1372. Bush's Dysfunctional Cuba Policy

The Bush administration's Cuba policy has reached a dead end, with no hope of success. Its objective is nothing less than to bring down the Castro regime. Or, as then-Assistant Secretary of State Roger Noriega put it on October 2, 2003: "The President is determined to see the end of the Castro regime and the dismantling of the apparatus that has kept him in office for so long." President George W. Bush then appointed a Commission for Assistance to a Free Cuba with the goals of bringing about "an expeditious end of the dictatorship," and developing a plan to achieve that goal. In May 2004, the Commission came out with a near-500- page plan whose basic premise was that the Castro regime was near collapse and that another shove or two would bring it down--a few more Radio Marti broadcasts, a few more travel restrictions, another economic sanction or two and it would all be over. The plan also read like a blueprint for an American occupation that would make the trains run on time, show the Cubans how to run their school systems and grow their crops--so much so that it offended many Cubans who read it, even those who didn't necessarily agree with the Castro government. To correct that, the new--and shorter--report issued by Secretary of State Condoleezza Rice, Commerce Secretary Carlos Gutierrez and Transition Coordinator Caleb McCarry, on July 10 this year stressed that its purpose was simply to assist Cubans on the island. Solutions must come from them, it insisted, adding that the U.S. stood ready and willing to support those initiatives. But having said that, the report went on with page after page of recommended actions--always provided that Cubans on the island wished to initiate them.

Abstract:
Will unbearable regulatory costs ruin the US economy? This specter haunts official Washington, just as fears of communism once did. Once again, the prevailing rhetoric suggests, an implacable enemy of free enterprise puts our prosperity at risk. Like anti-communism in its heyday, anti-command-and-control-ism serves to narrow debate, promoting the unregulated laissez-faire economy as the sole acceptable goal and standard for public policy. Fears of the purported costs of regulation have been used to justify a sweeping reorganization of regulatory practice, in which the Office of Management and Budget (OMB) is empowered to, and often enough does, reject regulations from other agencies on the basis of intricate, conjectural, economic calculations.

Abstract:
The contemporary age appears beset and driven by moral and political disputes, disagreements, fundamental misunderstandings, and mutual incomprehension. Secularists and religious believers systematically argue past one another. Doctrinal differences across and within religious communities persist despite, in many cases, centuries of dialogue and debate. Many of these disputes are neither trivial nor banal, but go to the heart of some of the most enduring and fundamental political questions and concerns. Foremost among them is the question: how can we co-exist in a peaceful and harmonious manner that does not entail a wholesale renunciation of those constitutive beliefs and practices that make us who we are? How can we be and let be? The search for a sufficiently robust common ground is increasingly urgent and appears increasingly difficult to achieve at regional, national, and international levels. Some readers might balk at this particular characterization of the world “out there,” for some, a solution may appear readily at hand, requiring only sufficient political will and courage to be realized. On this view, the moral and legal doctrine of human rights provides the normative cement capable of overcoming conflict and holding the world together. For many advocates of human rights the doctrine and its core principles are neither partial nor contingent. Human rights, it is argued, address a global community of morally equal individuals. The right to life and the right to be free from torture are absolute and immutable. Simplifying a very complicated series of philosophical arguments, no rational individual, however powerful, is considered rationally capable of rejecting the universal application of such core principles. The doctrine of human rights is a necessary and sufficient means for resolving the phenomenon of moral and political conflict and offers a sustainable answer to the question of how we might live together despite our deep differences.

In the early 1970s, legal scholars began reexamining the dominant legal paradigms within Western polities with a skeptical view of their underlying doctrines and arguments. While the critique was radical in the context of its time, the critical legal movement itself, both inside and outside academia, has largely become somewhat passé as its valid insights have either been absorbed into mainstream juridical scholarship or largely superseded by newer fields of legal inquiry that it had nurtured, including feminist jurisprudence, critical race theory, and postmodern scholarship.

Abstract:
In recent years, the dynamics of justifying and legitimizing the policies and practice of international intervention has attracted the attention of mainstream media and has also cut across the subdivisions of the Liberal Arts college. Thus, by jumping on the bandwagon of this “trendy” topic both journalists and scholars have attempted to understand as well as explain the phenomenon of intervention (Chandler 2002; Fortna 2004; Lyons and Mastaduno 1995; Smith 1998). Yet, as I claim in this essay, owing to the limelight attracted by this topic in recent years, only few commentators have managed to elucidate the underlying dynamics of the exercise and process of international intervention. If anything, this attention to international intervention has tended to produce numerous (often polarized) opinions, yet little clarity on the issue.

1379. The Radical Libertarian Political Economy of 19th Century Preacher David Lipscomb

Abstract:
David Lipscomb (1831-1917) was an influential Tennessee preacher who edited a weekly paper from 1866-1917 and published a book Civil Government in 1889. Although few, if any, economists appear to be aware of David Lipscomb, Lipscomb's writing includes many points that political economists, especially radical libertarian ones, are making today. This article highlights some of Lipscomb's insights and relates them to arguments made by economists in the past three decades. Lipscomb argued that government is not created for the benefit of the public but for the benefit of the rulers. He believed that all governments, including democratic ones, are problematic. He argued that self-serving politicians actually create conflict and violence and that the public should withdraw support from government. He argued that moral people should not participate in politics, should not vote, and should not fight in wars. Modern libertarian economists make similar arguments that Lipscomb made more than a century in advance.

Abstract:
One of the most striking features of the political arrangements on this planet is the fact that it is divided in to sovereign states. The earth is carved into territories ruled by governments whose accountability to those who do not live there continues to be rather limited. This is striking because life chances depend significantly on the state into which one happens to be born. To be sure, in recent times, globalization has woven together, in highly complex systems, the fates of communities, households, and individuals in distant parts of the world; it is partly for this reason that hardly anybody now champions a notion of sovereignty that insulates a state from extern al criticism, or limits liability for how that state's actions affect foreign nationals. Nevertheless, state sovereignty persists as a political fact. The number of independent states has increased enormously through the major political upheavals of the 20 th century, and it is not clear that there is anything wrong in principle with states – or so, at any rate, we will assume in this study.
