181. Nepal: Beyond Royal Rule

Abstract:
Nepal is in turmoil and the monarchy is in question. King Gyanendra had calculated that his authoritarian moves since October 2002 would return order to a land wracked by Maoist insurgency and political instability but he has failed. The seven months since the royal coup have seen security degenerate under a royal government with no plans for peace and democracy. The Maoists seized the initiative by announcing a unilateral three month ceasefire on 3 September 2005. The international community needs to recognise that its calls for palace/political party reconciliation as the sole path toward stability are unrealistic. New lines need to be explored, beginning with support for the ceasefire and the tentative dialogue underway between the parties and the Maoists.

Abstract:
The United States has been lobbying the UN Security Council to pass a new resolution about reinforcing Lebanon's sovereignty, building on the October 25, 2005, report by UN envoy Terje Roed-Larsen on the implementation of UN Security Council Resolution 1559. That resolution, adopted on September 2, 2004, called for the disbanding and disarmament of all militias in Lebanon, the extension of Lebanese government control over all Lebanese territory, and the strict respect of Lebanese sovereignty. Important as each might be in light of recent developments, the Resolution 1559 requirements are closely interconnected.

Abstract:
Extensive scholarly works on the issue of autonomy and indigenous self-governance show that legal concepts of autonomy suffer from much confusion. In the following study, I present a survey of the concept of governance in the legal scholarship in attempting to develop normative grounds for the right to autonomy. This paper is divided into two parts. At the outset it deals with general considerations of theoretical aspects of the concept of autonomy in public law1 and examines the extent to which the right to autonomy can be defined and justified in light of international and comparative constitutional legislation.

184. The U.S. and Transatlantic Relations: On the Difference between Dominance and Hegemony

Abstract:
It is important to distinguish hegemony from dominance, as various authors like Machiavelli, Gramsci, and Nye have argued. This distinction allows one to appreciate that the first Bush Administration attempted to be a dominant power rather than a hegemonic one. A long list of assertions of essentially unilateral dominant power projections is actually buttressed by two pillars: primary of hard power but also American exceptionalism. By comparison to Europe, the George W. Bush version of American exceptionalism emphasizes traditional and absolute U.S. state sovereignty, a corresponding depreciation of international law and organization, parochialism, and non-muscular multilateralism. Because of all this the U.S. is largely responsible for the crisis in Atlanticism. The Europeans, however, have made their own contributions to this crisis. The crisis needs to be resolved, as the management of various international problems requires trans-Atlantic cooperation. Fortunately there are signs of movement toward this cooperation, although the signals are mixed on the U.S. side.

Abstract:
Democratic legitimacy for the EU is problematic if it is seen as a future nation-state. If instead the EU were seen as a regional state—with shared sovereignty, variable boundaries, composite identity, compound governance, and a fragmented democracy in which the EU level assures governance for and with the people through effective governing and interest consultation, leaving to the national level government by and of the people through political participation and citizen representation—the problems of the democratic deficit diminish for the EU level. But they become even greater for the national level, where the changes to national democratic practices demand better ideas and discourses of legitimization. A further complicating factor results from problems of “institutional fit,” because the EU has had a more disruptive impact on “simple” polities, where governing activity has traditionally been channeled through a single authority, than on more “compound” polities, where it has been more dispersed through multiple authorities.

186. The Central-Local Division of Power in the Americas and the Renewed Mexican Federalism (Old Institutions, New Political Realities)

Abstract:
This research paper explores whether the central-local division of power is an important institutional variable in the operation of political systems in the Americas. It develops a typology of central-local divisions of power in the hemisphere based on two specific characteristics that differentiate them (federal-unitary and centralized-decentralized), and discusses the relevance of the institutional and partisan configurations of the system in the workings of this variable. Then, it constructs a veto gates and veto players model in order to analyze the causal mechanism through which the centrallocal division of power impacts political systems in the Americas. It then presents two examples (with variations in time and space) to support the argument that the central-local division of power's relevance depends on its type, the institutional configuration, and party composition of the system. In doing so, it analyses the Mexican federal system, arguing that renewed Mexican federalism and its consequences in terms of democratic governance and the efficient provision of public policies is a result of the concurrence of old institutions with the new political reality, that is, the intersection of the old institutional framework and the new partisan configurations of the Mexican political system.

187. The EU's Security Policy Towards the Mediterranean: An (Im)possible Combination of Export of European Political Values and Anti-terror Measures?

Abstract:
The Southern part of the Mediterranean has been put high on the EU-security agenda after 9/11. The Working paper makes the argument that the EU-politics towards its Arab Mediterranean neighbours are staggering between a status quo oriented politics and a politics of export of democracy. The tension is seen as an expression of two conceptualizations of the Mediterranean and the uneasy combination of four contradicting concepts on the relationship between the Mediterranean and the EU. The first conceptualization is about the Mediterranean as a cultural cradle of great civilizations. The other one is about the Mediterranean as a conflict-ridden zone. These conceptualizations are interlinked in the discourses on how to export security to the South and which kind of security the EU has to promote. The inter-linkage between the two conceptualization of the Mediterranean is furthermore linked up to two oppositional representations of the EU: the EU as an exporter of democracy and the EU as being a model to copy but not an empire-builder. This results in the following dilemmas caused by the oppositional relationship between four concepts: Respect for cultural diversity and export of political shared values. Respect for Arab sovereignty and export of European political values. The opposition between the four concepts is sharpened by Islamic terrorism which underlines the uneasy 'marriage' of the four concepts.

This study analyzes the issue of self-determination, territorial integrity and international stability, within the Yugoslav context. However, it is not confined to the Yugoslav case of self-determination alone. The study stretches over other several cases of self-determination and analyzes the historical background of the phenomenon itself. The argument of this dissertation in terms of the history of self-determination, is that the phenomenon has gradually crystallized over the last two centuries. In addition, self-determination is viewed in connection with two other issues: territorial integrity and international stability. In fact, these two segments have been and remain intrinsic to every discussion of selfdetermination. The historical part of the problem also is comprised of scholarly work and the judicial practice that have lead to the final formulation of self-determination as it stands at the present.

It is common practice among early modern French historians to interpret society, culture, and politics through an analysis of the metaphors, narratives, and rituals that mediated the relationship between sovereigns (kings and queens) and the nation. La Mort du Roi: Un essai d'ethnographie politique comparée transposes this practice to the modern period, in particular by focusing on the discourses and rituals surrounding dying and dead heads of state in France and elsewhere. It was the death of François Mitterrand in 1996 that provided the inspiration for this transposition, worked out in a year-long seminar organized by Jacques Julliard in 1996 and 1997 at the École des Hautes Études en Sciences Sociales.

Abstract:
American global power – military, economic, technological, cultural, and political – is one of the great realities of our age. Never before has one country been so powerful and unrivaled. The United States began the 1990s as the world's only superpower and its advantages continued to grow through the decade. After the Cold War, the United States reduced its military spending at a slower rate than other countries and its economy grew at a faster pace. The globalization of the world economy has reinforced American economic and political dominance. No ideological challengers are in site. More recently, in response to terrorist attacks, the United States has embarked on a massive military buildup. In the recent National Security Strategy, the Bush administration has articulated an ambitious and provocative global military role for the United States in confronting new-age threats. Overall, American power advantages are multidimensional, unprecedented, and unlikely to disappear any time soon. The world has taken notice of these developments. Indeed, the post-Cold War rise of American power -- what might be called the rise of American "unipolarity" -- has unsettled world politics. Governments everywhere are worried about the uncertainties and insecurities that appear to flow from such extreme and unprecedented disparities of power. The shifting global security environment – triggered by the terrorist attacks of September 11th –also has conspired to upset old relationships and expectations. The American invasions of Afghanistan and Iraq have put American power on display and raised far-reaching questions about the use of force, alliances, weapons of mass destruction, sovereignty and interventionism. The world is in the midst of a great geopolitical adjustment process. Governments are trying to figure out how an American-centered unipolar order will operate. How will the United States use its power? Will a unipolar world be built around rules and institutions or the unilateral exercise of American power? This global worry about how a unipolar world will operate – in which the most basic questions about the character of world politics are at stake, namely, who benefits and who commands – is the not-so-hidden subtext of all the recent controversies in America's relations with the rest of the world. The question posed in this report is: how are the major countries around the world responding to American global preeminence? Overall, strategies and policies are mostly still in flux around the world. Responses up to now have been mostly ad hoc. Governments are learning, adapting, negotiating, and reacting – thus it is not possible to identify fixed "strategies of response." This report seeks to help us understand these evolving responses in two ways: first, it will provide conceptual tools to identify and track strategic responses by major states to American preeminence, and second, it will offer some preliminary characterizations of the patterns of response, particularly by Western Europe, Russia, and China. This report might be seen as a sort of "field guide" to global reactions rather than a definitive theoretical and empirical statement on the subject. I begin by offering a summary of the findings. After this, I look at the rise of American unipolar power and the variety of ways that American power is "experienced" around the world. In the next section, I survey the deeper sources and multifaceted character of American unipolar power. Next I explore the limits of the basic strategies of response to concentrated power – balancing, bandwagoning and binding. In the next section, I explore some of the emerging strategies that are appearing among the major countries. Finally, in the conclusion I return to the issue of unipolar power and rule-based order.
