Abstract:
Históricamente, la Unión Europea ha constituido un gran apoyo para la Corte Penal Internacional (CPI), tanto en su nacimiento, como en la integridad de su instrumento constitutivo (el Estatuto de Roma), así como en el desarrollo de sus funciones. Sin embargo, la agresión de la Federación Rusa a Ucrania ha propiciado el cumplimiento de un nuevo papel de la Unión Europea en su relación con la CPI y en la lucha contra la impunidad de los crímenes internacionales más graves cometidos en dicho conflicto. En este sentido, está siendo decisiva la actuación de Eurojust como centro de armonización de los esfuerzos investigadores en relación con los crímenes cometidos en Ucrania. Igualmente, la puesta en marcha de otros mecanismos novedosos por parte de la Unión Europea revela la consolidación de un rol inédito de la UE en la lucha contra la impunidad.

Abstract:
The United States Holocaust Memorial Museum's Simon-Skjodt Center for the Prevention of Genocide published a report in February 2022 detailing the immediate risk of mass atrocities facing South Sudanese civilians.1 Since then, threats facing South Sudanese civilians have worsened and the government of South Sudan has failed to take action to mitigate these threats.2 Attacks against civilians have continued, leading thousands of people to be killed, injured, or displaced. Experts told Simon-Skjodt Center staff that they feared the world's youngest country would slip back into full scale war. This stems from both the highly complex conflict dynamics throughout the country with different geographic regions experiencing unique forms of violence from distinct perpetrators as well as the South Sudanese government's recent decision to delay for two years the deadline for implementing the peace agreement and for conducting national elections. Their actions suggest that those most responsible for past abuses may intend to cling to power and evade justice for their actions. The need to take decisive preventative and protective action is urgent.

The most recent conflict in Ethiopia has claimed thousands of lives and perpetrators have enjoyed almost complete impunity for their crimes. Abstract:
South Sudanese civilians face a risk of mass atrocities from government forces, armed militia, and opposition groups as political instability at the national level increases. Impunity has fostered a culture in which the commission of mass atrocity crimes is normalized. In the leadup to the 2023 elections, President Salva Kiir could lead violent crackdowns on organized gatherings in an effort to silence opposition. If government and opposition forces continue to unify into a single army, infighting could spill over into violence against and among civilian groups.

Abstract:
The purpose of this article is to review the works of several academics specialized in the matter of security, which the authors will use as an analytical setting and revision their outcomes to define and understand the concept of state capture. Once the concept of state capture is defined, then the case of Mexico will be analysed. This article intends to discuss several indicators regarding state capture such as the rule of law, how political violence has also influenced the issues of corruption, impunity, and mentions how money laundering prevention serves as a tool for tackling corruption. In order to grasp an understanding what state capture is, we must first develop conceptualizations of corruption, impunity and its classifications, the rule of law, and the state apparatus. This article intends to analyse the implications that all of the above might have with regards to a state captured democracy, from an academic approach.

Abstract:
Among the various ad hoc international criminal tribunals that have been established since the end of the twentieth century, the Special Tribunal for Lebanon stands out for its singularity, both at the jurisdictional level and for its contribution to the treatment of victims. The work of the Special Tribunal for Lebanon began in 2009, delivering its first sentence on 18 August 2020. Through its constitution, the United Nations Security Council sought not to abandon the path initiated in 1993 with the creation of the Yugoslavia and Rwanda tribunals; however, the result has not been as expected. This article aims to analyze the peculiarities of the Tribunal and its work, making a critical analysis of it, considering it as a lost opportunity for the reconstruction process in Lebanon./Entre los diversos tribunales penales internacionales ad hoc que se han creado desde finales del siglo XX, el Tribunal Especial para el Líbano destaca por su particularidad, tanto a nivel jurisdiccional como por su contribución al tratamiento de las víctimas. La labor del Tribunal Especial para el Líbano comenzó en 2009, dictando su primera sentencia de instancia el 18 de agosto de 2020. Mediante su constitución, el Consejo de Seguridad de Naciones Unidas apostó por no abandonar el camino iniciado en 1993 con la creación de los tribunales de Yugoslavia y Ruanda; sin embargo, el resultado no ha sido el esperado. Este trabajo pretende analizar las peculiaridades del Tribunal y su trabajo, realizando un análisis crítico del mismo como oportunidad perdida para el proceso de reconstrucción del Líbano.

Abstract:
European governments have failed to prevent corrupt actors from laundering hundreds of billions of dollars through the international financial system and their own economies. This breakdown in the rule of law empowers kleptocratic regimes across the globe, which capitalise on the political culture underpinning Europe’s approach to globalisation. Western governments create a negative feedback loop that hinders their foreign policy initiatives when they treat corruption in other countries as an inherent part of the local culture. European policymakers should aim to catch up with, and overtake, their US counterparts on anti-money laundering regulation and enforcement. European countries should create national institutions – and an international coalition of Western states – that are dedicated to countering kleptocrats.
