1171. Thresholds in the Process of International Financial Integration

Abstract:
The financial crisis has re-ignited the fierce debate about the merits of financial globalization and its implications for growth, especially for developing countries. The empirical literature has not been able to conclusively establish the presumed growth benefits of financial integration. Indeed, a new literature proposes that the indirect benefits of financial integration may be more important than the traditional financing channel emphasized in previous analyses. A major complication, however, is that there seem to be certain “threshold” levels of financial and institutional development that an economy needs to attain before it can derive the indirect benefits and reduce the risks of financial openness. In this paper, we develop a unified empirical framework for characterizing such threshold conditions. We find that there are clearly identifiable thresholds in variables such as financial depth and institutional quality—the cost-benefit trade- off from financial openness improves significantly once these threshold conditions are satisfied. We also find that the thresholds are lower for foreign direct investment and portfolio equity liabilities compared to those for debt liabilities.

1172. The G20 Meetings: No Common Framework, No Consensus

Abstract:
Participants in the recently completed G20 meeting in London agreed on a number of measures, some substantial and some merely symbolic, but they sidestepped the real issues dividing the major economic powers and, in so doing, failed to address the root causes of the global trade and investment imbalances. This was almost inevitable. China, Europe, and the United States have incompatible conceptual frameworks for understanding the causes of the global financial crisis; furthermore, their conflicting domestic political constraints make agreement on solutions hard to reach. Europeans believe that the root cause of the crisis was excessively deregulated financial systems, and they are skeptical about U.S. and Chinese calls for fiscal expansion, worrying that excessive spending would prolong the imbalances and make the ultimate adjustment more difficult. China also believes that the roots of the crisis lie within the structure of the global financial system, although Beijing insists that it was mainly the reserve status of the U.S. dollar that permitted imbalances to develop to unsustainable levels. China is particularly vulnerable to trade protection and seeks to maintain open markets for its continued export of domestic overcapacity. Like the United States, it is pushing for more aggressive, globally coordinated fiscal expansion. However, because of rigidities in its financial system and development model, its fiscal response to the crisis may exacerbate the difficult global adjustment and may, ironically, increase the chances of trade friction. In a time of contracting demand, the United States controls two-thirds of the most valuable resource in the world: net demand. Consequently, it is U.S. policies that will determine the pace and direction of the global recovery, along with the institutional framework that will govern trade and investment relationships for decades to come. The crisis puts the United States more firmly at the center of the emerging world order than ever. So far, the United States has not understood the need to consider the global outcomes of its recovery policies. Until the major powers can reach consensus about the roots of the imbalance and cooperate on policies to promote recovery, it is likely that the world economy will get worse before it gets better. The United States will drive the recovery process, but in order to do so effectively it will need to recognize its position of strength and negotiate the appropriate agreements with other major powers, especially China, on the pace and nature of the adjustment.

The debate about the role that sovereign wealth funds (SWFs) from Arab and other emerging economies play in international financial markets has been a highly cyclical one. Only twelve months ago, the Western public questioned the deeper rationales for sovereign investments in what were perceived to be strategic assets of Western economies. Commentators argued that these investments could harm the long-term competitiveness and national security of Western economies.

1174. The Alien Tort Statute of 1789: Time for a Fresh Look

In 2007 the Second Circuit Court of Appeals held that US companies that had done business with apartheid South Africa could be found liable for monetary damages under the Alien Tort Statute (ATS) of 1789 (Khulumani v. Barclay Nat. Bank Ltd., 504 F.3d 254 [2d Cir. 2007]). Liability arises, the Second Circuit declared, from their possible connections with human rights violations committed by South Africa during the apartheid era. Firms named in the suit include Bank of America, IBM, Coca-Cola, and General Motors. The governments of the United Kingdom, Germany, and Switzerland all opposed the lawsuit, as did the government of South Africa, which argued that the suit ran counter to its policy of reconciliation. The Bush administration also opposed the suit, but the Second Circuit rejected the argument that the cases could be dismissed for foreign policy reasons.

1176. European Food Safety Regulation and the Developing Countries: Regulatory problems and possibilities

Abstract:
This paper examines the European Community's food safety regime in order to identify those legal measures that cause the most problems for developing countries' exporters of food products and to point to possible solutions. It is shown that barriers ma y arise due to an array of requirements, some of which may appear to be rather minor legal amendments, such as changing a sampling plan. There is no easy solution to this problem, but three specific measures are proposed: Firstly, improved harmonisation of food safety measures in the industrialised countries. Secondly, when proposing new food safety measures the European Commission should identify the proposal's likely consequences on developing countries – and should explain how alternative measures will affect both food safety and the developing countries. And lastly, the European Community should strengthen its provision of development assistance to enable the developing countries to comply with the food safety standards.

Abstract:
DIIS Working Paper reviews a recent influential branch within the Social Studies of Finance literature which asserts that financial markets are embedded in economics rather than in society (as scholars of the New Economic Sociology would have it). Coming from actor-network theory, the literature contributes conceptually to an extended ontology of markets and agency and empirically to an improved understanding of the importance of economist's role in constructing markets and assembling economic agency. It also draws attention to the staggering effects that material devices and technical 'details' can potentially have on the macrodynamics of financial markets. In some cases financial markets can even be performed by economics, that is, materialized in very close accordance with the economic models that describe them. From this insight they conclude that economics is a performative science and that the social sciences should consequently break down the Great (analytical) Divide between finance the- ory and financial markets.

The May update incorporates quarter one 2009 data on China's foreign reserves, the Treasury International Capital (TIC) capital flows data for December, January, and February, and the results of the June 2008 survey of foreign portfolio investment in the United States. The June 2008 survey indicated that China bought fewer Treasury bonds and more equities than the authors estimated in the January paper.

1180. Reforming and Reinforcing the Revolution: The Post-TRIPS Politics of Patents in Latin America

Abstract:
National policies toward intellectual property (IP) were revolutionized in the 1990s, as countries adopted new systems to conform to the World Trade Organization's (WTO) Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPs). TRIPS-style IP regimes make patents available for more types of knowledge, grant long periods of patent protection, and endow patent owners with strong rights of exclusion. This paper analyzes two contrasting patterns of political mobilization and pressures for change that newly-introduced, TRIPS-style regimes became subject to by the early 21st Century. Most governments faced pressures to address aspects of their IP systems regarding pharmaceutical patents; governments came under pressure to reform their new patent systems, calling into question the appropriateness and utility of broad and strong private rights of exclusion as tools for disseminating knowledge. Most governments also faced pressures to modify aspects of their patent systems more broadly related to science, technology, and indigenous innovation (STI); governments came under pressure to reinforce their new patent systems, buttressing the role of private rights of exclusion as mechanisms to incentivize the creation and distribution of knowledge and technology. I provide a political explanation for the contrasting trajectories of reform and reinforcement by examining how different policy arrangements generate and mobilize interests for continuity and discontinuity. The focus is on asymmetric patterns of interest mobilization: those actors who benefit from policy interventions tend to mobilize more than those who suffer; those actors who suffer retain the capacities for mobilization and resistance more in the area of health-drugs than STI.
