271. U.S.-ASEAN-ROK Cooperation on Nontraditional Security

Abstract:
Traditional security issues in the Asia-Pacific, such as tensions on the Korean Peninsula or disputes over the South China Sea, consistently attract the attention of policymakers within the region and abroad. But their consequences for ordinary people are often dwarfed by the fallout from nontraditional security (NTS) events, such as climate change, resource scarcity, infectious diseases, natural disasters, irregular migration, famine, people smuggling, drug trafficking, and transnational crime. For countries in the Association of Southeast Asian Nations (ASEAN), the human and economic losses from NTS threats can be staggering. Moreover, economic and social costs from NTS threats consume resources that otherwise could be channeled toward economic growth and social welfare. Historically, there have been bilateral and multilateral attempts at cooperation on NTS in the Asia-Pacific, but they have not been enough. Trilateral cooperation among the United States, ASEAN, and South Korea would benefit not just the participating parties, but also the region as a whole. Such cooperation would allow South Korea to contribute to the region and is consistent with the Moon Jae-in government’s desire to play a greater foreign policy role beyond the Korean Peninsula. It would also advance the U.S.-South Korean alliance and give South Korea experience that could be used in future NTS crises in North Korea such as famines, natural disasters, or pandemics.

Abstract:
With effects of climate change becoming more prominent, it is important to examine what climate change will mean in terms of human rights and the impact on the most vulnerable populations. The UN Office of the High Commissioner for Human Rights emphasizes “increasing frequency of extreme weather events and natural disasters, rising sea-levels, floods, heat waves, droughts, desertification, water shortages, and the spread of tropical and vector-borne diseases” as a few of the many adverse effects resulting from climate change. Moreover, these issues threaten the enjoyment of the most basic rights including right to life, water, food, sanitation, among many others. Ethiopia, a country with over 80% of its population living in multidimensional poverty, is no beginner when it comes to dealing with famines. The Ethiopian Civil war began with a coup d’etat in 1973, which was largely a result of unrest after Emperor Haile Selassie refused to respond to the 1972 famine. In 1984, Ethiopia suffered a worse, more publicized famine, which is said to have killed over a million people. International initiatives were able to secure international aid, but political instability into 1991 led to lower rates of development as compared to its other Sub-Saharan neighbors. In the midst violence, a large sector of the Ethiopian population was lost, and the Ethiopian economy collapsed as a result of the government’s resistance to welcome international aid in rebel-controlled areas. The Federal Democratic Republic of Ethiopia was established in 1991 and was followed by a shift in Ethiopia’s resistance to international aid, ultimately jumpstarting the upwards trend of development.

Abstract:
As COHRE wraps up the academic year in the coming weeks, the Center’s focus on labor rights is coming to an end, despite the vast range of important topics left to be discussed. We cannot touch on every aspect of labor rights, though it is important that the international community remain vigilant in advocating for increased respect of labor rights, particularly as we enter into an uncertain age of technological advancement and a changing climate. With this blog, I aim to shed some light on labor issues in relation to climate change, a topic often left out of academic discourse. Population increase and decreasing availability of shared resources including water and land are exacerbated by the indisputable climactic changes the earth is facing. Climate change will also affect respect for labor rights in significant ways, and if the international community is aware of these vulnerabilities, adaptation and mitigation mechanisms can be more effective in addressing the issues.

Abstract:
Nearly half of the claims brought under the Energy Charter Treaty1 raise issues related to the modification of the Renewable Energy Support Schemes (RESs), but only two decisions have been published: Charanne and Eiser. This paper evaluates these decisions in light of the existing general practice on expropriation and Fair and Equitable Treatment, as well as from a pragmatic perspective in the context of climate change. The article concludes that tribunals should recognize reinforced stability to RESs under the ECT.

275. The Need for Governance of Climate Geoengineering

Sooner rather than later, policymakers around the world will need to confront an uncomfortable reality: that despite the best efforts of national governments and thousands of mayors and other civic leaders, we can no longer contain global average temperatures to below 1.5–2 degrees Celsius above preindustrial levels through mitigation of carbon emissions alone. It is widely acknowledged that even if the world stopped all emissions today, there would still be a rise in global temperatures to a level that would stay for hundreds of years (the lifetime of the carbon dioxide already in the atmosphere) before temperatures began to drop, thus constituting a temperature “overshoot.” For many experts the question is no longer whether the world can keep the temperature rise below the goals stipulated in the Paris Agreement, but by how much will the world miss that target and how long will the overshoot last. The acknowledgement of this temperature overshoot—alongside a growing appreciation of its devastating impact on people’s lives, the global economy, and the environment—may mark a new inflection point in our efforts to manage the risks of climate change.1 When you add to this the U.S. president’s announcement in June 2017 that the nation would withdraw from the Paris Agreement, it comes as no surprise that a growing number of scientists are thinking about additional approaches to managing the risks of an overshoot. Perhaps most dramatically, we have seen a resurgent interest in a field that once resided at the fringes of science or on the pages of sci-fi novels, but which is now being taken quite seriously in academic circles: geoengineering. As this interest develops, it is becoming more likely that a group of countries or cities or even one or more wealthy individuals might decide to deploy geoengineering technologies during the coming decades. We need to be ready for any such eventuality; and being ready means considering a host of pressing questions. How would we govern such actors? Who assesses the balance of risks and rewards when deploying geoengineering technologies? What safeguards and what compensation mechanisms need to be built in? If we start deliberately altering global temperatures, who controls the global thermostat? It was to address these questions that the Carnegie Climate Geoengineering Governance Initiative was born: to bring the profoundly complex issues of geoengineering governance and ethics to a much wider audience.2 We are potentially at the dawn of an age of geoengineering. It is time for policymakers to start discussing whether geoengineering is to go forward and, if so, how.

Abstract:
Based on the major normative political theory contributions on global climate justice, the present paper analyzes the new international agreement on climate change, adopted at COP 21 in Paris (2015). Therefore, a literary review of the extensive normative theoretical discussion about global climate justice is made, with special attention to the two approaches that have permeated multilateral political negotiations - historical responsibility and equal per capita emissions. From this normative discussion, this paper recalls the global climate change negotiation process, focusing on the Kyoto Protocol. Next, the analysis emphasizes on the Paris Agreement in an effort to evaluate the normative questions on justice and equity within the environmental governance regime. Finally, the set of conclusions indicates that, although the flexibility of the Agreement has encompassed some dimensions of responsibility, necessity and ability to bear the costs, the most complex dimensions of justice and equity has not been completely solved, which may hinder the operation of environmental governance in a near future.

277. A Multiple Streams Explanation of Pakistan’s Climate Change Policy

Abstract:
Despite having minimal contribution to the global carbon emissions, Pakistan is considered to be one of the most vulnerable countries to the catastrophes of climate change. The country experienced back-to-back super floods in 2010 and 2011. In 2010 alone, the floods inundated 20 percent of the country and displaced some 20 million people, making it the biggest human displacement caused by a single climate-induced event in the history(Ministry of Climate Change, 2012). In the wake of these disasters, the Government of Pakistan established the world’s first full-fledged National Ministry of Climate Change and approved a National Policy on Climate Change in 2012. In this context, this paper applies a Multiple Streams lens to understand the agenda-setting process that prompted the development and approval of this policy. The paper will first discuss Pakistan’s vulnerability to climate change and the relevant literature on climate change agenda setting, and will then explore how various facts and events fit into the three streams of Multiple Streams Framework to account for the agenda-setting process that led to development and approval of the national climate change policy.

Abstract:
This volume is a result of the dialogue between experts on Cuba-U.S. relations initiated by the Centro de Investigaciones de Política Internacional of the Instituto Superior de Relaciones Internacionales (CIPI/ISRI). Aimed at bringing together scholars and policymakers, among others, with expertise on the topic, the annual meetings in Havana have for years stimulated in-depth discussions by participants primarily from Cuba, the United States, and Latin America. The exchanges represent a wide range of perspectives and even of vocabularies. For example, the Cubans use the word blockade when referring to the U.S. embargo of the island and tend to hear “regime change” when U.S. officials refer to “democracy promotion”. In one respect there has been considerable consensus—that U.S. policy toward Cuba since the 1960s was a failed policy as the Obama administration eventually concluded and many experts have argued. The 2014 annual CIPI/ISRI meeting was in full swing on December 17, 2014 when rumors began to circulate that President Raúl Castro and President Barack Obama were going to make statements at mid-day concerning Cuba-U.S. relations. Tension mounted and at noon there was standing room only in the conference auditorium as the two Presidents announced on TV their commitment to the normalization of relations that had been ruptured in 1961. The room erupted in cheers, sobs, and the singing of the Cuban and U.S. national anthems. The experts were shocked. In panel after panel during the previous two days, they had speculated that there might be some relaxation of tensions, but no one predicted the initiation of a move toward normalization and the resumption of formal diplomatic relations. In the midst of the celebration Wayne Smith, who as a young Foreign Service officer had been tasked with closing the U.S. embassy in Havana in 1961, entered the auditorium and soon chants of “WAYNE—WAYNE” echoed throughout and he was pushed forward and asked to speak. Wayne had been honored the night before for his work to resolve U.S.-Cuban conflicts beginning when he resigned as the Chief of the US Interest Section in 1982 over differences with the Reagan administration’s policies toward Cuba. From that time forward he fought for a reconceptualization of U.S. policy toward Cuba as a scholar-advocate. Wayne simply said that the night before December 17, 2014 he had prayed that normalization would occur before he died and that his prayers had been answered. The moment catalyzed what many conference participants were feeling—a sense that after more than fifty years of hostilities the long road toward normalization could begin. It is the objective of this book to analyze the first two years of the process toward normalization of Cuba-U.S. relations from December 17, 2014 to January 2017. The majority of the chapters are revised and updated versions of papers presented at the 2015 CIPI/ISRI conference. A few of the chapters were commissioned afterwards to cover such topics as sanctions and claims. This volume does not attempt to modify the opinions or conclusions of the authors. Rather it lets the differences stand in an effort to better comprehend what has kept the two neighboring countries apart for so long and the nature of the challenges facing the process toward normalization. The authors analyze the causes of over fifty years of hostile relations interspersed with fitful negotiations that were marked by lack of trust, misperceptions, and miscues, as well as the challenges the process toward normalization currently faces. Since D17 (December 17, 2014) a bilateral Cuba-U.S. commission has been established, as well as technical working groups, in order to devise new agreements and stimulate the unravelling of the substantial accumulation of laws, regulations, and directives in both countries that have slowed the process toward normalization. Progress in introducing new regulations and directives has been slow and arduous. While some advances have been made particularly in terms of easing restrictions on travel to Cuba, as well as encouraging commerce and communications, much remains to be done. In addition, major impediments exist—the principal one being the U.S. embargo/blockade of Cuba which requires action by the U.S. Congress to remove. There are also major issues relating to U.S. preferential treatment of Cuban immigrants, continuing U.S. sanctions, as well as legal claims by both parties for expropriated properties and damages. The identification of mutual interests and agreements to cooperate has been apparent in Cuba-U.S. exchanges on security and environmental issues, among others. Both the Cuban and U.S. negotiators have admitted over the last two years that the process is difficult. Among the challenges are developing a common vocabulary regarding issues of sovereignty. Other questions are related to the direction of each country’s foreign policy particularly given domestic developments in both countries, for example, the level of political and ideological polarization in the United States and the actions that President Donald Trump and a Republican Congress might take beginning in January 2017. Add to this the stated intention President Raúl Castro to end his term as head of state in early 2018 and unknowns abound.
