1031. Conflict and Post-Conflict Governance: The Stakeholder Perspective

Abstract:
Post-conflict governance requires simultaneous and complementary action on three levels. national governance, local governance, and civil society. Norbert Mao, a parliamentary leader from Uganda, offered this progression for managing the trade-off between short-term stabilization and long-term capacity building: "In the emergency phase, you should do it for us. In the reconstruction phase, you should do it with us. And in the development phase, you should do it through us." Efforts to develop the capacity of local governments to deliver services may be more responsive to external assistance than programs aimed at overcoming systemic dysfunctions in the central government, in part because municipal officials are more accountable to their communities. Civil society should be a prominent player in transitioning to “local ownership,” which may erroneously be conceived in terms of ownership by national and perhaps local governments. Building the capacity of civil society entails connectivity with international partners and ideas, not just financing. There are trade-offs involved among the three stakeholders. Among the most salient, when a legacy of abuse of power by the national government and repression of opposition groups must be confronted, an active civil society is essential. An invigorated civil society can fundamentally challenge illicit structures of power that profited from conflict.

Abstract:
Drug production and drug trafficking are effects as well as causes of political instability. They flourish under weak states and sustain that weakness by financing insurgency and warlordism and by intimidating or corrupting the officials of enforcement agencies and security forces. Afghanistan is a primary instance of this complex of social and political pathologies.

Abstract:
This is the fourth in a series of reports, underwritten principally by the Ford Foundation, and, in this particular case, additionally, the Houston Endowment, as to various cities' (namely, New York, Los Angeles, Chicago, New Orleans, and Houston) preparedness for terrorism and catastrophic natural disasters. Our goal in each city was to identify best practices that can be replicated in other cities around the nation; to identify any gaps in preparedness; and to make recommendations to close any such gaps. We conducted these assessments primarily through roundtable discussions in each city in 2007-2009 with key local, state, and federal government officials, corporate and non-profit stakeholders, and academic and think tank experts, with some supplemental research and follow-up interviews. The audience for each roundtable consisted of representatives of funding organizations, congressional staff, policy experts, and students, all of whom were helpful in engaging the speakers in dialogue following their formal presentations.

1034. Immunities of State Officials, International Crimes, and Foreign Domestic Courts

Abstract:
This article examines the extent to which state officials are subject to prosecution in foreign domestic courts for international crimes. We consider the different types of immunity that international law accords to state officials, the reasons for the conferment of this immunity and whether they apply in cases in which it is alleged that the official has committed an international crime. We argue that personal immunity (immunity ratione personae) continues to apply even where prosecution is sought for international crimes. Also we consider that instead of a single category of personal immunity there are in fact two types of such immunity and that one type extends beyond senior officials such as the Head of State and Head of Government. Most of the article deals with functional immunity (immunity ratione materiae). We take the view that this type of immunity does not apply in the case of domestic prosecution of foreign officials for most international crimes. However, we reject the traditional arguments which have been put forward by scholars and courts in support of this view. Instead we consider the key to understanding when functional immunity is available lies in examining how jurisdiction is conferred on domestic courts.

1035. Has the Fed Been a Failure?

As the one-hundredth anniversary of the 1913 Federal Reserve Act approaches, we assess whether the nation's experiment with the Federal Reserve has been a success or a failure. Drawing on a wide range of recent empirical research, we find the following: (1) The Fed's full history (1914 to present) has been characterized by more rather than fewer symptoms of monetary and macroeconomic instability than the decades leading to the Fed's establishment. (2) While the Fed's performance has undoubtedly improved since World War II, even its postwar performance has not clearly surpassed that of its undoubtedly flawed predecessor, the National Banking system, before World War I. (3) Some proposed alternative arrangements might plausibly do better than the Fed as presently constituted. We conclude that the need for a systematic exploration of alternatives to the established monetary system is as pressing today as it was a century ago.

1036. Do Vouchers and Tax Credits Increase Private School Regulation?

School voucher and education tax credit programs have proliferated in the United States over the past two decades. Advocates have argued that they will enable families to become active consumers in a free and competitive education marketplace, but some fear that these programs may in fact bring with them a heavy regulatory burden that could stifle market forces. Until now, there has been no systematic, empirical investigation of that concern. The present paper aims to shed light on the issue by quantifying the regulations imposed on private schools both within and outside school choice programs, and then analyzing them with descriptive statistics and regression analyses. The results are tested for robustness to alternative ways of quantifying private school regulation, and to alternative regression models, and the question of causality is addressed. The study concludes that vouchers, but not tax credits, impose a substantial and statistically significant additional regulatory burden on participating private schools.

Welcome to International Affairs Forum's fourth special publication. We are once again delighted to be able to offer our readers a diverse collection of views, and I hope everyone will find something of interest. I think this publication stands out not only because of the quality of contributors, who have been generous enough to give up their valuable time over such a busy period, but also the range of subjects and geographical reach—we have contributors based on four continents and from nine countries covering everything from defense policy through Brand America and U.S.-India relations. I don't wish to add anything to the enormous amount of ink spilled over the historic nature of the recent election, except to say that whatever one's views of the past eight years—and this publication contains a full range of them—living in Tokyo has demonstrated to me time and again that although this is the Asian century, the world's eyes have been, and still are, very much on the United States of America and what Barack Obama will do in office.

1038. Zimbabwe: Engaging the Inclusive Government

After nearly a year of seemingly endless talks brokered by the Southern African Development Community (SADC), Zimbabwe's long-ruling ZANU-PF party and the two factions of the opposition Movement for Democratic Change (MDC) formed a coalition government in February. Opposition entry into government is a landmark development, and broad segments of the population are optimistic for the first time in years that a decade of repression and decline can be reversed. There is considerable international scepticism whether the flawed arrangement can succeed; many are tempted, with some reason, to second-guess the decision of mainstream MDC leader Morgan Tsvangirai to accept the deal under SADC and ZANU-PF pressure. But he had no good alternative, given a collapsed economy and humanitarian catastrophe from which his constituency was suffering. Donors should re-engage and apply a “humanitarian plus” aid strategy. South Africa, in collaboration with SADC, should negotiate retirement of hardline senior security leaders in the lifespan of the inclusive government.

Abstract:
Government and private roles in this segment of health service delivery remain controversial in China, as in many countries. Using 2004 data from over 360 government-owned and private hospitals in Guangdong Province, we find that non-government hospitals serve an overlapping but distinct market. They are smaller, newer market entrants, more likely to specialize, and less likely to be included in urban social insurance networks. We also document differences in staffing and financial performance, but no systematic ownership differences in simple measures of quality, controlling for size, location, case-mix and other confounding factors.

Abstract:
President Barack Obama, former U.S. Senate majority leader Tom Daschle, and others propose a new government agency that would evaluate the relative effectiveness of medical treatments. The need for “comparative-effectiveness research” is great. Evidence suggests Americans spend $700 billion annually on medical care that provides no value. Yet patients, providers, and purchasers typically lack the necessary information to distinguish between high- and low-value services.
