131. The Visegrad Co-operation, Poland, Slovakia and Austria in the Czech Foreign Policy: Coping with Irritants?

Abstract:
Since the developments in Central Europe were very dynamic in 2017, the importance of the Visegrad co-operation, Poland, Austria and Slovakia in the Czech foreign policy has grown. The general elections in Austria, the judicial reform in Poland and the subsequent triggering of Article 7 of the Treaty of the EU against Poland, the Polish and Hungarian EU Presidencies and various EU dossiers, such as the dossier on the reform of the EU’s asylum system, would all suggest that the Czech Republic should have paid more attention to the region. However, the Czech Republic chose rather a free-riding and adaptational approach toward it, and in some cases, it has shown disinterest in its policy vis-à-vis the region. There were fewer political contacts with and initiatives related to the other V4 states than in the previous years, and the Czech foreign policy was not able to address major dilemmas of the Central European policy. Interestingly, at the same time, the importance of the region was reflected in a higher politicisation and polarisation of the issues related to the Visegrad Group, Poland and Hungary.

Abstract:
The Russian economy is caught in stagnation, but thanks to a skillful macroeconomic policy, the economy has stabilized. The current economic model is dualistic. On the one hand, the so-called systemic liberals are in charge of macroeconomic policy, which they pursue eminently. On the other, President Vladimir Putin allows state corporations, cronies, and law enforcement agencies to dominate the corporate economy, enriching themselves with little consideration of legality. Anders Aslund's paper discusses the state of the Russian economy and the prospects for reform and growth.

133. Land Acquisition in India: A Review of Supreme Court Cases (1950-2016)

Abstract:
Context: India faces serious challenges in creating development processes that generate economic growth while being socially inclusive, ecologically sustainable, politically feasible, and in accordance with the Rule of Law. Equitable and efficient acquisition of land by the state for economic development projects, including infrastructure and industry, lies at the heart of these challenges. Simultaneously, securing constitutionally guaranteed land rights to the poorest and most vulnerable communities in India against the state and other dominant communities, has been considered crucial to their economic and social empowerment. Land is not only an important economic resource and source of livelihoods, it is also central to community identity, history and culture. Unsurprisingly then, throughout India, dispute over state acquisition of land that deprives people of their land rights spans various dimensions of economic, social, and political life. How do we mitigate this conflict? The CPR Land Rights Initiative report on ‘Land Acquisition in India: A Review of Supreme Court cases from 1950-2016’, offers some preliminary answers to this question. Not only is this report the first comprehensive country-wide study of land acquisition disputes since India's independence, but also for the first time ever analyses these disputes along various metrics, such as i) public purpose, ii) procedure for acquisition, iii) compensation, iv) invocation of the urgency clause, v) pendency of claims, and vi) tracks trends with respect to distribution of disputes across geography and time, and central and state laws. The Report also analyses litigation under the newly enacted Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (LARR Act) for the three year period, 2014 to 2016. A detailed presentation of the findings from the report can be accessed here. Key findings: Reasons for inequity between state and land losers: The Report concludes that the political and social contestation over land acquisition stems from the inherently coercive nature of the land acquisition process, which creates a severe imbalance of power between the state and land losers. While much of this imbalance was created by the text of the Land Acquisition Act, 1894, a considerable part of it could also be attributed to executive non-compliance with the rule of law. The result is a situation of great inequity for the land losers. Legal reform under the LARR Act should be implemented by government, not subverted to redress these inequities: The Report finds that specific provisions of the LARR Act are steps in the right direction to redress the imbalance of power that was built into the Land Acquisition Act, 1894 in so far as: i) they empower livelihood losers along with title-holders to bring claims for compensation and rehabilitation, ii) bring compensation requirements in accordance with existing reality, and iii) introduce requirements of consent and social impact assessment. The Report shows that litigation helps channelise political contestation of state action into legal as opposed to extra legal disputes. Therefore, by empowering hitherto disempowered land losers to bring claims under the LARR Act, the Act will help preempt extra-legal conflict. Since conflict inevitably stalls or derails legitimate development projects, it is in the interest of the government to comply with, and not subvert the LARR Act. Legal reforms must be supplemented by administrative and bureaucratic reforms: The Report highlights that legal reform is a necessary but not a sufficient precondition for ensuring greater equity and efficiency within the land acquisition process. In the absence of administrative and bureaucratic reforms, the introduction of the LARR Act will not succeed in eliminating inequities and inefficiencies embedded within the implementation of existing land acquisition procedures. In fact, the increase in procedural requirements under the LARR Act implies an even greater need for securing executive compliance with the rule of law, in order to translate the equities intended by these additional procedures into reality for land losers. Types of administrative reforms required: Such administrative reforms include building of state capacity to meaningfully comply with the increased procedural requirements stipulated by the LARR Act, and designing institutional structures that incentivise such compliance with the rule of law. This, in turn, requires a serious mind-set shift within the government toward accepting the reform enshrined in the LARR Act, and not subverting it as we have seen in both the LARR Ordinance, and the state amendments to the LARR Act, as also the rules adopted to implement the LARR Act in the states.

Abstract:
Growing water scarcity and degradation pose rapidly growing challenges to global food security and human well-being. Policymakers contending with these problems face many obstacles, including the increasing cost of developing new water through constructing storage, conveyance and treatment infrastructure, including for desalination of sea water. Other obstacles include the growing degradation of soils in irrigated areas, expanding groundwater depletion, rapidly growing water pollution, and the overall deterioration of freshwater ecosystems. Unless important policy reforms are undertaken today, water scarcity and pollution will adversely affect most, if not all, livelihoods in the coming decades.

135. Pathways to Media Reform in Sub‐Saharan Africa Reflections from a Regional Consultation

Abstract:
When Mali in 1991 ended more than two decades of one-party rule, it embraced media freedom and pluralism as an essential part of its democratic transition. For two decades the country was considered a success story of democracy in Africa. The greater freedom enjoyed by the media and the flourishing of radio stations in the country was seen as part of a wider growth of independent and plural media in Africa during the 1990s, following earlier periods of control over the media by post-colonial governments. Unfortunately, the link between media and democracy in Mali works both ways: reversals to Mali’s democratization have frequently been accompanied by setbacks to media freedom. In 2000, the government passed a law allowing journalists found guilty of defamation to be fined or imprisoned, and journalists came under pressure to self-censor reports on sensitive topics. And when a coup d’état in 2012 and conflict in the country’s north threatened the country’s democracy, the space for media was further constrained. According to Freedom House, in the country’s north, it is dangerous for journalists, bribery of journalists is commonplace, and working conditions for journalists have worsened. Everywhere in the world, democracy and press freedom have been natural companions, but as the case of Mali illustrates so well, the relationship between the two has been closely entwined in sub-Saharan Africa. In the struggles for independence from colonial rule, in the wave of post-colonial movements that ended military regimes and dictatorships, and in the efforts today to keep governments accountable, the demands for press freedom, citizen voice, and pluralism have frequently been at the vanguard. Conversely, as democratic institutions in the region have been slowly hollowed out in recent years by colluding political and economic elites, so too have we seen media pluralism eroded by the influence of the powerful: authoritarians have left standing the facade of democratic institutions and press freedoms in the region, while disabling them from within. This report lays out a vision for how the continuing struggle for vibrant, independent, and plural media systems in the region might more effectively bolster efforts of democratic revitalization. The report draws on the input of 36 experts in media and governance from 15 countries in sub-Saharan Africa who met in Durban, South Africa, in July 2017, and it deepens the insights and ideas that came from this group by documenting previously successful media reforms in sub-Saharan Africa.

136. Transparency and Rule of Law as Key Priorities for Armenia

This paper is part of CTR's Working Paper Series: "Eastern Voices: Europe's East Faces an Unsettled West." With the growing tension between East and West, and with the rejection by Russia of common international rules, the question how the post-Soviet states should construct their foreign relations remains of utmost importance. Armenia, a landlocked country in the South Caucasus, has yet to accomplish its transition from socialism to democracy and market economy. Moreover, efforts along these lines have regressed, and the authorities do little to implement reforms or to establish a healthy system of checks and balances. In recent months the country has been overwhelmed by protests. The authorities neither address domestic problems nor satisfy protestor demands. Instead the Armenian government frequently resorts to disproportionate use of police forces against peaceful protestors. With political prisoners and hundreds of detained civil activists, journalists and politicians, it will be impossible to build an independent and prosperous country. Armenia has a rich history and culture, but at the same time it has experienced dark historical periods. The Armenian Genocide of 1915 and the unresolved Nagorno-Karabakh conflict shape Armenian identity. However, such historical issues have been instrumentalized by the Armenian government. Instead of building the future, Armenian authorities emphasize the past. Policies based on past grievances lead the Armenian government to become more and more dependent on Russia. Armenia needs to tackle corruption, falsified elections, a corrupt judiciary and many other problems -- and Western partners whose efforts are based on democratic values, free and fair elections, and respect towards human rights have a crucial role to play. This chapter offers background on Armenia's relations with various actors, historical matters that shape Armenian identity, and the failure and lack of will to improve the country's current situation. It then discusses the role of the West and its importance for Armenia. We seek to answer why Armenia slowed down its reform efforts, what the West needs to do to improve the situation in Armenia.

Since Moldova's November 2014 election, the country's image has changed drastically from the “success story” of the EU´s Eastern Partnership to that of a “captured state.” Moldova's politics continue to be defined by corruption and vested interests, which take advantage of weak state institutions and public administration, an ineffective judiciary and law enforcement agencies. This environment has enabled hostile takeovers of financial companies, often through concealed offshore operations, for criminal purposes, money-laundering schemes and a spectacular banking fraud, which was uncovered in autumn 2014. Low incomes have prompted hundreds of thousands of Moldovans to leave the country in search of a better life. Rivalries for political power, control over institutions, and economic assets have generated growing crises within different ruling coalitions, resulting in rapid changeover in governments, the break-up of major political parties and the formation of new parliamentary majorities with precarious democratic legitimacy. All of these factors have subjected Moldova to an unrelenting series of governmental, economic, financial and social crises since early 2015. The deeper causes of these crises can be traced to much earlier developments, however, and are deeply rooted in local structures.

Abstract:
This Training Curriculum builds the knowledge and skills of women from civil society to participate in security sector reform (SSR), and conduct advocacy related to the security sector. It is a companion to A Women’s Guide to Security Sector Reform, published in 2013 by DCAF and Inclusive Security. The curriculum is aimed at experienced facilitators and trainers who design workshops and trainings for women and civil society organizations wishing to engage in SSR processes. The Training Curriculum addresses the concepts of security, the security sector, SSR, gender and gender equality, and the links between them. It builds skills for planning, research, coalition building, developing recommendations, and advocacy around the security sector, as well as monitoring and evaluating those efforts. Given that women are often excluded from SSR processes, the curriculum serves as a tool to train and support women and CSOs of all types to participate in dialogue and decision-making to create a security sector that is more effective, accountable and inclusive. The Training Curriculum includes 17 modules that are practical, field-tested, and grounded in adult learning methodologies. They include case studies, exercises, videos, and role plays to make the material accessible to a range of learning styles and knowledge levels. Sample agendas and training guidance are included in the Introduction and each module can be adapted to suit specific training needs.

140. Autonomous Reform vs Global Isomorphism: Explaining Iran’s Success in Reducing Fertility

A long-standing literature in the sociology of organizations (e.g., DiMaggio and Powell 1983) suggests that, as change agents face uncertainty about actions and outcomes, they often seek legitimacy through isomorphism: adopting structures, policies and reforms similar (at least in appearance) to those deemed successful elsewhere. We examine history’s most rapid reduction of fertility—from 8.4 in 1985 to 2.4 in 2002, in rural Iran—as an example of successful autonomous reform. The Iranian state, which was self-consciously cut off from nearly all of the traditional vectors of global isomorphism, initiated a successful behavioral change in a domain (family planning) perhaps unexpected for an Islamic state. We describe and explain the Iranian approach, in particular the rural program, contrasting it with the global strategy of adopting universal "best practices."
