Abstract:
This article analyses the interplay between politics and law in the recent attempts to strengthen the humanitarian commitment to saving lives in mare liberum. Despite a long-standing obligation to aid people in distress at sea, this so-called search and rescue regime has been marred by conflicts and political standoffs as states were faced with a growing number of capsising boat migrants potentially claiming international protection once on dry land. Attempts to provide a legal solution to these problems have resulted in a re-spatialisation of the high seas, extending the states' obligations in the international public domain based on geography rather than traditional functionalist principles that operated in the open seas. However, inadvertently, this further legalisation has equally enabled states to instrumentalise law to barter off and deconstruct responsibility by reference to traditional norms of sovereignty and maritime law. In other words, states may be able to reclaim sovereign power by becoming increasingly norm-savvy and successfully navigating the legal playing field provided by the very expansion of international law itself. Thus, rather than being simply a space of non-sovereignty per se, mare liberum becomes the venue for a complex game of sovereignty, law and politics.

US-Brazilian relations sunk to one of their lowest points ever following last year's exposure of the US government's massive surveillance of the South American giant-including the correspondence of President Rousseff and the business operations of Brazil's national oil company, Petrobras. Brazilian authorities responded angrily. The Brazilian president called off a highly valued state visit to Washington, denounced the US for violations of sovereignty and human rights, and proceeded to bypass the US to purchase nearly $5 billion worth of fighter aircraft from Sweden. In fact, US-Brazil ties have not been constructive for more than a generation. Yes, relations are mostly amiable, but with limited cooperation, considerable discord and some open clashes. Washington views Brazil primarily as a regional actor, and wants its cooperation mainly on inter-American issues. For Brazil, regional collaboration means working with other Latin American nations-not the United States. Brazil usually wants the US to keep a distance from the region. The US is no more enthusiastic about Brazil assuming a global role; differences over some of the world's most dangerous political and security challenges have made Washington uneasy about Brazil's engagement in international affairs and critical of its foreign policy judgements. Relations will probably improve, but they could get worse. The two governments need to acknowledge that their relationship is fragile and troubled, and take steps both to rebuild trust and to avert further deterioration and new confrontations. They have to be more careful with each other.

104. Hooray for Global Justice? Emerging Democracies in a Multipolar World

Rising powers are fundamentally shifting the relations of power in the global economic and political landscape. International political theory, however, has so far failed to evaluate this nascent multipolarity. This article fills this lacuna by synthesizing empirical and normative modes of inquiry. It examines the transformation of sovereignty exercised by emerging democracies and shows that – in stark contrast to emerging democracies' foreign policy rhetoric – the "softening" of sovereignty has become the norm. The present paper assesses this softening of sovereignty on the basis of a "democratic-internationalist" conception of global justice. This conception holds that global justice demands the establishment of reasonably democratic transnational relations that enable people themselves to determine what else justice requires. Because we find that the exercise of soft sovereignty by emerging democracies contributes to the realization of reasonably democratic transnational relations, we conclude that this nascent multipolarity ought to be welcomed from the democratic-internationalist view of global justice.

The distributed nature of Internet infrastructure and relatively malleable user engagement with content can misleadingly create the impression that the Internet is not governed. When Internet governance does rise to media or public prominence, this usually involves high-profile controversies such as the Egyptian government cutting off citizen Internet access or government-delegated censorship requests for Google to delete politically sensitive content. These are examples of Internet content governance via infrastructure. But beneath this layer of content, at much more technologically concealed layers, coordinated and sometimes centralized governance of the Internet's technical architecture is necessary to keep the network operational, secure and universally accessible. This governance is enacted not necessarily through traditional nation-state authority but via the design of technical architecture, the policies enacted by private industry and administration by new global institutions. While these coordinating functions perform highly specialized technical tasks, they also have significant economic and political implications.

In a globalizing world, the field of human rights has attempted to reach a universal moral consensus that transcends state sovereignty. The creation of the International Criminal Court (ICC) in 1998 provided a new mechanism to support these efforts. Although the jurisdiction of the Court extends across the globe, so far all of the investigations have taken place on the continent of Africa. This fact, along with the details of the cases the Court has taken up, has sparked questions concerning neocolonialism and the political independence of the Court. In order for the Court to improve its reputation in the global community, it must acknowledge, address, and work toward remedying these genuine concerns in a just and open manner. The inability of the ICC to overcome accusations of neocolonialism and the continual obstacle of state sovereignty evidence the complex impact that globalization has had on international criminal law. The ICC has the potential to bring violators of international criminal law to justice, but in doing so it must avoid promoting impunity among the politically powerful and recognize that there are some situations in which arrest warrants and criminal prosecution cannot bring peace.

Abstract:
This paper critically explores Carl Schmitt's theory of democracy. I present the emergence of the democratic principle of legitimacy as described by Schmitt, then elaborate on the people as sovereign qua constituent power and present its threefold relationship with the constitution. Later I formulate three lessons to be taken from Schmitt's theory and discuss its importance and implications for democratic theory in terms of the normative and formative principle of democracy, core subject and core mode of democratic politics, and conditions of possibility of constituent democratic politics. In concluding Part I discuss the difference between liberal, republican and deliberative model of democracy and Schmitt-inspired theory.

Twenty-one years after the collapse of the Soviet Union, the international community has not yet managed to solve the four separatist conflicts that broke out in the wake of the USSR's demise. With the help of their patron states (Russia and, in the case of Nagorno-Karabakh, Armenia), the self-proclaimed Republics of Transnistria, Abkhazia, South Ossetia and Nagorno-Karabakh have become de facto states with separate political institutions and economic structures.
