1. The Mass Media and Violent Conflicts in Sub-Saharan Africa

Abstract:
Mass media have been a critical weapon of warfare since the cold war, and even more recently, the powerful intrusion of the new media: transformed the landscape in terms of reach and influence. Its role can be both constructive and deconstructive. The Rwanda genocide, armed violence in Nigeria and Kenya, and the Balkan wars has questioned its roles, powers, and ethical responsibilities in violent conflict circumstances. In these cases, the mass media played a poisonous role. Although establishing a causal relationship between mass media and framing of opinion, emotion, and beliefs that steams violent conflicts in Sub-Saharan Africa is neither linear nor clear. However, this paper underscores the mass media’s compelling influence on how perception in the fragile armed conflict environment of Africa is developed. It is not only used as an effective propaganda machine for promoting regime defense, building resistant movement, but also transforming the political actor’s parochial interest in people’s interest.

2. Governing Abuse of Free Speech during Elections in Pakistan

Abstract:
Election creates an environment of hate which may lead to potential of violence. Although there are enough laws relating to prohibition of hate speech under the Constitution of Pakistan and the ordinary law like Pakistan Penal Code and Anti Terrorism Act, however, there are special laws which control hate speech during Elections. Although International Instruments protected freedom of speech first but did not prohibit hate speech, however, it was permitted to be limited in certain cases. Similarly, the Constitution of Pakistan 1973 also guaranteed the freedom of speech but with list of exceptions to prohibit hate speech. For this purpose, all election laws were consolidated in the form of one piece of legislation: the Election Act 2017. It prohibited hate speech under corrupt practices and made it an offence. To assure a free and fair election, it is mandatory for the Election Commission of Pakistan to frame a Code of Conduct for the political parties and the candidates. The Commission is also bound to issue a separate Code of Conduct for the media. Both Codes provide effective legal regimes to control hate speech. However, the efforts to control it can only be successful if all stakeholders struggle to confront this monster.

Abstract:
This article argues that the Committee for the Elimination of All Forms of Racial Discrimination (CERD Committee), as it exercises quasi-judicial authority, should consider applying standards of reasoning similar to those of international courts. In particular, with respect to racially discriminating speech, the legitimacy of the CERD Committee’s Communications would benefit from a margin of appreciation doctrine that leaves domestic authorities greater leeway in finding their strategy to counter the threat of anti-migrant popular sentiment and gives recognition to alternative approaches beyond criminal persecution. This allows a context sensitive approach that might do justice to both the freedom of expression and the need for a more effective protection against racially discriminating speech.

CIMA is pleased to release A Clash of Cultures: Hate Speech, Taboos, Blasphemy, and the Role of News Media, by Jane Sasseen. The ability of individuals to openly speak their minds is a core principle not only of American journalism, but American democracy. Even when speech is insulting or disrespectful to others-speech that might run afoul of hate speech laws throughout Western Europe or be banned outright in much of the rest of the world-it is generally permitted in the United States. But the rise of the Internet and the instantaneous global communications it enables have raised a host of new questions about how to handle hate speech and other potentially offensive speech when it can be seen by audiences in other countries that do not share those values.
