111. The Sinification of China: How the minorities are being merged into one nation

Abstract:
The long-term aim of the Communist Party is to make China unified, and the most recent tool for this is the creation a Chinese nation. This term was included in the Constitution last year, which contradicts the definition of China as a multi-national state. Unifying China includes promoting a Chinese identity through history and culture. The current borders and ethnic composition of China are presented as the results of natural processes. History is written from the viewpoint of the Han Chinese and their relations with the border regions. Culture is discussed in a similar Han-centric manner. The Party has set “Chinese values” against “universal values” and religions. It demands religions to be Sinified in order to alleviate any risks they might pose to national unity. Most concretely, the creation of a Chinese nation is affecting the people in Xinjiang. This has given rise to concerns in other countries. The Sinification of minority nationalities may potentially become a new stumbling block in China’s relations with Western states.

Abstract:
China has raised its stakes in human rights governance. It has systematically sought to remove human rights from the centre of the international order by launching alternative human rights concepts, blocking human rights financing at the UN, and hindering civil society involvement in human rights scrutiny. China’s approach to human rights is not only guided by past experiences of humiliation and the idea of developmentalism, but first and foremost by the desire to secure the existing political system and its leadership. The alternative design for human rights is built around consensual cooperation rather than hard legal obligations and international scrutiny. It promotes dialogue and capacity-building instead of practices such as naming and shaming. States supportive of human rights should respond to Chinese efforts in the Human Rights Council as well as within the UN more broadly. This can be done by raising awareness of the systematic attack on human rights, increasing knowledge about Chinese foreign policy objectives, and by creating practices that help to achieve common stances.

113. A Human Rights Approach to Conflict Resolution

Abstract:
The role of human rights abuses in the causes, dynamics, and consequences of conflict illustrate the importance of a human rights approach to conflict resolution:1 if human rights are part of the problem, they must be part of the solution. This essay aims to show how a human rights perspective can improve the odds of transforming violent conflicts into sustainable peace by enhancing the design and implementation of peace processes and conflict resolution practices. In doing so, we will clarify the main characteristics of a human rights approach to conflict resolution and identify a set of human rights standards to guide its implementation. We will then briefly analyze the Colombian and the Israeli-Palestinian peace processes, each through the lens of the human rights approach. These two cases illustrate opposite ends of the spectrum when considering the inclusion of human rights in conflict resolution. At one end, the Colombian peace process illustrates how negotiations and a final agreement can recognize peace as a human right, highlighting the need to transform the structural conditions of injustice and human rights violations that give rise to armed conflict. At the other end, in the Oslo Accords between Israel and the Palestine Liberation Organization, human rights are virtually absent despite the fact that systematic abuses are among the main underlying causes and consequences of the conflict. In the conclusion, we address one of the main criticisms and challenges of a human rights–based approach to conflict resolution.

Abstract:
From the very beginnings of Soviet rule in Georgia, the communists were not very popular throughout Georgian society and treated as occupants. Almost all active forms of resistance ceased to exist after the bloody suppression of the August Uprising of 19241. The massive purge of the Georgian intelligentsia that followed deprived the nation of its patriotic elites. Only after the death of Stalin and in the wake of Nikita Khrushchev’s famous speech in 1956, did the situation change. Khrushchev’s words of accusation and criticism, leveled at Stalin for his cult of personality and other mistakes, were treated in Georgia as an attack on their nation and an element of Russian chauvinism. It gave rise to a series of mass protests in Tbilisi in March 1956, that were brutally dispersed by the army. Approxi- mately 150 people died as a result2. During the 1950s and 60s, Vasilii Mzhavanadze was the leader of the Georgian Com- munist Party. In keeping with Khrushchev’s strategy of somewhat reduced control over the national republics, one could observe a consolidation of power by the ruling elite in Geor- gia3. This led to the spread of corruption, bribery and other illegal economic operations. Despite a weak economy, according to official statistics, the average Georgian’s savings in the 1970s were nearly twice that of the average Russian. Also, during this time, a very high number of educated specialists – who while graduating, did not take job assignments were still able to live reasonably well. Another phenomenon characteristic for the 1950s and 60s was a growing sense of nationalism. Symptoms of this included a relatively small number of national minority representatives able to gain access to higher education in the Georgian Republic, as well as clear-cut Georgian control over local and national party structures. The situation did not change after the fall of Khrushchev.4 Only in the early 1970s, did things start to change. In 1972, the key position of the First Secretary of the Georgian Communist Party was passed to the former Minister of the Inte- rior – Eduard Shevardnadze, who began his rule with a broad campaign against corruption, overgrown bureaucracy, nepotism, and the so-called “second economy” (black market). Harsh administrative methods used in this campaign brought some positive effects – especially in the agricultural sector – but also resulted in a negative reaction from Georgian society5. Shevardnadze was also supposed to fight against growing Georgian nationalism. Campaigns, that condemned such things as reluctance to learn Russian lan- guage and promotion of national chauvinism in culture, were initiated. The teaching cur- riculum of the subject of history was also put under siege by the new authorities.

115. Toward Medium-Term Solutions for Rohingya Refugees and Hosts in Bangladesh: Mapping Potential Responsibility-Sharing Contributions

Abstract:
Bangladesh is providing a significant global public good by hosting nearly one million Rohingya refugees, including 700,000 who fled violence carried out with “genocidal intent” in 2017. Most refugees are living in camps in Cox’s Bazar District, where local resources and livelihoods are under strain. The situation has exacerbated development challenges and environmental degradation, such as inadequate public services and rapid deforestation. Safe, voluntary, and sustainable Rohingya repatriation to Myanmar is ultimately the best solution. However, the conditions for return do not exist, and Myanmar has not demonstrated meaningful progress in establishing them. Even if conditions did exist and voluntary repatriation began tomorrow, estimates show a large number of Rohingya will still be in Cox’s Bazar 10 years from now. The refugee situation is likely to be protracted. Medium-term planning is critical. The international community has an opportunity to recognize Bangladesh’s contributions through a robust responsibility-sharing process. In addition to humanitarian aid, this would include commitments that support development among host communities, as well as broader regional and national development strategies. There is precedent for development financing and beyond-aid solutions for refugees and host communities, such as in the Jordan, Lebanon, and Ethiopia Compacts. These agreements seek to meet the medium-term needs and generate inclusive growth for refugees and hosts, including through policy adjustments that enable self-reliance and reduce aid dependence. This brief explores the potential range of responsibility-sharing commitments in support of Bangladesh. It does not address the separate and equally important issues of securing justice and accountability for Myanmar’s alleged atrocities and establishing the necessary conditions in Myanmar for safe, voluntary, and sustainable repatriation—nor does it make recommendations on the humanitarian response, which remains essential. This brief focuses exclusively on the medium-term, development-oriented approach. It covers several categories of contribution and commitment types, including trade and investment, labor mobility, SEZ and infrastructure investment, private sector investment, resettlement, and development and climate finance. Each category includes illustrative examples, some of which are specific to one or a subset of UN Member States and others that are more broadly applicable. Geopolitical factors surrounding the Rohingya situation and potential responsibility-sharing commitments are also discussed. Building on this mapping, we will prepare a full report in 2019. The report will highlight a subset of anchor contributions that could build momentum for a responsibility-sharing process that delivers a “win-win-win” for refugees, host communities, and Bangladesh’s broader development objectives.

Grave and systematic human rights violations in disaster situations should be recognized as a concern for the field of transitional justice. Transitional justice mechanisms such as truth commissions, memorials, restitution and compensation programs and trials may, in some cases, make significant contributions to redressing abuses in disaster situations. Victims' perspectives and priorities should guide discussions on the relevance and application of particular transitional justice mechanisms.

The Kashmir issue is a primary source of resentment between India and Pakistan. It is considered the oldest issue on the schedule of the Security Council yet to be resolved. This divisive issue remained unsolved and has become the nuclear flashpoint. The peace of the South Asian region is severely contingent upon the peaceful resolution of the Kashmir dispute. It is not only the pivot of bitterness in the bilateral relation of India and Pakistan, it also a continuous threat to the regional peace in South Asia. This study critically assesses and evaluated the issue in the perspective of historical facts and current context regarding Kashmir. Chronological data presented and describe that the Kashmir issue has deteriorated the fragile security of South Asian region and remained a continuous threat of nuclear escalation in the region. Abstract:
The landmark United Nations Convention on the Rights of the Child (UNCRC) introduced „unique‟ provision of the right to child participation in its Article 12. This Convention, ratified by most states including Pakistan, gives right of participation to children in making decisions on matters related to them and makes it binding for the states to implement it in letter and spirit. The state is responsible for creating enabling environment which includes creation of necessary institutions, enacting or where necessary amending laws, formulating policies and strategies, allocating sufficient budgets, making congenial environment for NGOs and public consultations. This paper argues that state in Pakistan has not been able to sufficiently develop the enabling environment to fulfill the obligations that resulted in the aftermath of ratification UNCRC.

This report of the Working Group on Transitional Justice and SDG16+ articulates the contributions of transitional justice to the Sustainable Development Goals (SDGs), particularly SDG 16 on peace, justice, and inclusion, but also related goals on gender and inequality. The report contends that in contexts of serious and massive human rights violations, transitional justice provides a framework for addressing the needs of victims, helping to reduce the “justice gap,” and building sustainable peace and development.

Abstract:
This paper explores the relationship between terrorism and human rights from the international legal perspective. It first reviews the definitional content of “terrorism” and “human rights” and then discusses their doctrinal interactions—considering terrorism as both a cause and a product of human rights violations and addressing counter-terrorism efforts as a source of human rights violations that can themselves generate support for terrorism. It concludes with some observations about issues of international terrorism in the context of refugee law, criminal law and humanitarian law as well as some recommendations for future action.
