971. Designing Cabinets: Presidential Politics and Cabinet Instability in Latin America

Abstract:
This paper proposes and tests a theory about the strategic use of cabinet appointments by executives in presidential systems. The theory argues that cabinet turnover plays a crucial role in bargaining between the legislature and the executive over policy. In the context of fixed terms, the power to change the cabinet allows presidents to face unexpected shocks and use cabinet rotation to adjust their governments to new political and policy environments. This resource is even more important when presidents' formal authority is weaker and when their political support and popularity decrease. I use data on cabinet changes in twelve Latin American countries between 1982 and 2003 to test the main arguments of the theory.

Abstract:
When the Democratic Party of Japan (DPJ) kicked the Liberal Democratic Party (LDP) out of power in 2009, there was some sense of hope amongst the Japanese that things would change. If nothing else, the Japanese hoped that the DPJ would bring new ideas to tackle some of the country's ongoing problems. Reality soon proved otherwise. Not only has the DPJ quietly abandoned many of its campaign pledges, it has proved just as incapable at resolving ongoing problems. Seventeen months into a DPJ-led Japan, Prime Minister Naoto Kan faces a number of domestic problems that threaten his government's survival. The unfortunate result is another expected turn of the revolving door that is the Japanese premiership.

Abstract:
Security sector governance (SSG) poses a huge challenge to states transitioning to democracy, particularly in cases where the military and other components of the security sector had been very influential in the conduct of government affairs. SSG is even more of a challenge in conflict-ridden societies where the state's capacity to ensure internal security has been undermined. Democratic norms suggest that effective SSG involves not only the management of core security forces, but also competent civilian oversight. In addition, SSG programmes in Southeast Asia will have to recognise and address the specific realities and experiences of a particular country. This policy brief is based on the proceedings of the Second Study Group Meeting on 'Security Sector Governance and Conflict Management in Southeast Asia' organised by the Institute for Strategic and Development Studies, Inc. (ISDS, Philippines) in collaboration with the RSIS Centre for Non-Traditional Security (NTS) Studies on 11 February 2011.

The concept of global governance epitomizes transformations in the structure of political organization and highlights changes in the ways in which public authority is exercised. Times of change invite scholars to contemplate the plausibility of orthodox beliefs and doctrinal concepts. They push them towards innovation and there is indeed a strong sense among international lawyers that the terms of debate about the legitimacy of international law are shifting. A number of contributions over the past years have tried to respond to the challenges which phenomena of global governance pose to international legal scholarship. 1 The mounting wealth of literature now comes to speak in Steven Wheatley's book on The Democratic Legitimacy of International Law in which he calls on the legal profession to engage with questions of first principle, to reflect on the nature of international law, and to consider in closer detail the justification of legal constraints beyond the state. The book's main argument is at the outset rather straightforward. Wheatley observes a proliferation of sites of norm production and argues that the delegation of authority to international or transnational actors inevitably involves a loss for democracy. To remedy this deficit, he suggests restating requirements for democratic legitimacy in terms of the deliberative ideal as it is developed in the work of Jürgen Habermas. The book claims the use of Habermas' thought as its innovative edge, and develops its core argument accordingly. '[T]he legitimate exercise of public authority through law', it claims, 'is conditioned by respect for the cardinal principles of deliberative democracy: equality and public reason' (at 2). Aida Torres Pérez' Conflicts of Rights in the European Union. A Theory of Supranational Adjudication 1 is a comprehensive monograph dealing with one of the most striking normative challenges in the European Union (EU): the relationship between the European Court of Justice (ECJ) and Member State courts in adjudicating fundamental rights. Torres Pérez presents the existing spheres of fundamental rights protection in the EU and provides a thorough analysis of the conflicts that emerge where these different spheres overlap. Her volume covers a number of different approaches and provides suggestions on how to deal with these conflicts and eventually proposes a normative model for ECJ adjudication through judicial dialogue based on comparative constitutional reasoning. The book is well structured in three parts. The first part gives a brief but thorough overview of the different systems of fundamental rights protection open to EU citizens. The author describes these different systems as the multilevel protection of rights in Europe and distinguishes between human rights protection through national constitutions (constitutional rights), through the ECJ (EU fundamental rights) and through the European Convention on Human Rights (convention rights). She outlines the conflicts that arise when these different systems of fundamental rights protection overlap. In general, such conflicts may arise when different rights are considered to be fundamental (at 10) and where community members disagree regarding fundamental rights interpretation (at 11), especially concerning sensitive issues like abortion or affirmative action (at 16). A potential for conflict exists whenever states act within a field of application of EU law which includes two types of situations: (i) state acts implementing EU law, and (ii) state acts derogating from the EU basic freedoms of movement (at 16). Abstract:
One year after the failure of the Copenhagen Climate Summit, the next conference of the parties to the UN Framework Convention on Climate Change and the Kyoto Protocol in December 2010 adopted the so-called Cancun Agreements. Thereby, the Cancun conference succeeded in keeping the UN climate process alive and averting serious damage to multilateralism more broadly. However, the Cancun Agreements fall seriously short of providing for effective action on climate change. The current weakness of the international framework reinforces the rationale for strengthening domestic EU climate policies. It also requires a further rethinking of the EU\'s international leadership strategy.

Abstract:
Despite the growth of lobbying in the EU over the past two decades, the EU has taken a rather laissezfaire approach to regulating lobbying activity. While the European Parliament (EP) is in many ways more transparent and more accessible than many of the EU's national parliaments, the code of conduct for lobbyists and the Parliament's own rules of procedure are rather vague. As a result of the 'cash for laws' scandal, the EP President, Jerzy Buzek, has established a working group to draw up a new set of rules to govern the access and behaviour of lobbyists and to formulate a code of conduct for Members of the European Parliament (MEPs). The working group is currently considering seven proposals put forward by Jerzy Buzek, including a mandatory lobbying register for all EU institutions; a strengthening of MEPs' declarations of financial interests, with more frequent updates; a code of conduct for MEPs; a 'legislative footprint' for rapporteurs and tougher sanctions for non-compliance with these rules. While the reform proposal, as it stands now, offers a significant improvement of the Parliament's current rules, it does not go far enough, however.

In recent weeks pressures on the euro and eurozone sovereign debtors have subsided. Buoyant growth in the global economy, increasingly benefiting also the European economy, has of course played an important role in calming financial markets. But even more important has been the perception that France and Germany are again working constructively for a strong economic Europe. More broadly, the acute turbulence in financial markets since the spring of 2010 may have finally convinced our political leaders, notably including the German political establishment, that the benefits of a stable currency far outweigh the costs that may have to be borne to make it work properly. The euro will only be trusted if the member states effectively coordinate their economic policies not only to ensure fiscal stability, but also to eliminate persistent divergences in productivity leading to unsustainable imbalances between national savings and investment (Schäuble, 2011).

On 1 January 2011, Hungary, the third member of the European Union to join the club in 2004, took over the presidency of the Council of the European Union. This represents the first presidency of a newer member state under Lisbon Treaty rules. After the new treaty entered into force on 1 December 2009, all rotating presidencies are, in a sense, first time presidencies. Their relative success now depends more on administrative ability than political leadership.
