2381. Better Protection of the Rule of Law – or of European Taxpayers’ Money

Abstract:
The rule of law holds great importance to the EU, as it also should to its member states and improving its protection has become a focus of new legislative efforts. Will this proposed regulation be useful and effective tool added to EU’s legislation or will it do the opposite and hurt the member state governments? The author focuses on already existing procedures and their deficiencies and compares them to the current proposal while also shedding light on the background of the new legislation. The reflection addresses some of the questions that may be raised related to EU law, member state sovereignty and its possible effects. The regulation still has a long way to go to become a law and in or order for that to happen it needs to be accepted by the Council. The author lists potential scenarios that could occur in the process of the law’s adoption and explains the legislative procedures.

2382. The Regional Format 16+1: Early Rusting, Still Alive and Expanding into 17+1

Abstract:
The sub-regional multilateral format of China and 16 post-communist states (16+1) proved that it could last seven years and that it has the potential to absorb new members. Consequently, the European Union is increasingly concerned about its potentially divisive effects on the EU’s unity. The expected economic benefits of 16+1 for the European partners have been scarcely relevant; still, the European states exploit the 16+1 format for strengthening their bilateral agendas with China. Amidst the trade war with China, the US regards China’s rising influence in Central Europe as a political issue. Beijing’s priority in Europe is to calm down the tension with the EU, Germany, and France over the 16+1 platform. However, the accession of Greece to the enlarged format of 17+1 in the recent 16+1 summit in Dubrovnik and the gaining of support for the Belt and Road Initiative in Italy enable China to establish its foothold on the European South’s doorstep in connection with the 17+1 regional platform.

Abstract:
This essay discusses the main elements of the American security document called the Missile Defense Review 2019, which was presented by the US Ministry of Defense in January 2019. It covers the possible reasons for the postponed publication of the document and informs about the main legal documents dealing with the peaceful use of space. It compares the current document with the similar one from 2010, which was published by the Obama administration. It also focuses on the possibility of the deployment of US spacebased interceptors in the Earth’s orbit. In this context it analyses the possible negative consequences of such a development, especially that it could lead to the beginning of a phase of a high risk weaponization of outer space and the start of an arms race in that domain.

2384. 10 Years of Eastern Partnership: From Prague to Brussels and How to Proceed?

Abstract:
The past 10 years can be generally assessed as a success and this trend needs to be maintained in the upcoming decade. To this end, it will be necessary to come up with a new vision for EU-Eastern relations and keep the EU’s Eastern policy high on the EU agenda. This is where EaP supporters, such as Poland and Sweden, and again the Czech Republic, can play a decisive role. The strategic task ahead of those countries is to come up with new ideas and incentives on how to develop the policy until 2030, and beyond. The EU member states from the so-called “like-minded” group will also have to push for the Euro-Atlantic orientation of the Eastern European countries while keeping the door open to the future enlargement process in the long run. The policy paper looks at the past decade of Eastern Partnership, its achievements and failures and currents tasks and challenges that lie ahead of the both EU and the six EaP states. It brings policy recommendations for the European Union, Visegrad Group and the Czech Republic. The paper was published with a support of the Ministry of Foreign Affairs of the Czech Republic in the framework of public diplomacy projects within Czech Foreign Policy and international relations. It follows up on the Eastern Partnership Day, an international conference organized by AMO and the Institute of International Relations in June 2019.

Miroslav Tůma in his new Policy Paper titled "The Importance of Verification and Transparency in the Nuclear-Arms Control, Nonproliferation and Disarmament Process" explained how monitoring and verification procedure associated with the nuclear-arms control, nonproliferation and disarmament process is nowadays important, especially in the sphere between US and Russia, which posses 90% of nuclear weapons all over the world. The author also analysed the development of the verification procedure in this field and its future curse. Should be the engagement of verification activity in a straight line with international law? What attitude should the Czech Republic take towards this problem in the near future?

Recommendations are articulated for a state such as the Czech Republic for which a pragmatic normative the framework defined herein provides a useful perspective to look at the governance of new technologies that ensure normatively desirable outcomes of sweeping technological change, and stimulate international scientific collaboration with positive spill-over effects to other domains of international cooperation. This research was supported by the Technological Agency of the Czech Republic. 2387. Senior Leadership Training in UN Peace Operations

Due to their unique and complex nature, UN peacekeeping missions depend on effective leadership. Because few, if any, mission leaders have the requisite skills, knowledge, political judgment, and physical and mental stamina upon being selected, they require continuous, institutionalized, and sustained training and learning support. While the Secretariat has undertaken a number of training and learning initiatives, critical gaps remain. This paper identifies these gaps and analyzes obstacles that impede progress in addressing them. It looks at gaps in three broad areas: knowledge of peacekeeping doctrine, policy, and practice specific to UN peacekeeping; knowledge of UN policies and procedures on financial and human resources management; and leadership and team-building skills. To address these gaps, it recommends that the Secretariat prioritize action in several areas: Centralize responsibility for mission leadership training in a single unit; Integrate training into planning and recruitment processes; Provide more sustained support to training; and Employ new tools such as scenario-based exercises for in-mission training.

2388. Delivering Healthcare amid Crisis: The Humanitarian Response in Myanmar

Myanmar simultaneously faces multiple armed conflicts and crises, each with its own challenges. In Rakhine state, the government’s persecution of the Rohingya people has led to massive displacement, as have decades of armed conflict in Kachin and northern Shan states. Combined with chronic underdevelopment, these humanitarian crises have left people without access to adequate healthcare, leading international humanitarian actors to step in. The public health system in Myanmar is generally poor, and government funding for health services is among the lowest in the world. There are wide discrepancies in health services between rural and urban populations and between central and peripheral states. In Rakhine, there are only nine public health workers per 10,000 people, and access to secondary and tertiary healthcare is limited. Community-based or ethnic health organizations provide primary healthcare in many areas without government facilities. In crisis-affected areas, UN agencies and international and local NGOs play an important part in providing healthcare services. However, international action can be unbalanced both regionally and medically. In many areas, health actors have focused on responding to diseases like malaria, HIV/AIDS, and tuberculosis, leaving a critical gap in mental health services and clinical health responses to sexual and gender-based violence. Likewise, funding has been imbalanced, with Rakhine state receiving more funding than Kachin or northern Shan. This paper looks at the state of healthcare in Rakhine, Kachin, and northern Shan states, the role of humanitarian actors in the provision of health services, and the trends and challenges affecting the humanitarian health response. It provides several recommendations for improving the humanitarian health response in Myanmar, including: 1. Adjust the scope of the humanitarian response; 2. Advocate for better humanitarian access; 3. Strengthen local capacities, and; 4. Address the dilemmas inherent in providing aid amid a development and human rights crisis.

2389. A Necessary Voice: Small States, International Law, and the UN Security Council

Abstract:
The international rule-based order has come under threat on multiple fronts. If it continues to deteriorate into an older model based on power politics, small states—by definition vulnerable in a world where only might makes right—are most at risk. This makes them natural defenders of the international order that protects them. How can small countries serve as effective champions of the rule-based order and international law? This paper explores this question by looking at the role of small states on the UN Security Council. The council, with its five veto-wielding permanent members, is perhaps not an obvious place to look at the role of small states. Nonetheless, it presents critical opportunities, as well as difficult challenges, for small states. This paper concludes that small states on the Security Council are well-placed to provide an important, credible voice with moral authority to remind all member states of their obligations under international law, reaffirm normative commitments to compliance, and advocate for a recommitment to a multilateral, rule-based international order. Perhaps not since the founding of the United Nations has that voice been more necessary for all to hear.

2390. Stuck in Crisis: The Humanitarian Response to Sudan’s Health Emergency

Abstract:
Following decades of war, economic decline, and underinvestment, Sudan’s healthcare system entered a new phase of crisis in 2019 as peaceful protests led to the ouster of President Omar al-Bashir. Among those leading these protests were doctors and other medical personnel fed up with poor working conditions and medicine shortages. This speaks to the degraded state of healthcare in the country, particularly in the conflict-affected regions of Darfur, South Kordofan, and Blue Nile. This paper looks at the humanitarian response to health-related needs in these conflict-affected parts of Sudan. After providing an overview of the state of Sudan’s healthcare system, it explores the main trends and challenges in the humanitarian health response, including the difficult partnerships between international and Sudanese health actors, restricted humanitarian access, and the effort to shift toward more sustainable approaches. It concludes that the humanitarian health response in Sudan is stuck: most agree on the need to move beyond short-term approaches, but the national capacity and development funding needed to make this transition are missing. At the same time, with newly accessible areas exposing unmet needs and conflict and displacement ongoing, a robust humanitarian response is still desperately needed. This situation calls for the UN, donors, and health NGOs to continue their efforts to respond to needs while strengthening the healthcare system, to coordinate humanitarian and development funding, and to advocate for maintaining and extending humanitarian access.
