Abstract:
Kosovo's independence declaration on 17 February 2008 sent shock waves through Serbia's politics and society, polarising the former in a manner not seen since the Milosevic era. Rio ting led to attacks on nine Western embassies, destruction of foreign property and massive looting. The government fell on 10 March, split over whether to pursue a nationalist or pro-Western path. Belgrade's efforts to create a de facto partitioning of the north of Kosovo threaten the new state's territorial integrity and challenge deployment of European Union (EU) missions there, and Serbian parliamentary and local elections on 11 May are unlikely to change the basic policy towards the new state, even in the unlikely event a pro-Western government comes to power. They may, however, well give Serbia's nationalist parties new leverage.

Over the past year, sovereign wealth funds (SWFs) have leapt from the back pages in business sections of financial newspapers to lead stories on the Internet. Defenders of SWFs argue that they are benign, long-term investors that provide needed capital transfusions to hard-pressed private financial institutions. At the same time, political controversy surrounds SWFs in many countries including their own. Moderate voices have called for agreement on a set of best practices for SWFs.

Abstract:
Together with developments in international criminal justice and humanitarian law, the human rights revolution in international law has had a profound structural effect on the international legal order as a whole; we are today only beginning to discern and to digest this effect, to say nothing of the broader consequences for global politics. New actors have been empowered in the international legal system (not only individuals but various kinds of non-state collectivities as well); conceptions of responsibility have been altered; classic notions, such as territorial sovereignty and recognition of statehood, have sometimes subtly and sometimes radically been reshaped or adapted; and the balance of institutional actors charged with interpreting and applying inter-national law has shifted towards courts and tribunals (a major theme of Petersmann) and away from diplomats and their ministers.

155. Somalia: To Move Beyond the Failed State

Abstract:
Since 1991 Somalia has been the archetypal failed state. Several attempts to create a transitional set-up have failed, and the current one is on the brink of col-lapse, overtaken yet again by an Islamist insurgency, despite the support of an Ethiopian military intervention since December 2006. Over the last two years the situation has deteriorated into one of the world's worst humanitarian and security crises. The international community is preoccupied with a symptom – the piracy phenomenon – instead of concentrating on the core of the crisis, the need for a political settlement. The announced Ethiopian withdrawal, if it occurs, will open up a new period of uncertainty and risk. It could also provide a window of opportunity to relaunch a credible political process, however, if additional parties can be persuaded to join the Djibouti reconciliation talks, and local and international actors – including the U.S. and Ethiopia – accept that room must be found for much of the Islamist insurgency in that process and ultimately in a new government dispensation.

This report evaluates the international community's response to the conflict in Abkhazia. It recommends a package of immediate measures to the Georgian and Abkhaz sides to prevent the escalation of violence. As part of a multi-year strategy, it also suggests steps that Georgians, Abkhaz, and international stakeholders can take to lay the ground for future negotiations. In addition, the report proposes a diplomatic initiative by the United States and the European Union (EU) that would restore Georgia's sovereignty, while preserving the interests of Abkhaz.

Abstract:
The conventional separation in IR theory between instrumental behavior and legitimated norms as explanations for state action has discouraged the study of phenomena that include both. As a result important practices including hypocrisy, norm violation, and the strategic reinterpretation of rules and laws are under-examined. The source of the problem is the idea of 'internalization' of external rules and norms, which has come to define the distinction between rationalism and constructivism in IR, and between the logics of appropriateness and of consequences. I argue that internalization is problematic for empirical research in IR because it eliminates the possibility of strategic thinking by states in relation to international norms and rules. It leaves no room for instrumentalism around norms and so cannot account for norm violation, the strategic manipulation of norms, and the productive process of norm innovation. This is a problem equally for rationalism and constructivism. I argue for an alternative model that focuses on the practice of invoking international norms and rules and show that this approach allows new insight into the agent-structure problem, the relation between states and rules in world politics, and the relation between rationalism and constructivism.

Abstract:
THIS SEPTEMBER marks the fifteenth anniversary of the signing of the Oslo accord that was expected to bring peace to the Middle East. It is doubtful that the date will be widely celebrated. By now it is clear that the 13 September 1993 Declaration of Principles, though it resulted in the creation of a Palestinian self-governing authority, failed to lead to peace. For the Palestinians, it resulted in the parceling of the West Bank, the doubling of Israeli settlers, the construction of a crippling separation wall, a draconian closure regime, and an unprecedented separation between the Gaza Strip and the West Bank. Far from being celebrated, Oslo in many quarters in the occupied territories and the Palestinian diaspora is at best desperately clung to as a last-ditch legal basis for some form of a Palestinian state, and at worst vilified as the beginning of the end of Palestinian hopes for meaningful sovereignty.

Abstract:
In the referendum on the Treaty of Lisbon in June 2008, Irish voters who voted against the Treaty gave several specific reasons as well as a variety of vague or general reasons that were unrelated to anything that was in the Treaty. These vague or general reasons are important because they probably were also significant influences in the “no” votes in France and the Netherlands. Moreover, they may be shared by a substantial but unknown number of people in other EU member states who did not get an opportunity to vote in a referendum on the Lisbon Treaty or the Treaty for a Constitution. There were positive referendum results in Luxembourg and Spain. Other countries promised referenda, but did not hold them.

Abstract:
Last month, Tehran announced it was building maritime offices on the Persian Gulf island of Abu Musa, reigniting the long-standing territorial dispute between Iran and the United Arab Emirates (UAE). Since 1970, the disagreement over the island and the neighboring Greater and Lesser Tunbs has been mired in legal uncertainty and historical claims and counterclaims, hindering diplomatic relations between Iran and the Gulf Arab states. The recent diplomatic intensity surrounding the issue, however, including the UAE's August 21 formal protest to UN secretary-general Ban Ki-Moon, is a significant break from the past, and may be a forerunner to a future escalation. Considering the importance of the islands -- all three are strategically located near the Strait of Hormuz, where 20 percent of the world's oil passes daily -- the dispute's outcome is deeply tied to the interests of the United States and the international community.
