301. Evaluating Governance. Effectiveness and Legitimacy in Areas of Limited Statehood

Abstract:
While it is widely acknowledged that effectiveness and legitimacy both play an important role in the evaluation of governance, the causal relationship between these two concepts is far from clear. While some theorists hold that there is an inevitable trade-off between the demands of effectiveness and legitimacy, others argue that both qualities are mutually reinforcing. The aim of this paper is to shed light on the relationship between these two standards under conditions of limited statehood. The paper is organized into three sections: In the first section I will define the central concepts of effectiveness and legitimacy. While the main features of the concept of effectiveness are straightforward, the concept of legitimacy is notoriously opaque. In the second section, I will argue that the causal relationship between effectiveness and legitimacy is far more complex than usually assumed. Most scholars describe the connection as a virtuous circle: The more effective a political order or institution is, the more legitimate it is, and the more legitimate it is, the more effective it becomes. While the causal pathway from legitimacy to effectiveness is well understood, this does not hold true for the reverse connection from effectiveness to legitimacy. I will therefore identify four necessary conditions which have to be met in order to make the virtuous circle argument compelling. These are the conditions of (1.) “instrumental legitimacy belief,” (2.) “shared social goals,” (3.) “transparency,” and (4.) “generalization”. Finally, I will argue that these conditions are serious challenges to effective and legitimate governance in areas of limited statehood.

302. Executive Accountability in Southeast Asia: The Role of Legislatures in New Democracies and Under Electoral Authoritarianism

In an influential study, Fish and Kroenig argue that "overarching institutional designs" (i.e., presidential, parliamentary, and dual systems) tell us less about the prospects of a new democracy than does the particular strength of the legislature. Specifically, executives are best checked where legislatures are powerful, generating horizontal accountability. In addition, ordinary citizens are better informed by the robust party systems that strong legislatures support, fostering vertical accountability. In comparing Freedom House scores with their Parliamentary Powers Index (PPI), Fish and Kroenig show clear correlations, leading them to conclude that democracies are made strong by legislatures that are empowered. In this monograph, this thesis is tested in five country cases in Southeast Asia: the Philippines and Indonesia, both new democracies, and Malaysia, Cambodia, and Singapore, cases of electoral authoritarianism. Analysis uncovers that in the new democracies, though their legislatures may be rated as powerful, members are geared less to checking the executive than to sharing in state patronage. In addition, although the legislature is evaluated as weak under electoral authoritarianism, it features an opposition that, with little access to patronage, remains committed to exposing executive abuses. What is more, when the executive operates a regime type that lacks the full legitimacy gained through general elections, he or she grows more receptive to at least mild legislative scrutiny. Contrary to Fish and Kroenig, then, this study concludes that the executive is held more accountable by legislatures under electoral authoritarianism than in new democracies. But rather than leading to a transition to democratic politics, this accountability strengthens authoritarian rule.

Abstract:
The uprisings that unfolded in countries throughout the Middle East and North Africa during the first half of 2011 triggered a wave of electoral reforms and proposals for reform. In Egypt, one of the most pressing and controversial questions has been how to elect a new parliament that, as part of its charge, will select a body to draft a new constitution. How to elect representative assemblies is one of the fundamental questions of democracy. The resulting choice is greatly consequential in the transition from a despotic regime to a democratic system. The real challenge of election system design is producing an assembly that represents societal diversity, supports the important policy decisions made by legitimate governments, and provides a check on the exercise of executive authority.

304. Civil Society 2.0?: How the Internet Changes State-Society Relations in Authoritarian Regimes: The Case of Cuba

In the debate over the role of civil society under authoritarian regimes, the spread of transnational web-based media obliges us to rethink the arenas in which the societal voice can be raised–and heard. Taking the case of state-socialist Cuba, a diachronic comparison analyzes civil society dynamics prior to the Internet–in the early to mid-1990s, and a decade later, after digital and web-based media made their way onto the island. The study finds that in the pre-Internet period, the focus was on behind-the-scenes struggles for associational autonomy within the state-socialist framework. A decade later, web-based communication technologies have supported the emergence of a new type of public sphere in which the civil society debate is marked by autonomous citizen action. While this defies the socialist regime's design of state-society relations, its effect on democratization depends on the extent to which a web-based voice connects with off-line public debate and social action.

Six mois après la nouvelle victoire électorale du Conseil national pour la défense de la démocratie et Forces de défense de la démocratie (CNDD-FDD), le Burundi s'enfonce dans une impasse politique qui pourrait se transformer en une crise majeure susceptible de remettre en cause dix ans de progrès. En effet, au lieu de consolider la démocratie, les élections communale, parlementaire et présidentielle de 2010 ont abouti à la marginalisation de l'opposition, au p assage dans la clandestinité des Forces nationales de libération (FNL) et à l'émergence d'une nouvelle rébellion. Combinée à un système de gouvernance faible, cette évolution pourrait conduire à un recul démocratique. Seul s le rétablissement du dialogue politique entre le gouvernement et l'opposition, la sortie de la clandestinité pour les FNL et le renforcement des institutions démocratiques sont de nature à inverser cette dangereuse évolution.

Abstract:
The current wave of protests in Egypt has pitted thousands of demonstrators against the police and Central Security Forces (CSF). The performance of these forces is key to the outcome of the crisis. If they can contain the demonstrations without excessive violence, the protests will likely burn themselves out over time. But if the demonstrations continue or escalate into greater violence, the police and CSF could break down, either dissolving entirely or engaging in undisciplined violence that further exacerbates the situation. Such a scenario, or even the likelihood of it, would probably spur the government to deploy army personnel to support the security forces, deter further demonstrations, and, if necessary, put down the protests through force. That would be a true crisis for the government, one with an uncertain outcome.

Inspired by events in Tunisia, tens of thousands of Egyptians took to the streets on January 25 in major cities from Alexandria to Cairo, the largest demonstrations to hit the country since the bread riots of the 1970s. The government, which did not initially confront demonstrators in Cairo's Tahrir Square, finally took forceful action to remove them late last night. Today, January 26, the Interior Ministry announced that public gatherings and protests will no longer be tolerated; there were further clashes in Cairo and Suez. More protests are anticipated after Friday prayers (January 28). Will the government's tactics quell the demonstrations or cause them to spread? And what approach should Washington take?

As protests continued in Cairo, questions intensified about when and how President Hosni Mubarak would step aside and what kind of transitional government might replace him. The "key actor" at this time is Egypt's military leadership, which is concerned about growing violence, economic damage, and continued instability, says Bruce K. Rutherford, author of Egypt After Mubarak: Liberalism, Islam, and Democracy in the Arab World. "If they want these demonstrations to end, they can either intervene and use force to disperse the demonstrators or they can ask President Mubarak to leave," he says, which would indicate the army's belief that Mubarak's continued presence is destabilizing. Rutherford says the opposition has organized a ten-person leadership group headed by Mohamed ElBaradei, but that Egyptians are skeptical about the government's offer to open discussions with the opposition because in the past, such dialogues haven't led to any change. He says a possible successor to Mubarak may be former foreign minister Amr Moussa, currently head of the Arab League.

310. Nigeria's Elections: Reversing the Degeneration?

Abstract:
The April 2011 general elections – if credible and peaceful – would reverse the degeneration of the franchise since Nigeria returned to civilian rule in 1999, yield more representative and legitimate institutions and restore faith in a democratic trajectory. Anything similar to the 2007 sham, however, could deepen the vulnerability of West Africa's largest country to conflict, further alienate citizens from the political elite and reinforce violent groups' narratives of bad governance and exclusion. Flawed polls, especially if politicians stoke ethnic or religious divides, may ignite already straining fault lines, as losers protest results. Despite encouraging electoral preparations, serious obstacles remain. Many politicians still seem determined to use violence, bribery or rigging to win the spoils of office. In the remaining weeks, national institutions, led by the Independent National Election Commission (INEC), should redouble efforts to secure the poll's integrity, tackle impunity for electoral crimes, increase transparency and bolster safeguards, including by publicising results polling station by polling station and rejecting bogus returns.
