21. Indigenous Elder Societies as Leaders for Global Protected Areas Governance

Abstract:
Many models for parks and protected areas have been created globally to preserve biodiversity and natural heritage and to provide visitors with “wild places” to experience. This establishment of conventional parks and protected areas has typically been done through governance processes that do not acknowledge Indigenous peoples, including their connections to and their governance systems for such areas. Area-based conservation through parks and protected areas has, therefore, displaced and systematically oppressed Indigenous Peoples, disenfranchising them from their custodial roles and responsibilities within their traditional territories. In addition to oppression, conventional governance systems have also produced intrusive infrastructure and circulated tourists, creating human-wildlife conflict that often results in wildlife mortality. Through disenfranchising Indigenous peoples of their traditional territories, parks and protected areas in colonized regions of the world have separated nature from the societies that have the most deeply embedded place-based knowledge systems and governance structures.

Abstract:
Transnational networks of non-state actors are using ILO Convention No. 169 as a powerful instrument of environmental governance. The treaty promotes the norm of Free, Prior and Informed Consultation (FPIC), empowering local communities to influence infrastructure projects that impact their livelihoods and natural resources. However, there is a disconnect between the Brazilian government’s discourse and the effective implementation of this norm. Using document analysis and process tracing, this article investigates this rhetoric-practice gap. It argues that these transnational networks are diffusing the FPIC norm through Consultation Protocols, slowly bridging the gap.

Abstract:
On November 20, the Center for Native American Youth released its annual State of Native Youth report. The report highlights young leaders who are working hard to create a brighter future for tribal nations, the programs that help them do so, and the policy issues that impact their lives. The report also shares what we’ve learned from community meetings with youth and service providers about the priorities and solutions that matter most. The theme of this year’s report is Native Youth Count. Throughout this year’s report, we highlight the importance of Native youth civic engagement and belonging. We also feature artwork throughout the report that was submitted as part of the annual Gen-I Creative Native Call for Art. This year’s prompt was: What does citizenship and sense of belonging mean to you?

24. Energizing Regional Collaboration and Governance: CIGI Summit of North American Arctic Leaders

The North American Arctic (NAA) is a distinct subregion of the Arctic, with vast territories, extreme environmental conditions, small and remote communities, complex governance and significant resource constraints. There is an urgent need for stronger east-to-west cooperation among regional and national governments, Indigenous organizations, business, academia and other stakeholders to build the region’s prosperity. In February 2018, working closely with the Labrador North and Baffin Regional Chambers of Commerce, the Centre for International Governance Innovation hosted the “CIGI Summit of North American Arctic Leaders” — two special panel discussions exploring ways to foster this cooperation and strengthen dialogue among stakeholders. These panels occurred during the Northern Lights 2018 Business and Cultural Showcase, a four-day event in Ottawa bringing together more than 1,200 participants from across the country and around the world. The first panel featured the political leadership of the NAA; the second brought together experts in marine development and infrastructure. This conference report describes the summit’s key themes, priorities and takeaways.

25. Reconciliation beyond the Box: The UN Declaration and Plurinational Federalism in Canada

Abstract:
Prime Minister Justin Trudeau has publicly shared a vision of a plurinational state brought about through truth and reconciliation. He has expressed hope that Canadians are ready to rectify past wrongs and undo the legacy of colonialism by using the United Nations Declaration on the Rights of Indigenous Peoples (UN Declaration) as “a way forward” to achieve self-determination, dignity and respect for Indigenous peoples. Many have questioned the government’s commitment to reconciliation built upon nation-to-nation and government-to-government relationships. Governmental support of major development projects such as the Trans Mountain Pipeline Expansion, against strong opposition from some Indigenous voices, has created skepticism. Many Indigenous leaders have expressed concerns about how changes to a number of laws currently making their way through Parliament will impact Indigenous people, and whether their concerns are being fully heard by government. With respect to the government’s rights recognition and implementation framework, some Indigenous communities argue that the focus should be on the affirmation rather than the mere recognition of rights that are already enshrined in the UN Declaration. This paper looks at the history of Indigenous treaty making in Canada, the history of the courts’ statements regarding Crown sovereignty, underlying title and legislative power, and how the UN Declaration might lead Canada and Indigenous peoples toward genuine nation-to-nation relationships.

South Africa has a rich tradition of Indigenous knowledge covering uses of the country’s abundant natural resources. South Africa’s development of a multi-faceted framework for cultural and genetic resource protection in relation to Indigenous knowledge is a promising source of fruitful insights on the challenges and benefits of implementing such protections. As the first in a series of case studies featuring various models of traditional knowledge implementation in domestic legislation, this paper provides an overview of how South Africa is approaching the protection of traditional or Indigenous knowledge. A central aim of this series is to provide objective evidence and insight into national experiences that could serve to inform and support effective policy development in the field, without endorsing any particular national approach.

The aim of this journal is to disrupt the ‘single-story’ of mainstream foreign policy. Through highlighting both experienced and emerging voices from across the globe, we seek to understand, challenge, and critique foreign policy. This issue focuses on the theme of post-colonialism and foreign policy, which was chosen by our members and supporters. Through a post-colonial analytical lens, our contributors challenge the unquestioned objectivity of elitist, Western-centric foreign policy, and unpack the complex connections between gender, race, ethnicity, sexuality that are embedded in the everyday actions and politics of people from across the world. Alongside our written contributions, you will find artwork and poetry engaging with this theme. A feminist foreign policy brings all voices to the table, through whichever medium they choose to express themselves, challenging the academic and un-inclusive paradigm it is embedded in. 28. The Arctic Railway and the Sámi: Reconciling national interests with indigenous rights

Abstract:
Finland and Norway are planning to build the Arctic Railway, stretching from Rovaniemi to Kirkenes through the homeland of the indigenous Sámi people. The state governments have acknowledged their duty to consult with the Sámi, whose culture and livelihoods the railway would affect, but the Sámi have dismissed the consultation efforts thus far as inadequate and have denounced the project. The dispute has exposed the ambiguity of the state’s duty to consult with indigenous peoples: international law firmly establishes the duty but does not prescribe specific rules for carrying it out. In Norway, the domestic regulatory framework concerning the consultation duty is more evolved and the practice of implementation is more consistent than in Finland, but both states still lack an effective legal incorporation of the duty. Despite the ambiguity, the scope of the consultation duty is determined by its purpose: creating favourable conditions to reduce power disparity between the state and indigenous peoples in order to reach an agreement that reconciles national interests with indigenous rights.

29. Can Indigenous Associations Foster Trust, Tolerance, and Public Goods? Exploring the Role of Grins in Post-Conflict Mali

People gather in structured, if informal, community groups for many reasons—social, such as a book club or softball league; economic, such as a team hosting a fundraiser for a member’s medical expenses; or political, such as neighbors meeting to address flooding caused by poor infrastructure. But how does participating in such groups affect people’s well-being or decisions to work for other community improvements? Level of political knowledge? Level of trust toward group members, people in the broader community, or institutions such as the government? Or willingness to tolerate differences that are often at the root of conflict, such as ethnicity and religion? Through an Innovation and Research Grant funded by USAID’s Center of Excellence on Democracy, Human Rights, and Governance under the Democracy Fellows and Grants Program, Professors Jaimie Bleck from the University of Notre Dame and Philippe LeMay-Boucher from Heriot-Watt University, in collaboration with Jacopo Bonan from Catholic University of the Sacred Heart and Bassirou Sarr from the Paris School of Economics, worked to answer these questions by studying community groups called grins that meet in neighborhoods across Mali’s cities. The research, which included both survey data and data generated through the public goods and trust experimental games, was implemented in two sites in Mali: the capital Bamako and the twin cities of Mopti and Sevare, on the border between the formerly occupied north and the south. Key findings include: Grins’ primary purpose is social, but the groups also help members meet economic needs and provide a venue for political discussion and community service, such as neighborhood cleanup. The majority of grins are male-only, and the majority of grin members are male, comparatively better educated, and unmarried; however, members of male-only grins trusted one another less than members of mixed-gender or female-only grins. Members are better able to produce public goods than non-members, but only when working with members of their own grin. Members are considered more trustworthy than non-members, except for grins with internally displaced persons as members. Grinmembers had more trust in social institutions and diverse ethnic groups, though no more trust of the government; members of ethnically homogenous grins trusted diverse ethnic groups less.

30. Australia’s Election to the UN Human Rights Council

Abstract:
In mid-October, Australia was elected for the first time to the UN Human Rights Council. Australia, of course, is no stranger to working in the UN, having previously served on the Security Council five times. As a middle power, Australia has long worked to uphold international law and the international rules-based order. Australia’s stated goals for its term on the Council reflect its longstanding policies and values of equity and fairness. According to Freedom House, these policies and values make Australia one of the freest countries in the world. Pragmatically, this reputation also serves to wash away Australia’s dual sins of offshore processing of asylum seekers and continuing rise in aboriginal disadvantage.
