Abstract:
La Guinée-Bissau a besoin d'un Etat. Ses structures politiques et administratives ne lui permettent ni de contrôler son territoire, ni d'assurer les services publics minimums, ni de contrebalancer la domination politique de l'armée. Cette faiblesse structurelle est à l'origine de crises politiques récurrentes, de coups à répétition et de la prolifération de réseaux criminels. Cependant, la Guinée-Bissau semble être engagée aujourd'hui dans un nouvel élan grâce au pacte de stabilité politique signé par les trois partis politiques les plus importants en mars 2007. Le risque est réel de voir le pays devenir un narco-Etat et un no man's land politique et administratif, ouvert à tous les trafics et aux réseaux terroristes du Maghreb. La communauté internationale devrait d'urgence soutenir les efforts du gouvernement actuel pour consolider la démocratie, réformer le secteur de la sécurité et construire des structures étatiques viables.

Abstract:
The recent closure case brought against the ruling Justice and Development Party is a direct assault on Turkey's democracy. For this reason, America should not lose the opportunity to swiftly and unequivocally repudiate the establishment's attempts to re-assert control over Turkish politics by undemocratic means. The lack of a concrete resolution on the part of the U.S. in regard to the case has already resulted in a credibility gap. Given America's emphasis on and interest in Turkey's democracy and attendant reform process, a simple re-affirmation of its commitment to citizen's choices in free and fair elections would send a powerful message to a country that is on edge. Instead, Turkey is left with 'friends' who lack credibility and resolve at the worst possible moment. If the ruling party and its leadership are banned from political life, not only will Turkey lose its credibility in the Middle East as the only indigenous Muslim-majority democracy, the United States will also lose credibility in the world theatre for failing to support democracy in Turkey.

Abstract:
This article discusses the limits of the freedom of political parties in Turkey. The political party bans constitute one of the most important problems threatening the freedom of political parties in Turkey. The restrictions on the political parties come to the fore in two different forms: dissolution after the military coups and closure by means of legislation. In the current context of the case opened against the AK Party, it may be possible and advisable to apply an amendment, bringing Turkish jurisprudence in such matters in line with the standards of the European community. It is concluded that the Constitutional Court should interpret cases of the dissolution of political parties in the context of the principles of "secularism" and the "unitary state" in such a way as to take into account the requirements of the principle of "the rule of law" and to allow different political alignments to express themselves in a "human rights respecting" and "democratic" country.

Even the largest EU member states are no longer in a position on their own to shape international events or the world we all live in. Acting together in the EU they have shaped the international trade agenda. They have been much less successful in foreign policy for a combination of reasons, largely lack of will and poor arrangements. The Lisbon Treaty sets out to remedy the second of these, perhaps helping also to remedy the first in a world in which that becomes increasingly vital for European interests.

1325. Controlling Illegal Logging: Using Public Procurement Policy

Abstract:
The use of public procurement policy by consumer states to create protected markets for legal and sustainable timber is helping to exclude the products of illegal logging, thereby encouraging the legal and sustainable production of timber. Many countries already possess some form of green procurement policy into which criteria for legal and sustainable timber can easily be fitted. In general no new legislation is needed, so this offers a relatively rapid route to tackling imports of illegal timber. Nine countries currently possess some form of timber procurement policy at central government level. Although they are all very recent in implementation, the evidence already suggests that they are having a positive effect on increasing market share for verified legal and sustainable timber. However, the adoption of different criteria and coverage of products risks making it more difficult for exporters to provide supplies of timber; some degree of technical harmonization would be desirable, and seems likely. The inclusion of requirements for legal and sustainable timber in building standards provides another route for promoting these products. At present, however, the points-based systems that these standards are based on usually encourage, rather than require, sustainable timber.

1326. Stress-Testing the Regulators: Market Risks and the EU Economy

Abstract:
Today's market turbulence and global imbalances prompt the question whether economic and regulatory policies are poorly designed or just badly implemented. The question is urgent for Europe, which has its own asset booms and imbalances to worry about as well as the backwash of US problems. The imbalances in Europe's economies in large part reflect favourable shocks, such as falling interest rates and growing financial integration. But the 'growth crisis' in Portugal underscores the fact that there can be hard landings, even without a financial crisis, if fiscal policy is unwise and if productivity fails to take off. The current global imbalances and turbulence also have a common backdrop in the long period of unusually easy liquidity and low risk premia during which today's problems built up. This suggests that central banks should be prepared more often to 'lean against the wind' in times of asset price exuberance, and that politicians should not cut taxes or boost spending permanently on the back of revenue gains that result from transient financial booms. Banks and supervisors have many lessons to draw. Some involve going 'back to basics' on issues such as liquidity, off-balance-sheet operations, and the ability to close and reopen banks. Others require a careful look at incentives – in executive pay, rating agency roles and loan production systems. Supervisors also need to take better account of boom-bust cycles when they assess risks, and address cross-border issues in EU banking. Moral hazard has been partly addressed by pain inflicted on bank managements and shareholders. But at the macro level it may be building up as policy-makers act to limit losses in a setting where they cannot trace the ultimate fallout from risks. In future, their discretionary interventions need to be truly exceptional and much more symmetrical, or the money supply and the public debt will ratchet up amid serious resource misallocation.

1327. Reforming Pakistan's Police

Abstract:
After decades of misuse and neglect, Pakistan's police force is incapable of combating crime, upholding the law or protecting citizens and the state against militant violence. With an elected government taking over power after more than eight years of military rule, the importance of reforming this dysfunctional force has assumed new importance. Elected representatives will be held accountable if citizens continue to see the police, the public face of government, as brutal and corrupt. The democratic transition could also falter if deteriorating security gives the military a new opportunity to intervene, using, as it has in the past, the pretext of national security to justify derailing the democratic process on the grounds of good governance. Major reforms and reallocation of resources are required to create an effective and accountable police service.

1328. Indonesia: Implications of the Ahmadiyah Decree

On 9 June 2008, the Indonesian government announced a joint ministerial decree “freezing” activities of the Ahmadiyah sect, an offshoot of Islam whose members venerate the founder, Mirza Ghulam Ahmad. For months hardline Islamic groups had been ratcheting up the pressure for a full ban, while civil rights groups and many public figures argued that any state-imposed restrictions violated the constitutional guarantee of freedom of religion. The decree demonstrates how radical elements, which lack strong political support in Indonesia, have been able to develop contacts in the bureaucracy and use classic civil society advocacy techniques to influence government policy.

In June 2007, as Hamas took control of Gaza and a new government was formed in the West Bank, observers ventured two scenarios. The West Bank might become a model, whose economic revival and improved relations with Israel and the wider world contrasted with Gaza's sorry fate; or, given continued occupation and the structural dysfunctionality of the Palestinian Authority (PA), it would see little progress. Both were wrong. Under Salam Fayyad's competent leadership, it has made gains, particularly in law and order.

1330. Finance and the Macro-economy: The Politics of Regulatory Reform in Europe

Abstract:
This paper analyzes major changes in the regulation of the financial sector in Europe over the last three decades. Focusing on the pattern of change across five countries (Britain, France, Germany, Italy and Spain), the paper identifies two major periods of regulatory change: first, the shift away from postwar patterns of credit regulation in the 1970s and 1980s, and second, the intensification of state supervisory powers and the introduction of new regulatory structures from the 1990s to the present. In both cases, the authors point to the way in which different models of financial sector regulation affect the political consequences of macro-economic policy for political elites as an explanation for choices that governments have made in the regulatory arena. More specifically, while regulatory change in the first period may be largely explained by the way in which different postwar models of credit regulation impinged upon a government's political ability to impose disinflation, choices in favor of different regulatory structures in the second period (single regulator in Britain and Germany versus multiple regulators in the other countries) can be related to differences in the area of pension reform. By focusing on the political implications that different modes of financial regualtion can have for elected officials in the context of different macroeconomic scenarios, the authors offer an explanation of regualtory change that differs from accounts which emphasize the primacy of financial market forces in driving such change.
