231. Climate Wrongs and Human Rights: Putting people at the heart of climate-change policy

Abstract:
In failing to tackle climate change with urgency, rich countries are effectively violating the human rights of millions of the world's poorest people. Continued excessive greenhouse-gas emissions primarily from industrialised nations are – with scientific certainty – creating floods, droughts, hurricanes, sea-level rise, and seasonal unpredictability. The result is failed harvests, disappearing islands, destroyed homes, water scarcity, and deepening health crises, which are undermining millions of peoples' rights to life, security, food, water, health, shelter, and culture. Such rights violations could never truly be remedied in courts of law. Human-rights principles must be put at the heart of international climate-change policy making now, in order to stop this irreversible damage to humanity's future.

The World Health Report 2000, prepared by the World Health Organization, presented performance rankings of 191 nations' health care systems. These rankings have been widely cited in public debates about health care, particularly by those interested in reforming the U.S. health care system to resemble more closely those of other countries. Michael Moore, for instance, famously stated in his film SiCKO that the United States placed only 37th in the WHO report. CNN.com, in verifying Moore's claim, noted that France and Canada both placed in the top 10.

Abstract:
On March 11th, 2000, two children who were playing in the neighborhoods of Mitrovica, Kosovo, got hurt by an “unexploded ordnance”. One of them died in the explosion, the other was severely injured. An inquire clarified that the ordnance was a “bomblet”, a part of a cluster bomb dropped during the 1999 NATO air campaign against the Federal Republic of Yugoslavia.

Abstract:
This paper argues that because institutions are different from individuals, we need different ethics in order to address the unique ethical risks associated with them. In particular, institutions run into unique ethical problems when no one individual is clearly responsible for an institutional outcome, what many scholars have called the “many hands” dilemma. The traditional approach to resolving such dilemmas has nevertheless been to attribute responsibility to individuals, either as persons or as agents. Since the traditional approach sets limits on the kinds of institutional ethical dilemmas that can be resolved, I turn to historical institutionalism (HI) in order to focus instead on the level of the institution as a step towards the case for holding international institutions accountable as institutions. HI can draw attention away from the detailed actions of individuals inside an institution, instead focusing attention on the evolutionary nature of the institution, making it difficult to change institutional practices. Based on this claim, in the second part I discuss two examples of institutions' accountability structures and guidelines, the EU Code of Good Administrative Behaviour and the IMF Code of Conduct for Staff. By considering three different factors (location of the Code within the governance structure of the institution, relations with a public according to the Codes and language in the Codes), my objective is to show how these Codes illustrate the limitations of the traditional approach to the “many hands” dilemma. I close with a discussion of how this argument makes space for further research on institutional accountability.

On May 14, the Iranian government arrested six prominent Bahai leaders and accused them of "endangering national security." The timing of the arrests has led some to speculate that the Iranian government is trying to link these leaders to the April explosion at a religious center in Shiraz that killed fourteen people. Considering Iran's clerical establishment believes the existence of religious minorities undermines official Shiite orthodoxy, these latest arrests are just another black mark on Iran's long and dismal record of protecting individual human rights and religious freedom.

Kenya's post-election violence has displaced more than 600,000 persons within the country since December 2007. Although violence-induced displacement is not a new phenomenon in Kenya, the magnitude, speed and intensity of this displacement were unprecedented. Clashes in the 1990s, also around general elections, displaced hundreds of thousands of Kenyans, many of whom remain displaced today. The new coalition government has made the resettlement of Internally Displaced Persons (IDPs) a top priority, launching "Operation Return Home" in May.

239. The refugee, the sovereign and the sea : EU interdiction policies in the Mediterranean

This paper starts from the encounter between a European navy vessel and a dinghy carrying boat refugees and other desperate migrants across the Mediterranean or West African Sea towards Europe. It explores the growing trend in the EU of enacting migration control at the high seas or international waters – so-called interdiction. It is argued that these forms of extraterritorial migration control aim at reconquering the efficiency of the sovereign function to control migration, by trying to either deconstruct or shift correlate obligations vis-à-vis refugees and other persecuted persons to third States. In both instances, European States are entering into a sovereignty game, in which creative strategies are developed in order to reassert sovereign power unconstrained by national and international obligations.

Kidney transplantation in the United States is burdened by a terrible policy failure. The cost of this failure will be paid in the currency of years of human lives unnecessarily lost, as well as a massive increase in federal expenditures over the next decade and beyond. The number of patients with end-stage renal disease (ESRD) in the United States has grown, but the supply of kidneys—for the preferred treatment for ESRD, kidney transplantation— has not kept pace with the demand. Unfortunately, the issue is not simply one of supply and demand: in the United States the supply of kidneys for transplantation is kept artificially low by a prohibition on the sale of human organs.
