2152. State-led Responses to the Indian Energy Challenge: Infrastructure Expenditure, Central Public Sector Enterprises and Electrification

- In the 21st century, economic growth, increasing urbanization, demographic expansion, and advances in electrification as important drivers of energy demand have put significant pressure on the Indian energy landscape. Indeed, energy infrastructure problems are a major hindrance to India’s economic growth. The central objective of this paper is to present and analyze some of the main State-led policy efforts that have been put in place to address India’s energy challenge. In particular, we examine three main types of state-led energy policy in India: a) infrastructure expenditure, b) Central Public Sector Enterprises (CPSEs) investments and Research and Development (R&D) strategies, and c) electrification. Firstly, we present and examine current data on the role of the state in the development of India’s energy sector. Secondly, we provide a nuanced examination of the role of public-private relations in India’s energy sector, especially in contrast to the widespread advancement of the neoliberal agenda in the country recent years. We conclude that the Indian State has fostered an increasing participation of the private sector in infrastructure, especially in renewable energies in which PPPs type of procurement have been more relevant. CPSEs’ expenditure in R&D has been of main importance in oil as well as in power. However, most of them tend to adapt foreign technologies instead of balancing foreign technologies with domestic technological efforts. Therefore, a main contemporary challenge for the Indian CPSEs performing in the energy sector is to deepen their connections and interaction with the other Indian NSI actors. Through the electrification process, the State has created markets for the private sector. Finally, we recommend further energy-related questions to be addressed in future research projects.

2153. Something for Nothing? How Growing Rent-seeking is at the Heart of America’s Economic Troubles

- The following paper studies three main questions: First, What is the association between increasing concentration and labor and profit shares? Second, is this effect different across sectors? Third, is this effect uniform across advanced economies? The paper finds that while there is a negative relationship between concentration and labor share and a positive relationship between concentration and profit share, the result is more pronounced in the United States than in similar advanced European economies. Moreover, the results are stronger for the manufacturing sector than for the services sector. The paper concludes that this evidence suggests that deviations from perfect competition are likely explained by declining competition in the U.S., whereas these secular trends, such as heterogeneous technology adoption and the declining price of capital, are more likely at play in Europe. Consequently, the paper prioritizes pre-distribution over redistribution.

2154. Russian-Syrian Business Cooperation: Challenges and Prospects

- In order to achieve the goals of the “Rebuild Syria” strategy, Damascus has been trying to attract investment from friendly countries, viewing business cooperation with Russia as a cornerstone of such efforts. Moscow has not yet made a final choice between a comprehensive “broad” approach, aimed at building a long-term economic presence in Syria, and a “narrow approach” of outsourcing the country’s reconstruction to selective Russian companies capable of securing rapid compensation for Russia’s expenditures during the Syrian war. Currently the second approach seems to prevail. The modalities of the Russia-Syria business cooperation are based on the “government-to-government” (G2G), “business-to-government” (B2G) and “business-to-business” (B2B) formats with the first two being preferable for Russian partners. Traders and industrialists from Russia encounter opportunities and challenges in Syria, related to the need of Damascus to restore and modernise the national economy amidst the disruption of the territory and to socioeconomic life, disconnection from the global financial system, Western sanctions against Moscow and Damascus, a history of unsuccessful B2B practices and over-bureaucracy in Syria, hence a preference for G2G and B2G. Future mutual economic ties depend on the evolution of the environment around Syria, reconciliation inside the country and the improvement of the domestic business climate. Moscow is making an effort to push the UN, the EU and GCC states to become donors; although Syria-Russia-EU coordination on other matters seems unlikely due to the latter’s negative political image inside Syria and Damascus’s reliance on Russia and Iran.

2155. Addressing the Use of Human Shields

- Human shields are increasingly used in modern conflicts, exposing civilians and other protected persons to high risk of death and injuries. Using human shields is a violation of international humanitarian law (IHL) and a war crime under the 1998 Rome Statute of the International Criminal Court and customary international law. Armed forces confronted with human shields are faced with the dilemma between causing civil casualties that may undermine the legitimacy of their operations and refraining from attack which results in military disadvantages. To address the use of human shields, the respective normative framework and the enforcement of the prohibition could be strengthened. Strategic communication could also be deployed to delegitimize the use of human shields. Thematic engagement among states and with armed non-state actors could further prevent the use of human shields. Operational and tactical measures to circumvent human shields could further support states engaged in military operations and prevent incidental harm to civilians. Any action to address the use of human shields should be coordinated among states and international organizations.

- The number of civil wars tripled in the decade to 2015. In this context, mediation is widely recognised as a critical tool for promoting the peaceful settlement of disputes, and for conflict prevention and resolution. The UN Secretary General, António Guterres, has made mediation a strategic priority, stating in his latest address to the Security Council that “innovative thinking on mediation is no longer an option, it is a necessity.” i In addition, regional organisations including the African Union, the Economic Community of West African States (ECOWAS), the European Union, and the Organization for Security and Co-operation (OSCE) are also increasing their mediation capacity. It is also increasingly recognised that those who lead high-level mediation processes need to be more representative of diverse stakeholders who bring different perspectives and experiences. Increasing the diversity of mediators is important, because the experience of the mediator will determine how they assess the relative priority of issues in the peace process, and how they are able to connect across tracks to lead inclusive processes. The barriers to inclusion of people with diverse backgrounds are highlighted by the lack of representation of women: this specific field is recognised as one of the most ‘stark and difficult to address gaps’ in achieving gender parity.ii As stated by Mossarat Qadeem, the exclusion of women is not about culture, it is about power.iii A gendered lens helps us to identify the processes, biases and barriers which contribute to the marginalisation and exclusion not just of women, but of all stakeholders who should be at the peace table.

2157. Prohibitions and Export Assessment: Tracking Implementation of the Arms Trade Treaty

- This Geneva Paper shows that ATT states parties generally implement the ATT’s prohibitions set forth in Article 6 through national laws and policies. This paper also demonstrates that exporting states implement the ATT’s obligations regarding export assessment contained in Article 7 in many different ways. While the spectrum of how exporting states parties consider an arms exports’ potential effect on peace and security is very broad, their national frameworks contain similar or nearly identical export criteria on assessing the risk of arms being used for serious violations of international humanitarian law and international human rights law. Few states parties have national export criteria regarding terrorism, transnational organized crime and gender-based violence. States also consider national criteria other than those specified in Article 7 before authorizing arms exports, including positive consequences of arms exports. Finally, states parties’ national frameworks mostly do not define clear thresholds for denying arms exports. Given this divergence in states party implementation, in addition to a remaining lack of clarity on how states apply the ATT provisions in practice, this paper recommends reinforcing dialogue on ATT implementation. This could lead to better understanding and implementation guidance that strengthens the emergence of common standards and improves the quality of national export assessments. To increase states parties’ knowledge on risks to be avoided, institutionalizing cooperation with human rights bodies and establishing an ATT internal information exchange mechanism is also recommended.

- Abstract:
- Security challenges are ‘emergent’ or ‘emerging’ when the wider community of security experts begin to discuss and debate a given issue as a prelude to developing, resourcing and then implementing appropriate policy responses. Some security challenges are "ab ovo" – they emerge onto the policy landscape at incredible speed, complete and entire, rather than slowly over a long gestation period. For some institutions, the ‘real’ emerging challenge is defined as much by institutional and cultural change needed to enable more efficient, effective and legitimate policy response as it is by the inherent complexity of the challenges themselves. Highest priority challenges (e.g. climatological, nuclear, biological, health and agriculture-related) are those that threaten the survival of people and institutions. Second order priority challenges undermine essential ways of life and the fabric of state-society relations, the nature of democratic governance and the integrity of the ‘social contract’.

- Despite worldwide support of 130 states, the Arms Trade Treaty (ATT) has failed to attract membership from countries in Asia, one of the largest arms importing regions. One set of explanations for this reluctance to join an international regime of conventional arms trade regulation is related to the fear of restrictions on the imports of weapons seen as necessary in a context of protracted conflicts and rising tensions among key states in Asia. Another argument is the interpretation of the ATT as not directly prohibiting arms transfers to non-state actors, such as terrorist groups. Another reason is the efforts of some Asian states to develop their own arms industry and exports to reduce dependency on external suppliers and project influence in the region. One of the main criticisms from the Asian states about the ATT relates to the criteria of export risk assessment (Article 7), which, in their view, gives undue advantages to exporting countries. It would be desirable to promote some dialogue between State Parties and Asian non-parties and signatories to assess the benefits from and the difficulties in implementing the Treaty and address the objections of nonparties. Amending the Treaty will be easier if Asian countries accede to it.

2160. Synergies between the Arms Trade Treaty and the Wassenaar Arrangement

- The Arms Trade Treaty and the Wassenaar Arrangement both seek to address the challenge posed by unconstrained transfer of conventional arms but differ in structure and approach. There are opportunities for synergies furthering the regimes’ common purpose. States members to both regimes can accentuate and interweave the strengths of the Arms Trade Treaty and the Wassenaar Arrangement. Transferring cutting-edge standards on export controls from the Wassenaar Arrangement to the Arms Trade Treaty would bolster the Arms Trade Treaty and foster global harmonization between exporting and importing countries. Political momentum on certain issues within the Arms Trade Treaty process may benefit the Wassenaar Arrangement’s further development. A derivative of the Wassenaar Arrangement’s regular ‘General Information Exchange’ on regions, transfers, and risky actors could be institutionalized within an Arms Trade Treaty working group. Sharing within the Wassenaar Arrangement information, concerns and practical challenges of states parties to the Arms Trade Treaty could make the Wassenaar Arrangement’s work more effective. Coordinating both regimes’ outreach activities, mentioning each other’s work and using each other’s documents for capacity building could mainstream arms transfer controls, prevent perceptions of conflicting standards as well as enable efficiencies regarding national efforts for compliance with international standards.
