11. The Greek-Turkish Maritime Disputes: An International Law Perspective

Abstract:
This Policy Paper by Efthymios Papastavridis, Research Associate of ELIAMEP; Researcher and Part-time Lecturer, University of Oxford Fellow; Academy of Athens & Athens PIL Center, examines the maritime disputes between Greece and Turkey, in particular those concerning maritime delimitation and the breadth of the territorial sea of Greece, against the background of international law. It starts with setting out the historical and legal background of the continental shelf dispute in the Aegean Sea, in particular Greece’s applications before the International Court of Justice (ICJ) and the UN Security Council in 1976. Then, the paper considers the different legal positions of Greece and Turkey concerning the issues of the breadth of the territorial sea and the maritime delimitation and assesses these positions under international law. This assessment is followed by the discussion of the various means available under international law for the settlement of the maritime delimitation dispute under international law, in particular, its submission to the ICJ, which has often been at the front line of public and scholarly discourse. The paper concludes that international law provides a sufficient, clear and predictable legal framework for the resolution of the Greek-Turkish maritime dispute, which will be of the outmost benefit for both States and for the Eastern Mediterranean region as a whole.

Abstract:
On March 6, 2020, India secured the distinction of ob‐ server status to the Indian Ocean Commission (IOC), an association that consists of five Indian Ocean states—Mauritius, Seychelles, Madagascar, Comoros, and Réunion (France). New Delhi is now formally clubbed in the IOC along with the four other observer countries of China, Malta, the European Union, and the International Organisation of La Francophone (OIF). What does this mean for India’s power play in the Indo-Pacific? ​ Fundamentally, inclusion in the IOC points to a more serious structural maritime engagement for India in the Western Indian Ocean region. The IOC is a key grouping working to foster cooperation on both traditional and non-traditional security matters of the Western Indian Ocean, which connects the Southeastern Coast of Africa with the mainstream Indian Ocean. In other words, this association opens the gateway for a more formal "continental connection" between India and the Eastern African coastal countries bordering the Indian Ocean. It not only enhances India’s stature as a rising maritime power in the Western Indian Ocean, but also exemplifies India’s security-based desire for institutionalized association with countries in the region. It promotes cooperation between India and the littoral countries on the Eastern African Coast in a number of key activities in the region: maritime-military aid and assistance, capacity building, joint military exercises, sea patrolling, logistics and intelligence assistantship, and naval training...

13. France's “Indo-Pacific” Strategy: Regional Projection

Abstract:
President Macron talks of France’s ‘Indo-Pacific strategy’ (une stratégie indo-pacifique). This article analyzes French strategic discourse and strategy adopted for the Indo-Pacific by France. It finds that French strategy has three main elements. Firstly it has seeks legitimacy, politically seeking to move from a colonial possessions position to democratic integration with France, and has sought to achieve regional integration and legitimacy of this. Secondly, geographically France has moved up northwards from its possessions in the Southern Indian Ocean and Southern Pacific to active maritime involvement in the northern Indian Ocean, South China Sea and Western Pacific. Thirdly, French strategy is to actively secure security partnerships with other countries in the region. Naval projection is a prominent feature of French strategy, which is a strategy which is significantly driven by China’s maritime expansion across the Indo-Pacific. The article thus seeks to analyze, explain and evaluate the effectiveness of France’s Indo-Pacific strategy.

14. Designing High-seas Marine Protected Areas to Conserve Blue Carbon Ecosystems: A Climate-essential Development?

Abstract:
The high seas are a critical biodiversity reservoir and carbon sink. Unfortunately, the oceans, generally, and the high seas, in particular, do not feature prominently in international climate mitigation or climate adaptation efforts. There are, however, signals that ocean conservation is poised to occupy a more significant role in international climate law and policy going forward. This paper argues that improved conservation and sustainable use of high-seas living marine resources are essential developments at the convergence of climate action and ocean governance that should manifest, at least in part, as climate-informed high-seas marine protected areas.

15. Defending Europe: scenario-based capability requirements for NATO’s European members

Abstract:
The study applies scenario analysis – with scenarios set in the early 2020s – to generate force requirements, and assesses the ability of NATO’s European member states to meet these requirements based on data from the IISS Military Balance Plus online database. The cost of closing the identified capability shortfalls through equipment acquisition has been estimated. The objective of the study is to enable informed policy dialogue both in Europe and in a transatlantic setting. The study explicitly does not intend to predict future conflicts nor the intentions of any of the actors involved. Neither does it wish to prescribe a certain path of action to be pursued by European NATO governments. The first scenario examined deals with the protection of the global sea lines of communication (SLOCs). In this scenario, the United States has withdrawn from NATO and has also abandoned its role of providing global maritime presence and protection, not just for its own national interest but also as an international public good. It thus falls to European countries to achieve and sustain a stable maritime-security environment in European waters and beyond, to enable the free flow of international maritime trade, and to protect global maritime infrastructure. The IISS assesses that European NATO members would have to invest between US$94 billion and US$110bn to fill the capability gaps generated by this scenario. The second scenario deals with the defence of European NATO territory against a state-level military attack. In this scenario, tensions between Russia and NATO members Lithuania and Poland escalate into war after the US has left NATO. This war results in the Russian occupation of Lithuania and some Polish territory seized by Russia. Invoking Article V, the European members of NATO direct the Supreme Allied Commander Europe (SACEUR) to plan Operation Eastern Shield to reassure Estonia, Latvia and Poland, and other front-line NATO member states, by deterring further Russian aggression. European NATO also prepares and assembles forces for Operation Eastern Storm, a military operation to restore Polish and Lithuanian government control over their territories.

16. Advancing UK maritime aviation in the Queen Elizabeth-class era

Abstract:
The United Kingdom is on the cusp of regenerating what is a transformational capability. The first of the UK’s new-generation aircraft carriers, HMS Queen Elizabeth, has been at sea on trials for two years, and is working up towards its first operational deployment in 2021. The second ship, HMS Prince of Wales, is scheduled to be accepted into service before the end of the year. The F-35B Lightning II has achieved initial land-based operating capability and the Lightning Force has carried out its first overseas deployment, Lightning Dawn. Maritime aviation in the round has undergone a significant transformation, and there has been a substantial increased focus on collaboration and partnering with industry as well as developing stronger links with critical allies. To underscore the significance of the undertaking, then secretary of state for defence Penny Mordaunt announced on 15 May 2019 that the UK planned to produce a National Aircraft Carrier Policy to lay down a blueprint for how the new carrier era would help deliver the UK’s global objectives. In addition, on 4 June, then prime minister Theresa May announced that the UK would earmark the Queen Elizabeth-class carriers to form part of NATO’s significant new Readiness Initiative. These developments have prompted thought and discussion on the extent to which the carrier programme will enable and actually drive the transformation of UK joint-force capabilities, and are posing questions about the demands such a programme will place on UK defence and industry. Abstract:
Russia’s Syrian campaign has demonstrated the returning challenge the West faces in the underwater domain. Combat operations in Syria have been an opportunity for Russia’s military forces to prove on operations a new generation of capabilities, just as Operation ‘Desert Storm’ in 1991 saw the United States demonstrate its own new generation of military technology. One of the first weapons fired in ‘Desert Storm’ was a Tomahawk sea-launched cruise missile (SLCM), launched on the first day from several surface combatants. Two days later, a Los Angeles-class nuclear-powered attack submarine (SSN) became the first submarine to fire Tomahawk in combat.[1] The USN’s re-roling of its SSNs as primary power projection platforms in the 1990s/early 2000s underlined the shift in Western focus in the underwater battlespace away from the primary Cold War task of anti-submarine warfare (ASW) to counter Soviet naval activity. Simply, the strategic collapse of the Soviet Union saw what was a significant submarine threat disappear almost overnight, and with it – for that moment, at least – the Western requirement for ASW capability. Today, the underwater threat is back. Since 2008 – which saw both Russian naval forces engaged in the Georgia campaign and the re-emergence of regular deployments by Russian submarines (and surface ships) south of the Greenland-Iceland-UK (GIUK) gap – naval power has been central to Russia’s strategic resurgence.

The US-Japan-Australia-India Quadrilateral Strategic Dialogue (QSD), or simply “Quad,” process continues to attract the attention of policy-makers, analysts, and scholars interested in the impact of this new and potentially significant alignment formation on the security dynamics of the Indo Pacific region. The reemergence of the Quad meetings in 2017 after their abrupt termination over a decade ago in 2007 has led analysts to wonder if it is now here to stay this time as an enduring additional component of the region’s multifarious security architecture. It has also animated a heated debate about its true nature and purpose, with commentators bitterly divided in their appraisal. Some believe it lacks real substance and cohesion, whilst others argue it has the portentous makings of a new military alliance aimed at containing the PRC. Nevertheless, despite prodigious efforts on behalf of the strategic commentariat, the actual substance and nature of the Quad itself remains enveloped by mixed signals, misapprehensions, and mischaracterizations. As Graeme Dobell recounts: ‘The Quad is more notable for the questions it provokes than the answers it offers.’

19. Ocean horizons: Strengthening maritime security in Indo-Pacific island states

The report examines how Pacific island countries (PICs) and Indian Ocean island states (IO island states) are managing and prioritising their maritime security challenges. These islands, which we call the ‘Indo-Pacific island states’, face an intricate offshore tapestry. In particular, this report suggests that most of the maritime threats and risks facing the Indo-Pacific island states are increasing. That’s in part because of the general lack of effective maritime security identified in this report. The report describes the current geopolitical environment of the Indo-Pacific island states and how we should understand maritime security in the context of island states. It examines the core maritime security concerns of the PICs and IO island states and considers points of commonality and divergence in island state perspectives on maritime security and major-power competition. The report provides key recommendations for Indo-Pacific island states and for countries, such as Australia and its partners, that wish to more effectively engage with the island states on maritime security.

20. Augmenting maritime domain awareness in southeast Asia: Boosting national capabilities in the Philippines, Thailand and Indonesia

Abstract:
Promoting maritime domain awareness (MDA) has become an increasingly high priority area for many Southeast Asian states. The rising salience of a regional maritime ‘disorder’ that’s increasingly being shaped by the influence of so-called ‘grey area’ phenomena, combined with a growing awareness that these non-state challenges can be dealt with only through a whole-of-government approach, has prompted several regional countries to create multiagency operational fusion centres (FCs) to mitigate these dangers. Foremost among those initiatives have been the Philippine National Coast Watch Center (NCWC, established in 2012), the Thai Maritime Enforcement Command Centre (MECC, set up in 2019) and the Indonesian Sea Security Coordination Centre (Baden Keamanan Laut Prebublik Indonesia, BAKAMLA, formed in 2014). While the specific drivers for the creation of these organisations has differed according to the conditional contexts of the three countries concerned, they have all faced a similar set of challenges that has stymied progress in providing a truly coordinated approach to maritime security (MARSEC) threats.
