4721. Flood Risk Mapping in Canada: Moving Forward on a National Priority

Abstract:
To improve public awareness of flood risk and meet its commitment to the United Nations Sendai Framework on Disaster Risk Reduction, Canada must develop up-to-date flood risk maps and make them publicly available. Effective flood maps improve risk perception, ensure information is accessible and stimulate risk reduction. Good flood maps provide: information to personalize the experience of flooding; local and historical context; a legend; legible flood extents; definitions of scientific and technical terminology; transparency on uncertainty and limitations; data on all forms of flooding; and risk reduction advice. Until a more coordinated map development process can occur, the Government of Canada should create a national online repository where existing maps are collected and made publicly accessible.

4722. Crisis in the WTO: Restoring the Dispute Settlement Function

Abstract:
The impasse in the World Trade Organization (WTO) over the appointment of new members of the Appellate Body is just one symptom of crisis in cooperation on trade. Driven by skepticism about multilateralism and binding dispute settlement, and by a growing strategic and economic rivalry with China, the current US administration has elevated longstanding US concerns about WTO dispute settlement to new heights. The inability of WTO members to exercise their collective authority to interpret the meaning of their WTO commitments has meant that the Appellate Body is effectively not subject to any checks and balances. As other WTO members blocked US efforts to negotiate more member control, the United States increasingly turned to unpopular unilateral mechanisms, culminating in the current block on new appointments as part of its more disruptive trade policy. Assuming the United States will eventually return to rules-based trade, restoring the WTO dispute settlement system to full capacity and enhancing its legitimacy will likely require some changes. This might include improving mechanisms for political oversight, diverting sensitive issues from adjudication, narrowing the scope of adjudication, improving institutional support and providing members more say over certain procedures. Preserving compulsory, impartial and enforceable dispute settlement in the WTO will require an accommodation of different perspectives on how the system should function. Achieving this, in whatever form, will contribute to maintaining and even strengthening multilateral cooperation on trade.

4723. No Strangers at the Gate: Collective Responsibility and a Region’s Response to the Venezuelan Refugee and Migration Crisis

Abstract:
Venezuela suffers from a profound and multifaceted crisis. Years of mismanagement have led to a crippling economic contraction and an inflation rate projected to reach 1,000,000 percent in 2018. Citizens are chronically short of food and medicine and face some of the world’s highest levels of violence. The governing regime has systematically dismantled democratic checks and balances, consolidating power through fraudulent elections, violent re­pression and the cynical use of scarcity as a tool of control. Unsurprisingly, Venezuelans are fleeing, generating the largest refugee and migration flow in the history of the Western Hemisphere — more than 1.6 million people since 2015. Most have sought refuge within Latin America, but Venezuelans are now also the leading requesters of asylum in the United States and Spain. With no end in sight for the economic, humanitarian and governance crisis in Venezuela, the forced migration challenge will only grow. The regional response to Venezuelan refugees and migrants has been marked by a spirit of solidarity. Latin American countries — particularly neighbouring Colombia, where authorities report receiving 5,000 Venezuelans per day — have taken important steps to ensure freedom of movement and to provide avenues for legal stay and access to basic rights for those fleeing Venezuela. Nonetheless, many significant challeng­es to effective response remain. Meeting them requires reinforcing the existing re­gional solidarity toward Venezuelan refugees and migrants and combining it with greater creativity, collective responsibility and political will from the international community. This report aims to galvanize such an effort and offers concrete proposals for action.

4724. Data Is Different: Why the World Needs a New Approach to Governing Cross-border Data Flows

Companies, governments and individuals are using data to create new services such as apps, artificial intelligence and the Internet of Things. These data-driven services rely on large pools of data and a relatively unhindered flow of data across borders (few market access or governance barriers). The current approach to governing cross-border data flows through trade agreements has not led to binding, universal or interoperable rules governing the use of data. Most countries with significant data-driven firms are in the process of debating how to regulate these services and the data that underpins them. But many developing countries are not able to participate in that debate. Policy makers must devise a more effective approach to regulating trade in data for four reasons: the unique nature of data as an item exchanged across borders; the sheer volume of data exchanged; the fact that much of the data exchanged across borders is personal data; and the fact that although data could be a significant source of growth, many developing countries are unprepared to participate in this new data-driven economy and to build new data-driven services. This paper begins with an overview and then describes how trade in data is different from trade in goods or services. It then examines analogies used to describe data as an input, which can help us understand how data could be regulated. Next, the paper discusses how trade policy makers are regulating trade in data and how these efforts have created a patchwork. Finally, it suggests an alternative approach.

Abstract:
All U.S. administrations aim to conceive foreign policies that protect and enhance Americans’ safety, prosperity, and way of life. However, views now diverge considerably within and across political party lines about whether the U.S. role abroad is adequately advancing the economic well-being of the middle class at home. Today, even as the U.S. economy is growing and unemployment rates are falling, many households still struggle to sustain a middle-class standard of living. Meanwhile, America’s top earners accrue an increasing share of the nation’s income and wealth, and China and other economic competitors overseas reap increasing benefits from a global economy that U.S. security and leadership help underwrite. Policymakers need to explore ways to make U.S. foreign policy work better for America’s middle class, even if their economic fortunes depend largely on domestic factors and policies. However, before policymakers propose big foreign policy changes, they should first test their assumptions about who the middle class is, what economic problems they face, and how different aspects of U.S. foreign policy can cause or solve them. They need to examine how much issues like trade matter to these households’ economic fortunes relative to other foreign and domestic policies. They should acknowledge the trade-offs arising from policy changes that benefit some communities at the expense of others. And they should reach beyond the foreign policy establishment to hear from those in the nation’s heartland who have critical perspectives to offer, especially state and local officials, economic developers, small business owners, local labor representatives, community leaders, and working families. With these objectives in mind, the Carnegie Endowment for International Peace launched a series of state-level case studies to determine whether significant changes to U.S. foreign policy are needed to better advance the economic well-being of America’s middle class. Ohio was chosen for the inaugural study because of its economic and political diversity and its well-known status as a bellwether state. Carnegie partnered with researchers at OSU to conduct the study and convened a bipartisan task force comprised of former senior policymakers to provide strategic guidance and shape the findings. Interviews were conducted in Cleveland, Columbus, Coshocton, Dayton, Lima, and Marion to solicit views in diverse conditions across the state.

4726. Uncertain Ground: Engaging With Europe’s De Facto States and Breakaway Territories

Abstract:
Abkhazia, Transdniestria, and northern Cyprus, three unrecognized statelets in Europe that arose during conflicts in the twentieth century, have endured for decades. Despite many problems, they are self-governing and stable, and they show no signs of collapsing. They exercise internal sovereignty, even as they have no prospect of getting international recognition. This qualifies them as de facto states. While these territories still have problems of poor regulation and impunity from international justice, in many other regards, they seek respectability and try to cleave to European norms. This distinguishes them from the breakaway territories in eastern Ukraine. Concerns in the recognized states that greater engagement will lead to “creeping recognition” of the territories is not borne out by legal opinion, which concludes that recognition is a conscious act and cannot be conferred by accident.Better engagement with breakaway territories such as these is an overlooked resource in conflict resolution. If carried out in a clear-sighted and intelligent manner, it should benefit all sides. It should give citizens of the de facto states greater opportunities to be integrated into the world. It should benefit the recognized states who generally have a de jure claim over the territories (the “parent states”) by building bridges across the conflict divide. It should have a wider benefit by ensuring that these places are more compliant with international norms.

Abstract:
As the domain of civil society burgeoned in the 1990s and early 2000s—a crucial component of the global spread of democracy in the developing and postcommunist worlds—many transnational and domestic actors involved in building and supporting this expanding civil society assumed that the sector was naturally animated by organizations mobilizing for progressive causes. Some organizations focused on the needs of underrepresented groups, such as women’s empowerment, inclusion of minorities, and LGBT (lesbian, gay, bisexual, and transgender) rights; others addressed broader societal issues such as economic justice, social welfare, and antipoverty concerns. In many countries, the term “civil society” came to be associated with a relatively bounded set of organizations associated with a common agenda, one separate from or even actively opposed by conservative political forces. However, in the past ten years, this assumption and outlook are proving increasingly incorrect. In many countries in the developing and postcommunist worlds, as well as in long-established Western democracies, conservative forms of civic activism have been multiplying and gaining traction. In some cases, new conservative civic movements and groups are closely associated with illiberal political actors and appear to be an integral part of the well-chronicled global pushback against Western liberal democratic norms. In other cases, the political alliances and implications of conservative civil society are less clear. In almost all cases—other than perhaps that of the United States, where the rise of conservative activism has been the subject of considerable study—this rising world of conservative civil society has been little studied and often overlooked. This report seeks to correct this oversight and to probe more deeply into the rise of conservative civil society around the world. It does so under the rubric of Carnegie’s Civic Research Network project, an initiative that aims to explore new types of civic activism and examine the extent to which these activists and associations are redrawing the contours of global civil society. The emerging role and prominence of conservative activism is one such change to civil society that merits comparative examination. Taken as a whole, the report asks what conservative civic activism portends for global civil society. Its aim is not primarily to pass judgment on whether conservative civil society is a good or bad thing—although the contributing authors obviously have criticisms to make. Rather, it seeks mainly to understand more fully what this trend entails. Much has been written and said about anticapitalist, human rights, and global justice civil society campaigns and protests. Similar analytical depth is required in the study of conservative civil society. The report redresses the lack of analytical attention paid to the current rise of conservative civil society by offering examples of such movements and the issues that drive them. The authors examine the common traits that conservative groups share and the issues that divide them. They look at the kind of members that these groups attract and the tactics and tools they employ. And they ask how effective the emerging conservative civil society has been in reshaping the political agenda.

Abstract:
The Israeli and Palestinian communities are growing ever closer physically while remaining separated politically. Any solution must adequately address the needs of both sides. This report attempts to look at actualities and trends with a fresh and analytical eye. At first glance, the two halves of this report contain two very different views of a resolution to the Israeli-Palestinian conflict: one presents the case for a two-state solution, the other suggests that it is time to look at the idea of a single state with all its variations. But the two halves do not differ on the facts of the current situation. Nor do they differ much on the trajectory. The same facts can be used to support two different conclusions: Do we need new ideas or new determination and political will behind previous ones? The two chapters also highlight an important political reality: any solution must adequately address the needs of both sides. Imposed solutions will not work. The section authored by the Baker Institute does not deny that a one-state reality is emerging and the two-state solution is in trouble, but it argues that the two-state solution should not be abandoned as it provides the most coherent framework for a democratic Israeli state living in peace and security next to an independent and sovereign Palestinian state. Carnegie’s section recognizes that a one-state reality is emerging, whether desirable or not, and calls for scrutinizing solutions that take this reality into account instead of wishing it away. At a time when ideas to solve the conflict are being speculated about without much context, this report attempts to objectively analyze and present the two major options for a negotiated peace between the Israelis and the Palestinians and to explain the consequences of both for the parties involved and the international community. It is our hope that it will serve as not only a reminder of past efforts but also an incubator for future ones.

Abstract:
China is on course to lead the world in the deployment of nuclear power technology by 2030. Should it succeed, China will assume global leadership in nuclear technology development, industrial capacity, and nuclear energy governance. The impacts will be strategic and broad, affecting nuclear safety, nuclear security, nonproliferation, energy production, international trade, and climate mitigation. Especially critical is whether China achieves an industrial-scale transition from current nuclear technologies to advanced systems led by fast neutron reactors that recycle large amounts of plutonium fuel.
