31. Citizens in Training: Conscription and Nation-building in the United Arab Emirates

Abstract:
n 2014, the United Arab Emirates (UAE) embarked on a bold experiment: It began drafting young men into the military. This move was not only a departure for the Emirates, it was a departure from world trends. Governments have been moving away from national service requirements for decades as military missions have changed and governments have sought to create highly skilled all-volunteer armies. But the UAE move to press young men into military service was meant to build the country, not just the army. Several factors contributed to the decision to adopt conscription. One was a deeply unsettled regional environment. Another was a drive to promote a stronger sense of shared Emirati identity. A third was a growing fear that young Emirati men were becoming lazy and “soft” just as the government eyed an increasing imperative to shape its workforce for a world less centered on oil. A fourth consideration was the UAE’s resolve to blunt the forces that contributed to the Arab uprisings in 2011. Staring down all of these factors, the UAE leadership decided a bold intervention was needed. The leadership constructed a program combining intensive physical fitness training with military training, national education, and character education. It did not only reach 18 year-olds. Everyone 30 years of age and younger is required to register, pulling men from their jobs and families to live with their peers in barracks, perform predawn calisthenics, and clean toilets. Those lacking the fitness for military training—nearly one in five—are not exempted, but rather are trained for civilian roles in vital sectors. The UAE drew from careful studies of other national service programs around the world—especially in Finland, Singapore, and South Korea—and had indirect knowledge of Israel’s program. Compared to these countries, the UAE has made innovations in its approach to citizenship education, workforce development, and public health. Women can volunteer, but fewer than 850 have done so, compared to 50,000 male conscripts. Women are cast largely in a supportive role as relatives of conscripts.

Abstract:
Latin America (LA) over the past century has experienced a period of relative interstate peace, free from the bloody wars typically seen in other global regions, such as Europe (CENTENO, 2002; MARES, 2001). The region, however, is also the most violent and unsafe in the world. Los Cabos, Mexico, the deadliest city in the world in 2017, boasts about 111.33 deaths per every 100,000 residents (SEGURIDAD, JUSTICIA Y PAZ, 2018: 3), making many of the region’s urban areas resemble combat zones. This paradoxically results in LA having what some scholars term a “violent” or “hybrid” peace (BATTAGLIO, 2012; MARES, 2001). This article discusses and analyses the historical trajectory that contributed to this development, specifically analyzing post-Cold War security doctrine in the region through a racial lens. Using historical process-tracing and a review of previous academic literature, we describe how the constitution of national identities, as well as state articulations of “citizenship” and “crime,” has resulted in a specific way of viewing and treating afro-descend-ent people across LA. This process has also contributed to the current security crisis across the hemisphere.

Tough action and rhetoric are the stamp of U.S. President Donald Trump’s immigration policy. The decision in September 2017 to revoke the Deferred Action for Childhood Arrivals (DACA)—a program that shields young undocumented immigrants (“Dreamers”) from removal, granting them an opportunity to complete school, enroll in college, volunteer for the armed services, or join the workforce—proved to be the most contentious in a groundswell of executive orders, directives, memos, and wide-ranging enforcement efforts to curtail unauthorized presence.1 Critics describe such sweeping measures as amounting to an anti-immigrant crusade. Supporters, meanwhile, applaud them as taking the handcuffs off immigration enforcement officers and border patrol agents. With the rising tide of restrictionism and the government’s tough-on-immigration approach under the rubric of a “nation of laws,” it is easy to lose sight of the only immigration program that has been renewed and extended under the Trump administration: the EB-5 program, or the “golden visa.”2 The contrast between the DACA “Dreamers” and the EB-5 “Parachuters” reveals the sharp edge, and deep injustices, of current policies. In 2017 the president signed into law and renewed the extension of the EB-5 program, which offers the world’s wealthy a coveted path to securing lawful permanent residence (LPR) status, jumping the queue and gaining an easy pass through the otherwise increasingly bolted gates of admission. The price tag for securing a green card via the EB-5 program ranges from $1 million to a “discounted” rate of $500,000 if funds are for specially designated rural areas or areas of high unemployment.3 The American golden visa, like comparable schemes in other desirable destination countries, caters to the global 1 percent. It treats money transfers—in large quantities—as a currency for acquiring entry visas, residence permits, and, ultimately, citizenship itself. Unlike the Dreamers, who now face the risk of deportation from the only country they have ever known as home, these visa applicants have no prior “bona fide relationship with a person or entity in the United States.”4 Instead, they gain a privileged route to enter the United States and remain lawfully in the country based on their ability to transfer capital across borders. The contrast between the DACA “Dreamers” and the EB-5 “Parachuters” reveals the sharp edge, and deep injustices, of current policies. The former have already become part of the fabric of the United States—including its society and economy—through their ongoing, peaceful, and productive presence, yet the sword of deportation continues to hang over their heads. On the other hand, the latter benefit from expedited and simplified pathways to obtain full-fledged legal membership, even if they fail to establish any tangible connections to their new home country. The intrusion of market logic into the sovereign act of defining “who belongs” raises significant justice and equality concerns that require closer scrutiny. The United States is not alone in testing, blurring, and eroding the state-market boundary regulating access to membership. A growing number of countries are putting their visas and passports up for sale. The proliferation of these programs is one of the most significant developments in citizenship and immigration practice in the past few decades, yet it has received scant attention in the literature. In the following pages, I begin to address this lacuna by identifying the core legal and normative puzzles associated with this new trend, which I will refer to as the marketization of citizenship to highlight a dual transformation: the commodifying of access to membership and the hollowing out of the “status, rights, and identity” components of citizenship.5 Marketization is never merely an economic process; it is also deeply political, as it reshapes and reengineers the boundaries of and interactions between states and markets, voice and power, the inviolable and the mercantile. The intrusion of market logic into the sovereign act of defining “who belongs” raises significant justice and equality concerns that require closer scrutiny, both empirical and normative—the remit of this essay. I treat these new developments as a productive site to explore foundational questions about the character of citizenship and its transformation in today’s world. I begin by tracing the global surge in the marketization of citizenship, providing illustrative examples, before turning to explore the official rationales for the EB-5 and exposing their shortcomings. Moving from the positive to the normative, I develop several lines of critique that seek to show that this new trend is uniquely threatening to notions of citizenship reflecting the horizon of equality and participation, regardless of which theories of state and society—liberal, civic republican, or democratic—inform them.

The tragic years of World War II, followed by the unfriendly communist policy in Poland towards the Jewish community, changed the country from a multicultural into the most homogeneous state in the European Union nowadays. At the same time, Israel, as a meeting place for various cultures, enjoys the influence of inhabitants from nearly all over the world. The dissimilar experiences and problems faced by the governing bodies should influence different approaches to dual citizenship in Poland and Israel. In view of the above, in the presented work the author would like to analyze the issue of the legal approach to dual citizenship both in Poland and in Israel. The main goal of the paper, beyond comparison of the effectiveness of the legislations, is finding the answer to the question: what is the state’s attitude towards the issue of the dual citizenship of their citizens? The hypothesis that the article will verify states, that due to the small number of people with dual citizenship in Poland, Polish legislation devoted to this topic is not extensive and has dissimilarities to the law in Israel, which, in contrast, is more complex and better responds to the needs of society. The reason for comparing Poland and Israel is the fact that Polish citizenship has been very popular among the citizens of the Jewish state, especially since 2004 when Poland became a member of the European Union. This issue in the long run may be one of the key determi- nants of Polish-Israeli and Polish-Jewish relations.

36. The Diversity of Citizenship of Palestinians and its Impact on their Mobility: Passport and Visa Issues

Abstract:
This article explores the formal impact of various citizenships and travel docu- ments held by Palestinians on their freedom to engage in international travel. Based on a theoretical analysis of passports and the global visa regime, it claims that international recognition is not only pre-requisite of statehood but also affects the scope of mobility in cases of citizens of de facto states, including the Palestinian Authority. The research is fo- cused on the following themes: the status of the population holding a Palestinian Authority Passport in the West Bank and the Gaza Strip in comparison to Palestinians who are citizens of Israel and carry passports of this state, the exceptional situation of East Jerusalemites as well as the case of Palestinians with Jordanian passports. Visa availability and other formal barriers for international travel are also examined. The argumentation is supported by the analysis of visa restriction indexes referring to the Palestinian Authority and to Israel. The article concludes that the mobility of Palestinians varies to a large extent depending on trav- el documents held and the recognition of a citizenship and the passport that comes with it is strictly dependent of the recognition of state sovereignty. Although in some cases citizenship can be divorced from the international recognition, the scope of visa-free mobility related to passports is always impaired.

37. Redefining American Families: The Disparate Effects of IIRIRA’s Automatic Bars to Reentry and Sponsorship Requirements on Mixed-Citizenship Couples

With passage of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (IIRIRA), the goal of discouraging illegal immigration and the legal immigration of the poor triumphed over the longstanding goal of family unity in US immigration policy. This shift resulted in policy changes that prevent some mixed-citizenship families from accessing family reunification benefits for the immigrant relatives of US citizens. Two specific elements of IIRIRA — (1) the three- and 10-year bars to reentry, and (2) the minimum income thresholds for citizen sponsors of immigrants — have created a hierarchy of mixed-citizenship families, enabling some to access all the citizenship benefits of family preservation and reunification, while excluding other, similar families from those same benefits. This article details these two key policy changes imposed by IIRIRA and describes their impact on mixed-citizenship couples seeking family reunification benefits in the United States. Mixed-citizenship couples seeking family reunification benefits do not bear the negative impacts of these two policies evenly. Rather, these policies disproportionately limit specific subgroups of immigrants and citizens from accessing family reunification. Low-income, non-White (particularly Latino), and less-educated American families bear the overwhelming brunt of IIRIRA’s narrowing of family reunification benefits. As a result, these policy changes have altered the composition of American society and modified broader notions of American national identity and who truly “belongs.” Most of the disparate impact between mixed-citizenship couples created by the IIRIRA would be corrected by enacting minor policy changes to (1) allow the undocumented spouses of US citizens to adjust their legal status from within the United States, and (2) include the noncitizen spouse’s income earning potential toward satisfying minimum income requirements.

As European authorities watched thousands of aspiring jihadists leave their countries to fight in Iraq and Syria in 2012 and 2013, few laws were in place to prevent them from “taking a holiday in Istanbul,” a well-known euphemism for jihadists seeking to travel to Syria. Abstract:
Consular officers at posts abroad face a range of difficult duties including informing relatives of a death abroad, counseling and helping victims of crime (do NOT go into Moscow’s underground street crossings late at night), visiting citizens arrested and jailed, refusing visas and dealing with the angry losing parent in a child custody fight. Still, we get a generous share of delightful duties like issuing passports and certificates of birth abroad, issuing adoption visas that give a child a route out of an orphanage to a family in the United States and informing an individual of an unknown claim to American citizenship.

40. Brexit and the Challenge of Citizenship: British passports for EU citizens living in the UK?

The task of finding a solution to the legal status of non-British EU citizens living in the UK after Brexit is exercising the best minds in the European Union at the moment. As the European Council (Art. 50) guidelines for Brexit negotiations rightly underline, “The United Kingdom's decision to leave the Union creates significant uncertainties that have the potential to cause disruption,…Citizens who have built their lives on the basis of rights flowing from the British membership of the EU face the prospect of losing those rights”. These guidelines also place special emphasis on the priority to ensure reciprocal guarantees in safeguarding the rights derived from EU law of EU and UK citizens and their families affected by Brexit, effective from the date of withdrawal. The latest idea floating in the media is that the UK should naturalise the non-British EU nationals living there (possibly numbering 3 million) as British citizens. This solution has been commonly called “giving them all passports”, but for an individual to qualify for a passport, s/he must hold the nationality of the state of issuance. Is this a serious policy option? It is certainly original and has the benefit of shifting the burden of dealing with this question back onto the UK – enlarge your population and keep good relations with your neighbours. But there are at least four challenging questions that deserve careful consideration.
