151. Syria Calling: Radicalisation in Central Asia

Abstract:
Growing numbers of Central Asian citizens, male and female, are travelling to the Middle East to fight or otherwise support the Islamic State (IS, formerly ISIL or ISIS). Prompted in part by political marginalisation and bleak economic prospects that characterise their post-Soviet region, 2,000-4,000 have in the past three years turned their back on their secular states to seek a radical alternative. IS beckons not only to those who seek combat experience, but also to those who envision a more devout, purposeful, fundamentalist religious life. This presents a complex problem to the governments of Central Asia. They are tempted to exploit the phenomenon to crack down on dissent. The more promising solution, however, requires addressing multiple political and administrative failures, revising discriminatory laws and policies, implementing outreach programs for both men and women and creating jobs at home for disadvantaged youths, as well as ensuring better coordination between security services.

Abstract:
In this review of three works (Jörg Kammerhofer’s Uncertainty in International Law: A Kelsenian Perspective; Jean d’Aspremont’s Formalism and the Sources of International Law: A Theory of the Ascertainment of Legal Rules ; and International Legal Positivism in a Post-Modern World, a collection of essays edited by Kammerhofer and d'Aspremont), Mónica García-Salmones Rovira argues that: Theological statements about morality and law to the effect that they ought to be autonomous or that they ought to coincide defy reality, history and common sense and suffer from intellectual inconsistency. On the contrary, from our long legal history appear at least two clear facts about the relationship between morality and law. First, they both conflate in the same acting individual. Second, in the legal sphere, the individual always acts in communication with other individuals. Whether one aims at investigating the normative principles of the first fact, of what makes a good lawyer, or of the second, of what makes good law and the related issue of responsibility, we are always thinking in terms of practical action. Probably, it is in that practical province where international law has its greater emancipatory potential in a post-modern world.

153. The International Legal Status of the Vatican/Holy See Complex

Abstract:
This article offers a re-examination of the international legal status of what is here termed the Vatican/Holy See complex (VHS), focusing on claims to statehood. The problematic ‘effect’ of Vatican City, of the Holy See, of the papacy and of associated entities is interrogated at the level of international law, entering as little as possible into administrative or theological distinctions. The various grounds cited as supporting status amounting to statehood are argued to be inadequate. The continuing exchange of representatives with states by the VHS is missionary and hierarchical in character and is reflective neither of the reciprocity of peers nor of customary obligation going to law. Agreements entered into by the papacy with the Kingdom of Italy (the Lateran Pacts) in 1929, relating to the status of the geographical territory known as Vatican City, cannot be determinative of international status. Nor can membership of international agreements and organizations confer a status amounting to statehood. Events and practices since 1929 have not substantially altered international status as of 1870. The Roman Catholic Church is but one of many faith-based international movements, and since the eclipse of the papal state nearly one-and-a-half centuries ago, the status in international law of its temporal headquarters in Rome should not be privileged.

Sufis are the spiritual guides who aspire for closer union with God. Islam is an exterior edifice in which an entity subsists, whilst the inner exploration for enlightenment belongs to an ambit of Sufi realization. The Sufi approach endeavors to mend a human demeanor and to open up human vistas to the sublime amity that comes from propinquity to God. Sufism is a devotional and spiritual current in the Islamic history. Sufism enlightens society to abstain from spitefulness, barbarianism, bigotry, sadism and discrepancy. Now it has been subject matter to the strain of modernization experienced across the Muslim world and people are faced with terrorism on its peak. The present-day approach of sadism and belligerence calls for a good propel for the message of Sufi Diaspora for the alteration of traumatized mental approach of the populace. The conflict ridden people really have a pursuit for peace. Sufi ideas generously contribute to the harmony and relief. Islam is a great and splendid religion now has become maligned due to atrocities of ‘Jehadis’ in the label of religion. Fundamentalism has amended the motif and spirit of Islam. Pakistan as a soil of Sufis, longs for serenity and harmony. Sufis are the people who believe in tolerance, love and well being of all humanity. It is necessary to follow the doctrine of Sufism in the world of turmoil and tribulations and to address the most serious issues like lack of interfaith harmony, terrorism, exploitation in Pakistan. The intention of this study is to explore the role of major Sufi saints in Sub-continent for preaching religion on the instructions of their sacred mentors and people have faith on Sufi Saints.

Abstract:
In the past three decades, Chinese Iranian and Middle East Studies have become more and more systematic, which is reflected not only in the great volume of publication, but also in the varied research methodologies and the increase in Iranian and Middle East academic journals. The development of Chinese Middle East studies have accelerated in particular after Arab Spring revolutions and the political changes in the Middle East (2000- 2013). Research institutes evolved from state-controlled propaganda offices into multi-dimensional academic and non-academic entities, including universities, research institutes, military institutions, government offices, overseas embassies and mass media. At the same time, publications evolved from providing an introduction and overview of Iran and Middle Eastern states to in-depth studies of Middle East politics and economics in three stages: beginnings (1949- 1978), growth (1979- 1999), and dealing with energy, religion, culture, society and security. The Middle East-related research programs' funding provided by provincial, ministerial and national authorities have increased and the quality of research has greatly improved. And finally, China has established, as well as joined, various academic institutions and NGOs, such as the Chinese Middle East Studies Association (CMESA), the Asian Middle East Studies Association (AMESA) and the Arabic Literature Studies Association (ALSA). However, Chinese Middle East Studies remain underdeveloped, both in comparison with China's American, European, and Japanese studies at home, and with Middle East studies in the West.

Abstract:
This article explores Iranian women's identities reflected in documentary films made during the post revolution era. By doing so, it draws attention to the complexities of representation with regard to the position of women and the current cultural policies in Iran from a legal, religious, and traditional point of view. The documentary films are divided into two categories: those made by Iranians residing in Iran and those made by the Diaspora documentary filmmakers, we then examine and compare their content and themes. This will in turn demonstrate the relationship between the two groups of Iranian documentary film makers and the subjects they address. The selected documentaries made in Iran for this study are sponsored by the state, through the Experimental and Documentary Film Centre (DEFC). This essay will analyze the way the two categories of documentary films [by state and Diaspora] address women's issues through the themes they cover, their agendas, as well as the adopted aesthetics. These documentary films show the social empowerment of Iranian women as active agents in a society that sets obstacles in women's paths. The comparison of the two categories of documentary films may thus show the relation between Iranians residing in Iran and those in the Diaspora, which can play a role in Iran's position internationally. This research looks into three films: Mokarrameh, Article 61 and Divorce, Iranian Style. It will also assess their content and character, and explain what each documentary reflects regarding women's status in society in that particular era with respect to its theme i.e. law, tradition and religion.

159. The Central African Republic – a history of a collapse foretold?

Abstract:
Political instability and administrative weakness have been permanent features of the Central African Republic (CAR) ever since independence. This is, therefore, the history of a collapse foretold. Michel Djotodia may have had good intentions when he put together the Séléka alliance; the problem was that the only thing that kept it together was the desire to get rid of François Bozizé. When Bozizé was gone, the coalition's internal coherence also disappeared. Thus, for lack of other options, the alliance members continued to make their livelihoods based on plunder. As the situation worsened, the communities plundered established their own militias, and the stage was set for a simmering sectarian conflict between Christians and Muslims. It is in this mess of communal violence that the international forces are supposed to re-establish law and order. The main challenge, however, is how to avoid adding fuel to the sectarian fire. The international forces must tread carefully, and any attempt at disarming militias must be conducted with this in mind. What has happened and is happening is tragic, but it is neither genocide nor a full-blown sectarian conflict. This can still be avoided if the international forces behave impartially with regard to the two main religious communities in the country.

Although President Rouhani has persuaded the Supreme Leader to adjust the IRGC's economic functions, he has not challenged its role in shaping Iran's nuclear policy. President Hassan Rouhani's relationship with Iran's Islamic Revolutionary Guard Corps (IRGC) is a central dynamic in the country's politics and economy. As always, Ayatollah Ali Khamenei ultimately determines the roles of the president and the IRGC, so Rouhani has sought to pursue his economic imperatives without crossing the Supreme Leader or the military elite on the nuclear issue.
