131. The cost of cargo preference for international food aid programs

Abstract:
The federal government annually appropriates funds for food aid programs that the US Agency for International Development manages to benefit some of the neediest individuals in the world. This report analyzes how one interest group, the US maritime industry, has managed to obtain rents from the Title II food aid program through cargo preference requirements in the name of national security. We find that removing cargo preference requirements would allow for between $36 and $64 million of already appropriated funds to go to feeding the hungry and would benefit US soft power globally.

Abstract:
Pacific Forum, the Yokosuka Council on Asia Pacific Studies (YCAPS), and Tama University’s Center for Rule-making Strategies, with support from the US Embassy in Japan, organized a conference discussing maritime issues in the Indo-Pacific as they relate to the “Free and Open” concept. The event was hosted by the Center for Rule-making Strategies in Tokyo November 21-22, 2019. Approximately 35 senior officials, scholars, scientists, and security specialists attended in their personal capacity for an off-the-record discussion. The closed-door conference covered an array of maritime challenges including territorial conflicts, erosion of the rule of law, piracy and other criminal activities, unsustainable fishing practices, and environmental destruction. Synchronizing the efforts of uniquely qualified experts, this conference and its initiatives developed important messages for regional and global thinkers.

Abstract:
This paper explores the high seas as a critical space for the formulation and development of international human rights law in two inter-related areas: anti-piracy campaigns and rescue of the so-called “boat people.” While the high seas have been instrumental in promoting inter-state cooperation and coordination, I argue that they have also laid bare the limits of states’ nominal commitments to rights protection. Using historical case studies of the Vietnam crisis, Haiti arrivals to the United States, and the current marine policies of Australia, I show that states too often willfully neglect their human rights obligations. In doing so, these states might succeed in protecting their short-term interests, but undermine the foundations of international human rights regimes in the long run.

En las postrimerías del siglo XV surgió de la mano de los dos pueblos ibéricos atlánticos una revolucionaria aproximación al uso en beneficio propio del mar, caracterizada por tener que enfrentarse al reto de la navegación oceánica y de la exploración de nuevas tierras, algo jamás siquiera concebido con anterioridad. Como ya había ocurrido en otras etapas históricas con otros protagonistas, la principal motivación para lanzarse al mar fue económica. Sin embargo, la escala geográfica del empeño en esta ocasión dio lugar a una nueva era, caracterizada tanto por un acelerado desarrollo científico como por una globalización del comercio, de la política, de la tecnología y de la cultura (el lenguaje, la educación y el cristianismo). Portugal conquistó los océanos con el ánimo de establecer una red de enclaves comerciales, creando el molde de lo que desde entonces se ha considerado el lógico proceder de las potencias marítimas, empeñadas en moverse con libertad por los mares que unen las colonias con la metrópoli. De esa guisa, lo que desde hace apenas poco más de un siglo se denomina poder naval no era sino la parte del poder marítimo que se encargaba de proteger el comercio propio de la ambición ajena. España, sin embargo, acometió una epopeya similar con una mentalidad más territorial (y más patrimonial), debido a la cual los mismos océanos pasaron a ser considerados parte integrante de las posesiones monárquicas como vínculo que unía las distintas partes del reino. Esa asunción engendró un concepto nuevo de poder naval, por el que en tiempo de paz complementaba al poder marítimo, que se convertía en tributario del primero en caso de conflicto bélico. Lo que los tratadistas clásicos anglosajones (Alfred T. Mahan y Julian S. Corbett, en particular) describieron como poder marítimo y naval al estudiar la historia basándose en fuentes documentales británicas no es más que la trasposición de los principios que rigieron la constitución del Portugal renacentista en una talasocracia de ámbito planetario. El caso español es mucho más complejo, pues no solo fue igualmente ignorado en los estudios histórico-estratégicos tardo-decimonónicos y posteriores (no solo anglosajones, lo que es aún más inexplicable), sino que se mantiene en la bruma de lo inexplorado al no haber tenido continuidad histórica reconocida, lo que ha contribuido a impedir una comprensión adecuada de la dimensión histórica del éxito (por su resiliencia, durabilidad, prosperidad…) del “imperio” de la Monarquía Hispánica.

136. COVID-19: In Search of Solutions for Maritime Supply Chains

Abstract:
The outbreak of the COVID-19 pandemic has had a remarkable impact on maritime supply chains. Since its first case in the capital of China’s Hubei province, Wuhan, Chinese seaborne trading activities were greatly affected – reports of weakening manufacturing confidence, decreasing demand for non-essential goods worldwide, and reduced workforce has surfaced since the massive transmission of COVID-19 in January 2020. Many European and Asian countries, including the United States, have responded to the pandemic in March 2020 by imposing strict containment measures. The implementation of national lockdowns or movement restrictions in pandemic-affected countries has led to rapid contractions in maritime supply chains. The wide-ranging impacts of COVID-19 on manufacturing and trading demands have created the need for different importing speeds based on essentiality, thus deteriorating the maritime supply chains. Governments and relevant authorities, as well as private entities, should take initiatives to ensure that maritime supply chains remain fully functional for national and commercial interests as the COVID-19 pandemic progresses. It could be ideal to adopt digitalisation and blockchains as these digital processes are easy to access and control in optimising the efficiency of maritime supply chains amidst the unprecedented COVID-19 pandemic.

The COVID-19 pandemic exemplifies how human impacts on the natural ecosystems can result in a widespread environmental, social and economic consequences across the globe, including Malaysia. The need to enhance environmental and biodiversity protection is more apparent than ever. Year 2020 has in fact become a year of reflection and opportunity to improve our actions on safeguarding the coastal and marine environment, resources and biodiversity at large, as well as related sectors and industries. This brief piece examines some of the impacts and implications seen in addressing the pandemic, and the way forward.

Abstract:
The cascading effect of the novel coronavirus (Covid-19) that originated in Wuhan, China, is producing widespread reverberations around the globe and impacting almost every facet of life as we know it today. This article discusses the impact of Covid-19 on the geo-economics and maritime sector of Malaysia. A study by McKinsey states that the pandemic is expected to peak in the US and Europe in May 2020 and, as such, its full-fledged impact has not yet been felt. The pandemic has a corresponding effect on the global economy, which is expected to suffer major declines in consumption and production throughout the year. The global supply chain has been hard-hit with dire consequences for international trade and the shipping industry.

139. An easy target? Types of attack on oil tankers by state actors

There was a huge reaction to the attacks that took place in the Gulf of Oman in May and June 2019 but, in fact, attacks on oil tankers are a century old problem. Oil tankers appear to be easy targets because of their size and cargo. The main objective of this paper is to analyse the effectiveness of different types of attack on oil tankers that have been undertaken since widespread use of oil began. A comparative case-study approach was adopted to evaluate the effectiveness of different types of attack on oil tankers over the long-term, namely the last century. It briefly reviews the destructiveness of three anti-tanker campaigns during the two World Wars. They are subsequently compared with two post-1945 sets of attacks in the Persian Gulf region – the Tanker War of the 1980s and the 2019 attacks. The scale of damages inflicted by attacks on oil tankers is varied. The experience of both World Wars shows their effectiveness. However, post-1945 events do not provide confirmatory evidence. The main difference is the scale of hostile activities. It is not the characteristics of tankers that make them easy targets but political conditions (war/peace state of international system) that enable the application of weapons and tactics that bring about a different scale of destruction.

140. Components of defence strategies in society’s information environment: a case study based on the grounded theory

Abstract:
The goal of this study is to explore the components of defence strategies faced by society in its information environment, and how these strategies are inter-related. This qualitative in-depth case study applied past research and empirical evidence to identify the components of defence strategies in a society’s information environment. The data collected was analysed using the Grounded Theory approach and a conceptual framework with the components of defence strategies and the relationships between these components was developed using the Grounded Theory. This study shows that the goal of politically and militarily hostile actors is to weaken society’s information environment, and that their operations are coordinated and carried out over a long time period. The data validates past studies and reveals relationships between the components of defence strategies. These relationships increase confidence in the validity of these components and their relationships, and expand the emerging theory. First, the data and findings showed 16 inter-connected components of defence strategies. Second, they showed that the political, military, societal, power, and personal goals of the hostile actors carrying out cyber operations and cyber attacks are to weaken society’s information environment. Third, they revealed that cyber operations and cyber attacks against networks, information and infrastructures are coordinated operations, carried out over a long time period. Finally, it was revealed that the actors defending society’s information environment must rapidly change their own components of defence strategies and use the newest tools and methods for these components in networks, infrastructures and social media.
