will of the legislators, is being imposed. In this article the authors elaborate on the general nature of the new legal phenomenon of the „right to truth”, as a tool of transitional justice, in particular in the context of both providing and abusing historical truth by the legislators, through the instrument of “memory laws”.

Abstract:
Since gaining independence, Kazakhstan, Kyrgyzstan, Tajikistan, Turkmenistan and Uzbekistan gradually opened their markets to foreign investors. Before Poland’s acces- sion to the European Union, the activities of Polish investors in Kazakhstan, Kyrgyzstan, Ta- jikistan, Turkmenistan and Uzbekistan were based on bilateral treaties concluded by Poland with those countries. Later, except Turkmenistan, they were governed by the partnership and cooperation agreements between the European Communities and their Member States. Despite the ample investment opportunities and favourable conditions for access to the mar- ket, the activity of Polish companies in these markets has not produced a significant effect. Poland invested with more considerable success on the markets in Kazakhstan and Kyrgyz- stan. It made investment attempts in Tajikistan and Uzbekistan, leaving out Turkmenistan. The reason why Poland has a weak position in these markets is the distance between the partners and inability of Polish companies to efficiently compete with large multinational companies which have been operating there for years. In the Kazakh market, good invest- ment prospects are available for waste management, petrochemical, mining and road con- struction companies. In Kyrgyzstan, there are cooperation possibilities in the area of modern agricultural and processing technologies and establishment of fruit and vegetable process- ing enterprises. In Tajikistan, enterprises can invest in petroleum and natural gas extraction and exploitation, the fuel market, processing of precious metals and construction of conven- tional and hydroelectric power plants. In Turkmenistan, Polish companies can compete for road, railway and housing construction contracts, whereas in Uzbekistan they can invest in businesses covered by government tax reductions.

Abstract:
There is a positive relationship between between the "Protection System for Refugees and Asylum Seekers" (SPRAR) and income growth. Hosting an additional refugee or asylum seekers as part of the SPRAR systems is associated with an additional 0.09% growth in per capita taxable income. Above and beyond the direct transfers associated with the presence of a SPRAR centre, its operation may be beneficial for the local economy of Italian municipalities.

325. The Formation of Local Self-government During the System Transformation Period in Poland and the Former GDR

Abstract:
This paper presents changes that have occurred at the local level in Poland and new German federal states during the process of the post-communist system transforma- tion. The stages of rebuilding the local self-government and its structures are analyzed. The experiences of Poland and Eastern Germany – two states where the system transformation took different courses – were compared. At the same time, both countries have different constitutional orders of the unitary state and federal state, and this context are interesting fields for a comparative analysis. This paper also confronts the two methods of institution building – the importing of well-established institutions and developing them in the evolu- tionary way, where in both cases path a dependency can be well observed. In Germany this is considered a special case (Sonderfall) of institutional transformation, in which the key role was played by the transference of institutions, personnel and financial means. This was also done much quicker and in a more structured and comprehensive way than in Poland. In the case of Poland, the creation of local self-government structures or shaping the political actors was a grassroots and evolutionary process. This article points out the most important factors that had a crucial significance in the course and results of the transformation and explains different ways of developing the system of democratic local self-government.

326. The Scope of Application of the Charter’s Right to Good Administration of the European Union

Abstract:
Article 41 of the Charter for Fundamental Rights of the EU guarantees the right to good administration as a fundamental right of the EU citizens. It seems from the wording that Article 41 applies only to the institutions, bodies, and agencies of the Union, without mentioning the Member States. This gives it a narrower scope than that given in Article 51.1 concerning the scope of the Charter as a whole. This paper discusses the question of applicability of the right to good administration regarding the implications of Article 41 in this respect. The doubt that stems from this is whether the content of 51.1 prevails or, on the contrary, it must be ignored and taken as reference to the particular provision in Article 41.

327. “Now Is a Time to Lead:” Advancing Transitional Justice Initiatives through Local Governments in Nepal

Abstract:
Recently, Nepal implemented some significant long-awaited changes to its structure of government that present new opportunities for addressing the justice needs of conflict victims. On September 20, 2015, a new Constitution came into effect, replacing the interim Constitution promulgated in 2007, soon after the conflict ended. That constitution introduced a new federal structure of government that, among other things, vests local governments with 22 powers and areas of responsibility over which they have broad authority. Many of these powers can be exercised to establish policies and programs at the local level for fulfilling victims’ rights to truth, justice, reparation, and acknowledgment for the human rights abuses victims suffered during the war. Although local initiatives are not a complete substitute for a coherent national policy, these powers offer great potential for implementing measures to address promptly and directly a full spectrum of victims’ reparative needs, from the symbolic to the material. They encompass food, housing, employment and job creation, medical care, education, legal services, help obtaining official documentation, memorialization initiatives and other forms of public recognition, awareness-raising activities, and measures aimed at preventing the recurrence of human rights abuses. Many of these measures would fulfill fundamental rights guaranteed under the Constitution to all Nepal’s citizens, and additional rights secured there for vulnerable populations (such as the elderly, disabled, single women, those marginalized or indigent, and children). If designed to be reparative in nature, they could also fulfill victims’ rights to an effective remedy, including the right to “adequate, effective and prompt reparation,” as articulated by the UN General Assembly in its Basic Principles and Guidelines on the Right to Remedy and Reparation for Victims of Gross Violations of Human Rights Law and Serious Violations of International Humanitarian Law (UN Basic Guidelines). This report aims to help local governments, victims’ groups, and other stakeholders to understand the scope and potential inherent in these powers and to identify what local governments and others can do to design and implement initiatives that support victims of conflict and that fulfill this potential. To this end, this report looks closely at the provisions of the 2015 Constitution and the Local Government Operationalization Act 2074 BS (2017 AD). It also considers the essential role local governments can play in crafting and coordinating responses alongside national-level institutions that are advancing transitional justice processes, such as the Truth and Reconciliation Commission (TRC), the Commission on Investigation of Enforced Disappearance of Persons (CIEDP), and the National Human Rights Commission (NHRC). Additional consideration is given to the provisions of the Enforced Disappearances Enquiry, Truth and Reconciliation Commission Act (the TRC Act), 2071 (2014), and the requirements established therein for local government cooperation and engagement with ongoing transitional justice mechanisms. With offices within or near victim communities, local governments in Nepal are well situated to tailor initiatives to address victims’ particular needs. Coming as they do from out of the communities they serve, most local officials, including many who are victims themselves, are familiar with realities on the ground and nuances in the economy and in community practices that may affect whether a policy will benefit or might unintentionally harm victims, or could even exacerbate tensions within families or between neighbors. Many local officials speak and read the local languages and dialects victims speak and read. Also, many are privy to crucial differences among survivors’ experiences of war, as well as their current life situations. With access to information about existing services and knowledge of what is required to get things done locally, local governments offer real potential advantages for understanding and effectively responding to victims’ needs and for building the kinds of relationships needed to help bridge divides not only between and among victim populations, but also between victims and nonvictim communities in Nepal. With five-year terms in office (and eligibility for an additional term), local officials at each of the different levels of local government (e.g., municipal, village, and ward) should be able to plan and undertake not only short-term or targeted projects that respond to victims’ urgent needs but also long-term, subsistence-based projects that can provide victims with the benefits they need to create a more stable life for years to come. Many of these initiatives can begin while national policymakers in Kathmandu continue working on a comprehensive approach to transitional justice. National and local dimensions of transitional justice are not mutually exclusive; there is no reason local efforts cannot be designed in a way that meet victims’ needs for redress, in particular for the most vulnerable populations, while still meeting other government obligations, including those at the central and provincial levels. In fact, local governments working effectively now might relieve some of the pressures on the central government, by meeting victims most acute needs and collecting data and testing policies that could be implemented later at the national level. To do so, all levels of government across the federal structure will need to coordinate, communicate, and abide by the essential elements of good governance, including preventing corruption. Victim initiatives must be designed in such a way as to “do no harm” and to ensure that victims are treated fairly and with respect and dignity. As Nepal has learned from its experience implementing the Interim Relief Program (IRP)—which was hampered by significant shortfalls in design and implementation (including insufficient funding, a lack of coordination among key stakeholders, the exclusion of some categories of victims and the unequal treatment of others, and the politicization of application processes and eligibility determinations)—it is essential to consult with victims, to be sensitive to their needs and vulnerabilities, to acknowledge the violations they experienced, and to monitor and evaluate implementation to prevent discrimination. In all decisions and procedures, the safety, well-being, and dignity of victims must be considered and given priority. The victims will be paying attention. As one victim forcefully made the point, “We raise our voices. We do not give up. And we will not sit by in silence…I say to the government—listen to our voices, consider our demands. The challenges local governments will inevitably face are innumerable. At each stage of the process, local governments will confront significant hurdles as they exercise their powers to design, plan, and eventually implement programs benefiting their constituents, including Nepal’s many conflict victims. This report highlights some of these major challenges based on feedback obtained during consultations conducted in preparation of this report in some of the districts where conflict victims live. Immediate steps should be taken to monitor, address, and mitigate the following challenges

328. he Other Fissile Material: Strengthening National and International Plutonium Management Approaches

Abstract:
CNS Occasional Paper #42 discusses issues relating to separated, or unirradiated, plutonium in civilian nuclear programs, that is, plutonium that has been chemically separated from spent nuclear reactor fuel by reprocessing but has not been reintroduced into a nuclear reactor after separation and subjected to further irradiation. Efforts to limit the spread of reprocessing in the civilian sector crystalized in the mid-1970s. Two developments triggered the intensified attention to this issue: (1) India’s 1974 test of a nuclear explosive device, which used as its core plutonium produced in an ostensibly peaceful nuclear-research program, and (2) attempts on the part of several states that had not renounced nuclear weapons to obtain reprocessing plants for their civil nuclear power programs. In the intervening forty-four years, in those states that proceeded with civilian reprocessing programs, stocks of separated civilian plutonium have continued to grow in the aggregate. Taken together today, they are substantially greater than worldwide military plutonium stocks. Multiple approaches to limiting the separation of civil plutonium have been implemented, and still others have been given serious study, but stocks have increased regardless, while options for working down these stocks appear to be diminishing. Meanwhile, concern has deepened over the possible theft or diversion of this material, which could bring weapon-sufficient quantities of plutonium into the hands of violent extremists. International Atomic Energy Agency safeguards are valuable, but they do not fully address the risks of breakout from nonproliferation or disarmament commitments. Safeguards are intended to provide timely warning of diversion, so as to provide an opportunity for intervention. However, even if diversion of plutonium is detected immediately, the plutonium could be weaponized too quickly for effective preventive measures. Nor are safeguards designed to address nuclear-material security issues. Accordingly, there is a need for institutional and technical measures to mitigate risks from separated plutonium. This report recommends steps to address the risks posed by existing reprocessing programs and stocks as well as ways to discourage potential new programs.

In 2015, the United Nations adopted an ambitious new agenda for global development, and its proponents have called for a “data revolution” to further its goals. How to mobilize this data revolution? Much of what has been written about it so far implies only the mounting of expanded surveys to track progress under each goal. Although surveys are essential, there are good reasons to believe that surveys alone would be insufficient and probably impractical.

Abstract:
Building on original quantitative and qualitative fieldwork in three refugee hosting cities – Nairobi, Gaziantep, and Peshawar—this study explores the role of social networks in furthering or hampering displaced persons’ ability to achieve self-reliance. Experiences are diverse, but several general findings emerge: (1) Group membership is remarkably low; (2) Social networks are an invaluable asset for many but are either unavailable or a hindrance for others; (3) The in-group networks that initially offer protection become less effective in the long-term; and (4) Economic security is closely depending on people’s ability to forge connections beyond co-nationals.
