371. Bankruptcy Proceedings for Sovereign State Insolvency and their Effect on Capital Flows

Abstract:
The paper examines the main issues involved in translating domestic bankruptcy procedures to the sovereign context. It considers some of the principles by which domestic bankruptcy procedures operate, and the extent to which they apply to international lending. Two recent proposals are considered in more detail, that of Krueger ('A New Approach to Sovereign Debt Restructuring') and that of Pettifor ('Resolving International Debt Crises - The Jubilee Framework for International Insolvency). The paper also considers the question of the ex ante effects of a procedure which makes default less costly, and concludes that despite a negative impact on the ability to borrow, the overall welfare effect need not be negative.

Abstract:
Recent state elections in Jammu and Kashmir, and the loss of power by the National Conference party that has dominated politics there since independence, have created a spark of hope that political tensions in the Kashmir Valley could de-escalate. It was a badly flawed election in 1987 that helped fuel a long running militant insurrection and general uprising, and tens of thousands have died in subsequent violence. Violence has been further amplified by historical strategic tensions between India and Pakistan over Jammu and Kashmir, and Kashmiri hopes for a political voice have often unfortunately become caught up in this broader international rivalry.

The struggle over land and natural resource rights is a key aspect of the conflict in Papua, formerly known as Irian Jaya, that pits the Indonesian state against an independence movement supported by most of the indigenous population. It is thought to have cost many thousands of lives since the 1960s, mostly Papuan civilians killed by the security forces. Among the most recent victims were three employees of the giant mining company, PT Freeport Indonesia, killed in a well-planned attack on 31 August 2002.

374. Indonesia: The Implications of the Timor Trials

As East Timor moves toward independence on 20 May 2002, trials are proceeding in Jakarta against Indonesian army and police officers and civilian officials accused of serious human rights violations in connection with the 1999 violence there. Within Indonesia, the trials have generated little interest, nothing approaching the attention given to the prosecution of Tommy Soeharto, the former president's son. Abroad, the delays in getting the trials underway, the high-ranking position of some defendants, the inexperience of the judges in trying human rights crimes, and the government's pointed lack of interest in addressing military impunity have raised doubts that any of the accused will be convicted.

Abstract:
This essay is about the pivotal role cities play in the current pattern of social, cultural, and political change in East Asia. Its starting premise is that the postwar era of nation state building and state-led change is ending and a different era—one that centers on global capitalism and new technological capacities—has been steadily emerging in the region over the last several decades. At the vortex of these new forces we find big, successful cities. In such cities, the forces of capitalism, cultural cosmopolitanism, and new technologies combine critically in a turbulent and heady new mix. As a result, while the effectiveness of state initiatives decreases, and government is under pressure to reform, privatize, and decentralize, the dynamic (and typically coastal) cities of East Asia are the center of powerful economic and cultural forces for change, and the source of alternative political agendas. Simultaneously, due to their rapid expansion, these cities have also become the locus of giant new problems for public management.

376. Wars and the Un-making of States: Taking Tilly Seriously in the Contemporary World

Abstract:
That war makes states has become part of international relations (and political science) folklore. There are good reasons for this. The idea can be evoked with reference to venerable classical masters of our trade, including Weber, Hintze and Elias, or more recent ones such as Finer or Tilly. Moreover, the argument dovetails beautifully with the anti-liberalism underlying much realist thinking in international relations. It stresses the violent foundations of power and states as opposed to liberal stress on the role of power growing out of legitimacy and common action. And finally, the argument is useful from two perspectives. Analytically, it enables observers to make positive sense of the messy reality of war in large parts of the world: it is just an inevitable step on the way to state formation (Cohen, Brown et al. 1981). And politically it provides a welcome excuse for not getting too closely involved with that messy reality. If wars make states, well then the best thing is to allow them to be fought out (Herbst 1996-7).

It is widely believed that the Internet poses an insurmountable threat to authoritarian rule. But political science scholarship has provided little support for this conventional wisdom, and a number of case studies from around the world show that authoritarian regimes are finding ways to control and counter the political impact of Internet use. While the long-term political impact of the Internet remains an open question, we argue that these strategies for control may continue to be viable in the short to medium term.

Ten months after the fall of Slobodan Miloöević , considerable progress has been made in establishing democratic governance in the Federal Republic of Yugoslavia (FRY) and reintegrating the country into the international community. Yet the future of the federation itself remains in doubt. The FRY is a hollow edifice whose institutions hardly function except as an address for the international community. Montenegroís authorities no longer recognise the legitimacy of the federal government. All sides agree that the status quo is unsustainable and that Montenegro and Serbia must find a new basis for their relationship.

International relief at the fall of the regime of Slobodan Miloević has been marred by dismay at the prospect of a breakaway from the Federal Republic of Yugoslavia (FRY) by Montenegro. As long as Milo.ević was in power, the international community supported Montenegro.s moves to distance itself from Belgrade. With Milo.ević gone, it was widely expected that Belgrade and Podgorica could patched up their relationship, and find a satisfactory accommodation within the framework of the FRY. Montenegrin President Milo Djukanović.s decision to opt instead for independence has caused international consternation.

Molly is a physician in her forties who lives in suburban Boston: thoughtful, soft-spoken, and extremely articulate—reason enough to take careful note of what she has to say about the formative experiences which led to her current commitments as a Jew. There is another reason as well: because the key words in this passage from our conversation, "I remember," are repeated no less than three times. What Molly and the other Jews we interviewed remember of their Jewish journeys, and—more importantly— how they remember it, provide the clues to a new sort of Jewish self emerging in the United States in recent decades.
