It has become increasingly clear that economic development and poverty reduction can significantly reduce the incidence of conflict. This is of particular importance for countries recovering from violent conflicts, considering they are often among the poorest even compared with other developing countries, and are extremely vulnerable to slipping back into violence.

Abstract:
This study aims to illustrate patterns of behavioural rules derived from corporate obligations, and to deduce from these a draft Code of Conduct (CoC) for Private Military and Security Companies (PMSCs). The purpose of a Code of Conduct for Private Military and Security Companies is to oblige such companies to comply with international human rights standards and the norms of international humanitarian law (IHL), thus improving the protection of human rights. In addition to drawing up a CoC together with implementation and monitoring mechanisms, this study aims to list the requirements of the relevant industry on the one hand, as well as of the stakeholders in politics and civil society on the other. It will then compare the divergence between the two in order to assess the potential success of an initiative for the recognition of a CoC for Private Military and Security Companies. Finally, this study will draw up specific options of action and recommendations related to the process of adopting a CoC.

403. Somalia: To Move Beyond the Failed State

Abstract:
Since 1991 Somalia has been the archetypal failed state. Several attempts to create a transitional set-up have failed, and the current one is on the brink of collapse, overtaken yet again by an Islamist insurgency, despite the support of an Ethiopian military intervention since December 2006. Over the last two years the situation has deteriorated into one of the world's worst humanitarian and security crises. The international community is preoccupied with a symptom - the piracy phenomenon - instead of concentrating on the core of the crisis, the need for a political settlement. The announced Ethiopian withdrawal, if it occurs, will open up a new period of uncertainty and risk. It could also provide a window of opportunity to relaunch a credible political process, however, if additional parties can be persuaded to join the Djibouti reconciliation talks, and local and international actors - including the U.S. and Ethiopia - accept that room must be found for much of the Islamist insurgency in that process and ultimately in a new government dispensation.

This paper examines some of the public diplomacy challenges that national governments and international organizations like NATO are increasingly facing. While new media technologies have become a powerful enabler in the globalised information environment, international security issues no longer remain 'close-hold' subjects reserved to foreign and security policymakers. Analyzing some of the current public trends in transatlantic themes in Europe and the United States, the author takes a closer look at NATO's evolving communication policies and activities. Evidently, public diplomacy has its limits. No matter how skilfully designed, it cannot replace political messages and contents. A serious political crisis or the loss of human lives cannot (and must not) be turned into a positive news story. However, if public diplomacy aims at establishing a trustful and interactive relationship between the seekers of information and the respective organization or government, public diplomacy requires political will, strategy and resources to be effective and credible.

406. Cultural policy in France - Genesis of a public policy category

Abstract:
This paper is a partial translation of a book published in French, which puts forward a socio-historical analysis of the relationships between cultural and political/bureaucratic field. This analysis sheds light on the conditions of the emergence, shaping and institutionalisation of a State policy regarding culture in France, from the late 19th to the 20th century. In this perspective, what is now called “cultural policy” is considered as the product of the history of power struggles, wherein the main stakes are the legitimate definition of culture and the definition of the legitimate functions of the State. The historical comparison reveals that these power struggles have long hindered the shaping of a “cultural policy”, which only took place starting in the early 1960s. It also shows that the persistence of these issues led to an “institutionalisation of vagueness” of a policy whose object could still not be precisely defined by the late 20th century. This research thus contributes to the history and sociology of the cultural field, as well as of the State and State intervention. By analysing the conditions and limits of a State definition of culture, it also sheds light on the modes of expression of the State's symbolic violence. The notion of category of public intervention developed used in the context of this research is embedded in the elaboration of a broader framework of analysis, aiming to account for socio-historical processes of institutionalisation of groups, relational structures, representations and constitutive normative frameworks of what is called a policy.

407. War and Peace in Early Modern East Asia: Hierarchy and Legitimacy in International Systems

Abstract:
Between 1368 and 1841 – almost five centuries – there were only two wars between China, Korea, Vietnam, and Japan. These Sinicized states crafted stable relations with each other, and most of the violence and instability arose between these states and the nomadic peoples to the north and west of China and Korea. Building on the “new sovereignty” research in international relations, I argue that the status quo orientation of China and established boundaries created a loose hierarchy within anarchy that had much to do with the period of peace. Built on a mix of legitimate authority and material power, the China-derived international order provided clear benefits to secondary states, and also contained credible commitments by China not to exploit secondary states that accepted its authority. Korean, Vietnamese, and even Japanese elites consciously copied Chinese institutional and discursive practices to craft stable relations with China, not to challenge it. International systems based on legitimacy and hierarchy are not unique to early modern East Asia, and incorporating these insights into our theories of international society has implications for the contemporary world as well.

A aucun moment depuis le coup d'Etat du 15 mars 2003, qui a porté au pouvoir l'actuel président François Bozizé, le risque d'une généralisation de la violence en Centrafrique n'a été aussi grand qu'aujourd'hui. Alors que l'ouverture d'un dialogue politique inclusif le 8 décembre – initialement prévue pour juin 2008 – continue de se négocier pied à pied, tant le régime en place que les principales forces d'opposition prépa- rent, en fait, le recours à la lutte armée comme ultima ratio d'une sortie de crise. Une réelle démocratisation et une réforme de l'Etat semblent possibles si les acteurs centrafricains arrivent à surmonter leurs désaccords d'une manière consensuelle et s'abstiennent de recourir à la violence pour accéder au pouvoir ou pour le garder. Le dialogue politique incl usif doit impérativement être recentré sur l'organisation des élections en 2010 et la négociation d'un mécanisme crédible de justice transitionnelle. Afin d'éviter une nouvelle prise de pouvoir par la force, le gouvernement centrafricain doit conduire à terme la réfo rme du secteur de sécurité et permettre un processus équitable d'intégration des forces rebelles dans les services de sécurité.

409. Northern Uganda: The Road to Peace, with or without Kony

Abstract:
The Juba peace process, intended to bring closure to the northern Uganda conflict and disarm Joseph Kony's Lord's Resistance Army (LRA), is failing. On 29 November, Kony failed again to appear at the Ri-Kwangba assembly point to sign the Final Peace Agreement (FPA). Since April, armed actions attributed (not always accurately) to the LRA resumed in Sudan's Western Equatoria state and the Bas Uélé district of the Congo (DRC). The LRA menace has moved out of Uganda, but the north does not yet have the certainty of sustainable peace. The government's reconstruction, development and oil exploitation policies will only bring peace if joined to a credible process of consultation over benefits and of reconciliation and measures to address the region's marginalisation from national institutions. Additional negotiations on insufficient aspects of the protocols, under a new format and supported by a military containment strategy, are also needed to disarm and reintegrate LRA fighters. For all this to happen, donor governments must adopt a more critical view of government intentions and performance.

410. Georgia: The Risks of Winter - Europe Briefing N°51

The situation in and around Georgia's conflict areas remains unstable. Violent incidents are continuing. Shots were fired near a convoy carrying the Georgian and Polish presidents on 23 November. European Union (EU) monitors are being denied access to South Ossetia and Abkhazia. Unambitious multi-party negotiations focusing on security and internally displaced person (IDP) return have gotten off to a slow start in Geneva. For the moment, however, domestic politics are the capital's main preoccupation. President Mikheil Saakash¬vili's position is at least temporarily secure, but his administration is likely to be severely tested politically and economically in the winter and spring months ahead. The August 2008 war with Russia and the global financial crisis have seriously undermined Georgia's economy and the foreign investment climate. Social discontent could rise as economic conditions worsen unless the government pushes forward with economic and political change.
