11. China’s responsibility for the Covid-19 pandemic: An international law perspective

Abstract:
The coronavirus pandemic has roiled international relations. The huge global toll of the pandemic, both in terms of deaths and economic implications, has raised the question of Chinese responsibility. This Working Paper analyzes China’s responsibility for Covid-19 under international law. In order for state responsibility to arise, China must have committed an internationally wrongful act. The conduct must be attributable to China and must constitute a breach of its international obligations. An analysis of the timeframe concerning the main measures undertaken by Chinese authorities at different government levels shows a lag in reporting the outbreak to WHO according to the International Health Regulations. Hence, there appears to be a case for injured states to invoke China’s responsibility. The prospects for implementation are nevertheless bleak. A tacit understanding seems to prevail among states not to pursue the spread of pathogens in terms of legal responsibility or litigation. Whether major power rivalry or the enormous costs of the pandemic will change this non-confrontational tradition of dealing with pathogens remains to be seen.

12. President Zelensky’s first year leading Ukraine: A case of déjà vu

Abstract:
During his first year as President of Ukraine, Volodymyr Zelensky prioritized presidential power-building. In order to do so, he relied heavily on the old system and established practices, such as “hands-on” management and the personalization of state agencies. Institution-building was replaced by the targeted fine-tuning of the dominant system. Some important reforms launched by the government in autumn 2019 were later stalled and reversed. As before, the adoption and implementation of comprehensive reforms will largely depend on Western pressure and conditionality. The major problem is that there are multiple centres of power in the country and the president’s actions only produce an illusion of control, while in reality the system is fragile and unstable. During the rest of his presidency, Volodymyr Zelensky will increasingly depend on oligarchs and govern through situational alliances. In exchange for their support, he may have to acquiesce to their continued dominance over the economy and the restoration of their influence in politics. Instability will intensify as his personal popularity wanes and economic and political crises deepen.

13. Uzbekistan’s new Central Asia policy: The economic rationale and political implications of good neighbourliness

Abstract:
Under the leadership of President Shavkat Mirziyoyev, Uzbekistan has embarked on a moderate reform programme that aims to achieve socio-economic growth without undoing the country’s authoritarian political system. The programme has implications beyond Uzbekistan’s borders because it has changed the way Uzbekistani foreign policy is formulated and implemented. Uzbekistan’s former isolationist stance has shifted to a foreign policy opening, which is most noticeable in the improvement of its relations with its neighbours. This Working Paper analyzes “good neighbourliness”, the key concept of Uzbekistan’s new Central Asia policy. It details the amendment of Uzbekistan’s bilateral relations with its neighbours and points to the positive reception of Uzbekistan’s new regional policy in Russia, China, and the West. The paper argues that while “good neighbourliness” is a pragmatic strategy rooted in economic rationality, the policy’s regional implications are substantial. It is laying the necessary foundation for sustainable Central Asian co-operation from within in a way that is acceptable to the Central Asian states and big non-regional actors alike.

Abstract:
I like being a policy-oriented academic: you meet lots of interesting people and you are invited to interesting meetings, so you can really contribute to the debate. Some actors may from time to time think you have an appealing idea, and they may even seek some academic legitimacy for their decisions. But you are of course not present when the actual decisions are being taken. It’s my job and I love it – but this is not the role that the EU itself should play. Europe does not aspire to be the world’s policeman, but it cannot just be the world’s professor either. As the new EU leadership is coming in, we must give punch to our strategy, and make sure we have the power to make our ideas work in the real world. Power, not to confront, but to engage the world.

Abstract:
This paper examines the policies for industrial cluster development in Viet Nam. The first export processing zone was established in 1991. Since 1994, Viet Nam has focused more on developing domestic productive capacity and thus various types of industrial estates were established. The key actors in industrial cluster policy are the government, Prime Minister, ministries, provincial people’s committees, and management boards of industrial and economic zones. The choice of industrial estate is often determined by factors such as geographic location, land, labour, infrastructure, industry, business environment, and incentives. Viet Nam has provided various incentives to industrial estates of various types, but the scope and extent of preferential policy support for firms in general and those operating in industrial and economic zones are rather modest. The industrial estates have contributed significantly to attracting foreign direct investment, to exports, to productivity improvement, etc. Looking forward, Viet Nam needs further efforts on industrial cluster development, including development of statistics, analysis of cluster policy impacts, and provision of FTA-consistent incentives.

16. The divided continent: Understanding Europe’s social landscape in 2020 and beyond

Abstract:
The political upheaval and dysfunction of recent years have focused political minds on better understanding the volatility underpinning European electorates. Interest in public opinion research has soared, yet it can be difficult to draw the findings of such surveys and focus groups into something meaningful and cohesive, from which genuine insights can be drawn. It is pertinent that policymakers at both the national and EU institutional levels grasp a clear and incisive idea of what is taking place culturally, socially and politically in EU member states, and that these tea leaves can be interpreted and harnessed to produce responsive, targeted policies. This research analysis report sets out the findings of a major survey conducted across 13 EU member states (i.e. Austria, Belgium, Bulgaria, Denmark, Estonia, France, Germany, Greece, Hungary, Italy, Poland, Spain, the Netherlands), which were selected to provide a representative snapshot of the bloc as a whole. This survey was expansive in its scope and unique in its focus on social and cultural issues, as well as politics, leadership and economic security. The data is interpreted through three distinct themes, each of which is likely to play a critical role in Europe’s ‘mood music’ over its coming parliamentary term: nostalgia, intergenerational conflict and democratic legitimacy. These themes have become the subject of much amateur punditry, although institutional understanding of their complex nature is often shallow. Therefore, this paper seeks to shine a more evidenced-based contextual light around their formation and nuances of application.

17. Total Competition: China’s Challenge in the South China Sea

Abstract:
China’s bid for ascendancy remains anchored in the South China Sea and surrounding Southeast Asian countries. The Chinese Communist Party (CCP) deems it economically and militarily vital to dominate the resources and sea lines of communication of a body of water twice the size of Alaska. Achieving this goal requires tethering neighboring countries into Beijing’s ambit while making the existing ruleset more favorable to China and displacing the dominant power behind the existing regional order. Some may find comfort in describing the scenario underway as a return to a “China-centered” rather than “Sino-centric” region.1 However, an authoritarian China’s coercive attempts to wield hegemonic control of the South China Sea threatens the sovereignty of Southeast Asian states and international freedom of the seas, both of which are of fundamental national interest to the United States. Yet the South China Sea and Southeast remain the least defended and most bountiful region susceptible to Chinese predations and inducements. The CCP leadership is obsessed with the idea that outside forces intend to contain China’s development, foment internal unrest, and prevent it from retaking what it considers to be its rightful place center stage in regional and global affairs. In partial response to deep-seated insecurities and renewed great-power ambitions, Xi Jinping and the CCP are in the process of attempting to exercise control over the entire nine-dash line claim covering the vast majority of the South China Sea and to turn Southeast Asia into a latter-day tributary system. CCP propaganda casts China’s quest for control over maritime Asia as an inexorable outcome of China’s rise and America’s decline. Curiously, the only government speaking seriously about “stopping” China is Beijing, suggesting that its policies are influenced more by subjective internal fears than by objective external realities. China wants nothing to stop it from consolidating its maximalist historic claims, from denying the United States the ability to intervene in regional conflicts, and from dismantling America’s postwar alliance system.

Leadership, once we study it, isn’t one thing exercised at the top by one person, as our colleague and leadership expert Ron Heifetz has observed; it is an activity exerted by people at all levels, and by noticing certain less obvious aspects of leadership, anyone can improve at it. Leadership is possible at any time there is a collective problem. Each of us may have a role to play in mobilizing others to address community problems, and each of us can improve our skills to be more effective.

20. Pandemics: The Armed Forces as the Ultima Ratio?

The novel coronavirus disease (COVID-19) crisis has caused leaders in all affected countries to turn to their armed forces for support in an ever-expanding range of roles. Armed forces are being tasked to provide capabilities that in many instances go beyond what they have provided in past crises. As the crisis progresses and tragedy intensifies, the armed forces may appear to be the last resort available—the ultima ratio—to decision-makers. It must be expected that these demands will continue to mount even if the current crisis abates, as it is sure to remain a top national concern for months to come. This paper examines the range of roles that armed forces have taken on within the context of this crisis and places those roles, mission, tasks, and function within a scheme of six mission sets that comprise the defense support to civil authority (DSCA) rubric. The paper goes on to set forth a half-dozen considerations for decision-makers to contemplate before asking the armed forces to undertake these roles. In the current pandemic crisis, many of the tasks inherent in the DSCA rubric have been prominent in the demands by political leaders for armed forces support, such as the provision of essential services (many logistical and medical in nature) as well as search capabilities, decontamination operations, and engineering support. For example, armed forces in Italy, Spain, France, and the United States, just to name a few, have built and staffed medical facilities; transported virus patients; delivered food supplies; searched buildings for victims; and decontaminated residences and public facilities, such as train stations and airports. In addition, armed forces organizations have provided mortuary services, including the transportation and cremation of virus victims’ remains, which, of course, are contaminated. Photos of Italian Army units have shown convoys of trucks loaded with coffins. Soldiers have also provided medical support to overwhelmed facilities. Soldiers have been photographed administering tests for the virus, moving patients within hospitals, and providing basic services, such as changing bed pans and providing meals, all in a contaminated environment. French military aircraft, equipped for medical evacuation, have transported virus patients to less-stressed medical facilities in France.
