1931. Explaining Transformation of Turkish Civil Society in the EU Accession Process

Abstract:
This study investigates the relationship between the announcement of Turkey's EU candidacy status at the EU's Helsinki Summit in 1999, and the development and transformation of Turkish civil society organizations (CSOs). It is argued that theories of historical institutionalism and rational choice institutionalism provides a useful framework for explaining the changes that took place in the number and institutional structures of Turkish CSOs. Historical institutionalism helps explain how the EU's affirmation of Turkey's EU candidacy has served as a critical juncture for the evolution of path dependency for Turkish CSOs. The economic reforms and democratization driven by Turkey's accession process are given special attention in this respect. Rational choice institutionalism will be employed to explain structural transformations within Turkish CSOs, and their considerable dependence on the funds provided by the EU.

1932. The Legal Reasoning of ICSID Tribunals – An Empirical Analysis

Abstract:
This empirical analysis of the use of interpretive arguments by ad hoc tribunals of the International Centre for the Settlement of Investment Disputes covers almost 100 cases decided during the past 10 years. The cases are analysed with a view to determining which arguments the tribunals use and how the arguments are used in light of Articles 31 and 32 of the Vienna Convention on the Law of Treaties. The analysis provides a basis for addressing the extent to which ICSID tribunals contribute to creating a predictable legal framework in which the interests of investors, states, and third parties are taken properly into account; the extent to which ICSID tribunals contribute to a coherent development of international investment law; and whether ICSID tribunals contribute to a 'fragmentation' of international law. Despite ICSID tribunals being ad hoc tribunals that solve legal disputes on the basis of heterogeneous legal sources, the article indicates that there is a tendency among ICSID tribunals to contribute to a homogeneous development of the methodology of international law. Nevertheless, the article concludes that ICSID tribunals could do significantly more to align their approaches to interpretive arguments with those of other international tribunals.

1933. Financial Impacts of Climate Change: An Overview of Climate Change-related Actions in the European Commission’s Development Cooperation

Abstract:
This paper analyses the variety of different external aid initiatives and financing mechanisms of the European Commission addressing climate change and development objectives, such as those stemming from the 2004 EU Action Plan on Climate Change and Development, from the Global Climate Change Alliance (GCCA) and those under the Thematic Programme for Environment and Sustainable Management of Natural Resources (ENRTP). The paper also outlines related Commission commitments with the European Investment Bank (EIB), the World Bank and the United Nations. While the European Commission has advanced a number of new initiatives, it seems that the complexity of responsibilities in the management of the current financing instruments requires organisational restructuring, a more transparent reporting mechanism and the development of better indicators to evaluate the impacts of those initiatives. Overall it appears that the Commission is just at the beginning of taking full account of climate change in development cooperation. Its contribution is rather limited in view of the financing needs related to climate change in developing countries, and innovative financing mechanisms should be sought together with member states and the private sector.

Abstract:
On February 13, 2008 the Iraqi parliament simultaneously passed a law that sets forth the relationship between the central and provincial governments, an amnesty law and the 2008 national budget. The passage of these laws was the result of months of negotiation and last-minute substantive and procedural compromises that could portend a shift away from merely ethnic and sectarian-based alliances to inter-ethnic and sectarian issue-based politics. At the same time, Iraqi lawmakers may have discovered a strategy of simultaneous consideration of multiple matters that could increase the likelihood of consensus and resolution—a sharp contrast to what has until now been an issue-by-issue approach that has often resulted in impasses and political gridlock.

1935. Embedded Provincial Reconstruction Teams

Abstract:
In January 2007, President Bush announced that the U.S. would double the number of Provincial Reconstruction Teams (PRTs) in Iraq as part of his plan for a "New Way Forward." PRTs are small, civilian-military units that assist provincial and local governments to govern more effectively and deliver essential services. These new PRTs would be embedded with Brigade (Army) and Regimental (Marine) Combat Teams (B/RCTs) participating in the "surge" of U.S. forces into Baghdad, Anbar and Erbil provinces. The new ePRTs would begin as four person interagency teams, but would expand to include civilian experts in a broad range of specialties. These new PRTs were staffed with Defense Department civilians and members of the National Guard and Army Reserve until funds became available to the State Department to hire civilian contractors. The process of deploying civilian experts is now underway, but the B/RCTs to which they are being assigned will return to the United States by August 2008.

Abstract:
On February 18, 2008 the Ugandan government and the Lord's Resistance Army (LRA) reached agreement on an accountability and reconciliation accord that would provide for prosecution in Uganda of senior LRA leaders most responsible for atrocities committed over the course of the country's 20-year long civil conflict. The agreement also provides that lower level perpetrators will be held accountable by traditional justice mechanisms indigenous to Northern Uganda, where much of the violence occurred.

In partnership with Concordis International and the Preparatory Committee for the Darfur-Darfur Dialogue and Consultation (DDDC), USIP held a consultation with approximately30 members of the North American Darfur diaspora community from February 12-14, 2008.Representative of Darfur's constituencies, this group of Darfurians traveled to Washington, D.C. from throughout the U.S. and Canada in order to address a broad range of issues related to the conflict in their homeland. Through small-group brainstorming and plenary ession debates, the group developed a set of consensus recommendations aimed at creating the conditions necessary for a sustainable safe and secure environment to prevail in the troubled region.

World hunger is prevalent yet receives relatively less attention compared to poverty. The MDGs have taken a step to address this with the resolution of halving the number of starving people in the world by 2015. A substantial and sustainable reduction in hunger will also greatly improve the chances of meeting the MDGs related to poverty reduction, education, child mortality, maternal health, and disease. Hunger though is not a straightforward problem of producing enough to feed the world's population; it has many cross-cutting dimensions. This study addresses a combination of economic, social, and political perspectives, drawing upon academic research of the economic factors and the experiences of international organizations and civil society.

In Research Area D “Welfare and Environment” of the Research Center (SFB) 700 we investigate how governance services are provided in the production of respective collective goods in areas of limited statehood. Six different projects explore how governance arrangements evolve and how effective, legitimate, and sustainable they are in delivering governance services. During a workshop in January 2008, we discussed the preliminary results of the first phase of research. This working paper documents these first findings and seeks to raise the readers' interest in the projects' upcoming publications.
