331. Templates for Trade: Change, Persistence and Path Dependence in U. S. and EU Preferential Trade Agreements

Abstract:
Over the last two decades, Preferential Trade Agreements (PTAs) proliferated through the international trading system. PTAs created a web of rules paralleling and extending the system of the World Trade Organization (WTO). PTAs are an increasingly dominant feature of the international trading system, adding to a steadily increasing complexity. Their content is rarely studied systematically across agreements, and the mechanisms leading to their genesis are little understood. It is typically assumed that actors like the European Union (EU) and the United States (U. S.) work off a template when negotiating PTAs. Some argue that this allows them, amongst others, to impose a regulatory regime. This working paper attempts to put this claim to the test. Using diffusion theory as framework, it analyzes PTAs signed by the EU, the U. S. and their regional trading partners. Understanding the use of templates will help negotiating parties to assess the margin of maneuver when negotiating PTAs with the EU and the U. S. as well as the rigidity of their mandate. The analysis is conducted on a regional and a domestic level using aggregated data on PTA content and a qualitative assessment of selected PTA provisions (anti-corruption, environment and cultural cooperation). The study finds that the flexibility of these mandates is considerable and that templates, if used at all, can change substantially over time.

332. Iceland and Europe: Drifting further apart?

Abstract:
Iceland applied for EU membership in 2009 at the height of the economic crisis. Four years later, a new government has put the application on hold: the majority of Icelanders are opposed to entry, but want to continue the accession process and put the results to a vote. Iceland's longer-standing problems with European integration stem from the issue of sovereignty in general, and maintaining control over fisheries and agriculture in particular. Since 2009, anti-European feelings have been stoked by the 'Icesave' dispute, while the prospective benefits of entry (including use of the euro) have been tarnished by witnessing the fate of other small states during the euro crisis. The new government proposes remaining a member of the EEA and developing relations with other world powers. But the US commitment to Iceland has weakened over the years, and 'rising' powers like China are unable, as yet, to solve the country's core problems. In terms of both its security and its standing within the global economy, Iceland is becoming more rather than less dependent on Europe over time. The question raised by the latest political turn is whether it will have to maintain that relationship from a distance, with limited control and with no guaranteed goodwill.

333. Obama's Climate Policy: Addressing climate change through executive actions

President Barack Obama's recent action to address climate change indicates that it will be one of the second term's topical questions. The new climate change action plan introduced by Obama in June 2013 is composed of various executive actions and based on three pillars: reducing carbon pollution; leading international attempts to approach climate change; and preparing the US for the effects of climate change. The measures already adopted on climate change provide an opportunity to examine the possibilities that the president has to implement his climate action plan through executive powers without Congress. The decision to advance the political agenda through executive decisions is at least partly attributable to the partisan gridlock currently gripping US politics. The reach and effect of the executive decisions to address climate change outlined in the climate action plan are yet to be determined. The topical question seems to be whether the actions already taken offer hope that the US will reach its target to reduce carbon pollution and slow the effects of climate change, or whether legislative action from Congress will be called for. Although climate change is now being addressed through executive actions that do not require new legislation from Congress, this does not rule out the possibility that legislation will be passed in the future.

Abstract:
Since gaining independence in December 1991, Ukraine has vacillated between the European Union and Russia for economic and political cooperation. Until recently neither had offered Ukraine much, but in the last few months, things have heated up. Ukraine's intention to sign an Association Agreement for political association and economic integration with the European Union has raised a furor in the Kremlin, which is now trying to block Ukraine from aligning itself with the European Union. Moscow has imposed trade sanctions in clear violation of its obligations in the World Trade Organization (WTO) and is pursuing an intense confrontation.

The possibilities for future Asia-Pacific security cooperation between Australia and Canada are promising. Economic development and population growth mean that security challenges present themselves as opportunities. Australia and Canada are well positioned to influence regional approaches to transnational challenges such as crime, terrorism, piracy and environmental degradation, and to contribute to food, energy and cyber security. This paper explores the current state of security cooperation between Australia and Canada in the Asia-Pacific, and identifies opportunities to extend the relationship, focussing on collaborative efforts like economic and maritime cooperation, which may help tackle transnational security challenges.

Abstract:
This paper examines the prospect and utility of closer defence cooperation for both Canada and Australia. It reflects on commonalities and like-mindedness, particularly as they concern regional security and stability in the Indo-Pacific. Forward-looking measures are presented for Canadian and Australian defence policy makers to capitalize on each other\'s strengths and similarities. Cooperation could enhance both countries\' ability to engage in the region, their mutual defence capabilities and their engagement with the great powers. With this in mind, closer bilateral engagement should be considered in three areas: bolstering regional engagement, cost-saving measures and enhancing engagement with great powers.

337. Transitional Justice and Colombia's Peace Talks

If the Santos administration and the Revolutionary Armed Forces of Colombia (FARC) are to lay the foundations for lasting peace as they continue to make head-way toward successfully concluding talks underway since late 2012, they need to agree on a clear, credible and coherent plan for dealing with human rights abuses committed by all sides. This is not easy. Any sustainable agreement must be acceptable well beyond just the two parties. Finding common ground between the guerrillas, the government, the critics of the peace talks, victims and a public largely unsym- pathetic to FARC would be difficult at the best of times but will be even harder on the cusp of the 2014 electoral cycle. However, with courts, Congress and voters all having important roles to play in ratifying and implementing transitional justice measures, both parties' long-term interest in a stable transition should outweigh the costs of agreeing to a deal that goes beyond their own narrow preferences. Otherwise, flagging popular support, political controversy and legal challenges risk undermining both justice and peace.

Abstract:
The presence of Indonesian President Susilo Bambang Yudhoyono at the G20 Summit in St Petersburg in early September went virtually unnoticed by the European media. That his attendance was overlooked can be explained by immediate factors, namely the overriding importance of the Syrian conflict in the discussions among leaders, and the fact that SBY (as President Yudhoyono is commonly known) is a lame-duck president with less than a year to go before the end of his two-term limit. Lacking BRIC status (for now at least), Indonesia – unlike China, India or even Brazil – barely registers on the radar screen of public awareness in Europe. Symptomatic of this neglect is the fact that, almost four years after its signing in November 2009, two EU member state parliaments (and the European Parliament itself) have yet to ratify the EU-Indonesia Partnership and Cooperation Agreement.

340. Transitional Justice for Syria

Abstract:
Transitional justice is the provision of justice in the transition from one form of government, often perceived as illegitimate, unjust, and tyrannical, or an anarchic society, to one that observes the rule of law and administers justice. It also is about choices: how to allocate scarce prosecutorial, judicial, police, and prison resources. The goal is to make the rule of law ordinary. A 2004 report of the United Nations (UN) Secretary-General on the rule of law and transitional justice in conflict and postconflict societies observed that most examples of transitional justice involved states emerging from civil war or widespread civil unrest such that government became impossible.
