2801. WHERE IS IRAQ HEADING? LESSONS FROM BASRA

Abstract:
Amid the media and military focus on Baghdad, another major Iraqi city – Basra – is being overlooked. Yet Basra's experience carries important lessons for the capital and nation as a whole. Coalition forces have already implemented a security plan there, Operation Sinbad, which was in many ways similar to Baghdad's current military surge. What U.S. commanders call “clear, hold and build”, their British counterparts earlier had dubbed “clear, hold and civil reconstruction”. And, as in the capital, the putative goal was to pave the way for a takeover by Iraqi forces. Far from being a model to be replicated, however, Basra is an example of what to avoid. With renewed violence and instability, Basra illustrates the pitfalls of a transitional process that has led to collapse of the state apparatus and failed to build legitimate institutions. Fierce intra-Shiite fighting also disproves the simplistic view of Iraq neatly divided between three homogenous communities.

In late March 2007, arrests by Densus 88, the police counter-terror unit, netted seven detainees in Central and East Java (an eighth was killed); a huge cache of explosives and weaponry; and documents that seemed to suggest a new military structure for Jemaah Islamiyah (JI), the region's largest jihadist organisation. The arrests followed directly from information obtained from operations in Poso, Central Sulawesi, in late January.

2803. Abkhazia: Ways Forward

Abstract:
Fourteen years of negotiation, led alternately by the UN and Russia, have done little to resolve the Georgian-Abkhaz conflict. There have been some successes on the ground: ceasefire violations are rare, approximately 45,000 internally displaced (IDP) Georgians have returned to homes in the Gali region, the two sides cooperate on operating the Inguri power plant, and a strategic railway through Abkhazia may restart. But the sharp deterioration in Russian-Georgian relations and a Georgian military adventure in the Kodori valley have contributed to a freeze in diplomacy over Abkhazia since mid-2006. In the absence of a new initiative, new violence is a real possibility. Because prospects are bleak for an early comprehensive settlement of the key political issues, in particular final status, the sides and international facilitators should shift their focus in 2007 to building confidence and cooperation in areas where there are realistic opportunities.

Despite the public bluster of the Islamic Republic of Iran, the regime's behavior shows that it suffers from deep self-doubt. The arrests of visiting Iranian-born U.S. scholars Haleh Esfandiari (director of the Middle East program at the Woodrow Wilson Center) and Kian Tajbakhsh (a consultant for philanthropist George Soros's Open Society Institute programs) reflect Tehran's fear that political change could be easily sparked. A May 22 ABC News report that President Bush has authorized a covert CIA program against the regime will only add to Iran's suspicions.

On April 14, suicide bombers unsuccessfully targeted the U.S. consulate and an American cultural center in Casablanca, four days after another group of bombers blew themselves up in a confrontation with city police. On April 11, al-Qaeda in the Islamic Maghreb (formerly the Salafist Group for Preaching and Combat, or GSPC) claimed responsibility for two suicide car bombings in Algiers, one targeting the prime minister's office and the other a police station. No group has claimed responsibility for the Moroccan incidents, but together with the Algerian attacks -- which killed 33 and wounded up to 330 -- they indicate that both northwestern Africa and the United States face an acute threat from established regional militant groups allied with international terrorist networks.

Abstract:
In the coming weeks, Syria will participate in two important regional conferences. On March 10, it will join Iraq's other neighbors and the five permanent members of the UN Security Council in Baghdad. On March 28-29, it will participate in the Arab League summit in Riyadh. Syria's detractors continue to criticize Damascus for failing to seal the border with Iraq and for meddling in Lebanese internal affairs in violation of UN Security Resolution 1701. Of equal importance is the downturn in Syria's relations with Saudi Arabia and Iran. Last week's Saudi-Iranian summit has Damascus worried about its role in Lebanon and the possibility of an international tribunal on the assassination of former Lebanese prime minister Rafiq Hariri, a crime for which Syria is widely believed to be responsible. Will the upcoming conferences give Syria a chance to improve its regional standing, or will its isolation continue?

2810. Jurisdiction and Compliance in Recent Decisions of the International Court of Justice

Abstract:
International institutions are plagued by too many expectations and too little power. One striking example is the International Court of Justice. Its malcontents criticize the Court as an ineffective player in achieving international peace and security, largely because of its perceived inability to control state behaviour. Scholars have long blamed this on the ICJ's 'flawed' jurisdictional architecture, which is based entirely on consent. Anything less than a clear indication of consent by the defendant state in a given case is thought to run serious non-compliance risks. This article takes issue with that assessment. By analysing the ICJ's final decisions since the landmark case of Nicaragua v. US, one finds that the manner in which the ICJ was seised of jurisdiction is actually a poor predictor of subsequent compliance. Rather, through complex mechanisms of authority signal and the political inertia induced by those decisions, almost all of the Court's decisions have achieved substantial, albeit imperfect, compliance. Thus, despite the likelihood that states will continue to reduce the scope of the ICJ's compulsory jurisdiction, the World Court will remain a vital, if limited, tool in resolving inter-state disputes and a force for world public order.
