301. An Assessment of Institutional and Legal Factors in Relation to Failure of Urban Regeneration

Abstract:
Large scale urban renewal projects, or ‘urban regeneration’ projects as commonly known in Turkey, are one of the most important political tools for the transition of cities from industry into service-heavy economic structures. Since 1970s regeneration projects have triggered substantial changes in urban economic geographies and caused extensive demographic shifts in the idle industrial, coastal and low socioeconomic residential areas of cities in late-capitalist countries. Yet, in Turkey they have started being implemented much later, with the first comprehensive regeneration policy devised in 2005 when the Justice and Development Party (AKP) came to power. Until 2000’s there existed significant financial and legal barriers to urban renewal. Struggling with budget deficits and high interest rates throughout the 90s, the state was not financially capable of urban renewal, which requires significant resources. On the other hand, Turkey’s local governance policies and financing did not allow municipalities to implement such projects by themselves. Finally, private sector actors (real estate investment trusts, major contractors, finance companies) lacked either any interest or the resources for urban renewal projects in the pre-2002 period characterised by high interest rates and inflation. When all these factors combined, despite serious need for regeneration and renewal in Turkey’s cities, unfortunately regeneration projects almost never came to life.

Abstract:
We are getting in the mood of the March 2019 local elections just as the general election has ended, and it looks as if the boat will be pushed out once again. Really, we do have a budget, right? At present, it remains an uncertainty how the central budget, our shared pool of resources, will be managed. Yet, we shall see how changes in the relations between the actors responsible for the tools, if not in the tools themselves, are reflected in practice. Hoping that they are at least transparent, we will examine budget transparency for democratic governance mainly through the lens of local government.

303. Developing Child-Sensitive Strategies in Local Government

Abstract:
This policy brief is published in the framework of “Inclusive Local Governance for Sustainable City” project under the umbrella project “Supporting Sustainable Cities” of TESEV funded by the Friedrich Naumann Foundation for Liberty. Actors of various sizes all participate in local programmes, plans and actions on the path towards achieving Sustainable Development Goals. International and regional cooperation are necessary for attaining these goals, for which central government may prove more crucial in its effects, while the inclusion of local actors is imperative for following both a more efficient path and achieving democratic participation. It is thus timely to highlight the importance of local participation in identifying and implementing the 11th Sustainable Development Goal, Sustainable City and Human Settlements. This goal, in which the issues of the right to the city under inclusion(1) the creation of accessible and safe urban spaces for all, and the active and direct participation of civil society come to the forefront, necessitates the active participation of metropolitan municipalities of local governments, as well as district municipalities which are in most contact on many issues with the city’s residents.

304. Services For Children and Family In Istanbul District Municipalities

Abstract:
The project titled “Analyzing and Mapping Services for Children and Family in Istanbul District Municipalities” aims to produce a comprehensive inventory of social services for children and family provided by district municipalities and to develop policy proposals for improving the geographic distribution and qualities of these services within a framework of the socio-economic differentiation of Istanbul districts. This Bernard van Leer Foundation supported project has been carried out by the Turkish Economic and Social Studies Foundation (TESEV). There has been collaboration with the Kadir Has University Istanbul Studies Center and the Union of Marmara Municipalities at various stages of the project. This report summarizes the stages of the studies carried out within the scope of the project and discusses the importance and use areas of the interactive website, which is an output of the project, from the perspective of both the municipalities and of other users. After the presentation of the findings and recommendations, the “Stratification of Neighborhoods with respect to Age and Mean Real Estate Values” maps and the “Municipality Services for Children and Family” data acquired through the project will be presented separately for each district.

305. Cooperation in a Post-Western World: Challenges and future prospects

Abstract:
The post-Cold War world has been characterised by global cooperation, largely driven by Western actors and based on the norms of Western liberalism. Today, global power shifts are accelerating. The Western liberal order finds itself in deep crisis. Its previous anchor, the United States (US), is no longer willing or able to run the system. Its most important former ally, the European Union (EU), is struggling with inte- gration fatigue. New nationalist movements in many Western countries are proliferating. In other parts of the world, too, people fear the impact of globalisa- tion and are seeking to regain national autonomy. What does this mean for the future of global cooper- ation? How can the wish for more national autonomy be reconciled with the need to cooperate in the face of unsustainable development, global inequality, conflict and gross violations of human rights? How do changing power constellations affect global cooper- ation? We suggest that new forms of governance will contribute to sustaining global cooperation. This paper uses the example of the Paris Agreement to illus- trate new forms of polycentric and multi-stakeholder transnational governance that are bottom-up rather than top-down. Moreover, constructive coalitions of the willing and more flexibility in global governance provisions might also be key for successful future cooperation.

Abstract:
Civil war in Syria started in 2011 provide an important and rich area of investi- gation into the study of civil war. The present study is intended to concentrate on the cause of Syrian civil war. The main focus of the paper is on the investigation of why and how civil war in Syria was triggered. Despite the various ways in which Syrian civil war can be addressed, the paper benefited from good/ poor governance theoretical framework to investigate the cause of the civil war. The findings support the theoretical argument that poor governance has led to civil war in Syria. Governance indicators show lack of free and fair elections, low level of rule of law, high level of corruption, lack of voice and accountability, exclusion of different interest groups, inequity and government ineffectiveness in Syria which have been resulted in lasting civil war.

307. Abuse of State Resources Research and Assessment Framework

Abstract:
The International Foundation for Electoral Systems (IFES) recently concluded a two-year Technical Leadership project examining the abuse of state resources (ASR) in election campaigns. This research initiative, led by the Center for Applied Research and Learning and funded by the United States Agency for International Development under the Global Elections and Political Transitions mechanism, focused on ASR (sometimes referred to as administrative resources) for the purpose of gaining an electoral advantage. The Abuse of State Resources Research and Assessment Framework: Guidelines for the Democracy and Governance Community of Practice is an abbreviated companion document to the complete Abuse of State Resources Research and Assessment Framework developed in this effort. Both documents are based on in-depth, comparative analysis of laws and regulations that target ASR in election campaigns and the effectiveness of these provisions in deterring or remedying these abuses. In many countries, uses of state resources during electoral periods are not sufficiently regulated and enforcement of violations is weak or nonexistent due to deficits of political will or limited capacity of oversight institutions. As highlighted in an IFES publication, individuals and parties in power may capitalize on these gaps to marshal public goods – including state personnel, state funds and physical assets, and official government communications – in service of political campaigns. Beyond undermining electoral competitiveness, another often-overlooked component of this abuse of power is the role elections play in cycles of entrenched corruption. Not only do abuses during the campaign period undermine competitiveness by conferring an unfair electoral advantage, they threaten the appropriate distribution of government services and do long-term damage to the legitimacy of governance institutions. This is because abuses do not stop after parties use the assistance of the state apparatus to win elections; corrupt politicians subsequently use their access to levers of the state to enrich themselves and distribute perks to supporters. The cycle of government personnel, media, and other resources being used in service of political campaigns is then likely to continue. This ASR assessment tool focuses on legal and regulatory provisions specific to ASR, but it also delves into some other common areas of abuse (for example, government procurement and contracting, public works spending around elections, campaign finance, and vote buying). These guidelines were designed for use by international and domestic civil society actors, implementers, and advocates to evaluate the effectiveness of the ASR legal framework in a given country and develop additional tools for monitoring and advocacy. This shorter version of the tool will help these groups identify priority issues and vulnerabilities that they can use in developing their strategy for monitoring, addressing, and/or advocating for measures to mitigate ASR. Findings could also point to specific recommendations for improving transparency and enforcement surrounding ASR, including enhanced training programs, strengthened regulatory provisions, investments in investigative journalism, and increased transparency in public procurement.

308. China’s 40 Years of Fiscal and Tax Reform: A Basic Trajectory

Abstract:
The present paper describes the trajectory of China’s fiscal and tax reform in thepast 40 years, which can be summarized in five phases. The reform commenced with“decentralizing power and transferring benefits.” Then, under great fiscal pressure,institutional reform was instigated, which aimed to establish a new fiscal and tax system.To regulate the government revenue and expenditure beyond the fiscal and tax system,reforms were put in place to build an institutional framework for public finance. As thefiscal and tax reform had gradually entered the more sophisticated phases, China took aseries of measures to further improve the public finance system. Since 2012, based on theoverall plan of comprehensively deepening reform, China has embarked on establishinga modern public finance system. The present paper characterizes China’s fiscal and taxreform as gradually moving toward a system that aligns with the overall reform andcomplements the goal of marketization and modernization of state governance.

309. In the eye of the storm? (In)stability in Western Iraqi Kurdistan

Abstract:
Iraqi Kurdistan has done well for itself in recent decades by carving out a largely autonomous region free of most governance and security interference from Baghdad. The alliance of convenience between the two pre-eminent Kurdish parties (PUK and KDP) effectively seized a number of opportunities to consolidate and expand Iraqi Kurdistan, such as the international no-fly zone (1991), the US intervention (2003), the crafting of a new constitution for Iraq (2005) and, arguably, even the rise of the Islamic State (IS) (2014). Yet, the Kurdistan Region of Iraq (KRI) also faces a triple crisis. Politically, this includes the exclusive and increasingly repressive rule of the KDP and PUK in a context of mediocre governance, as well as strained relations between Erbil and Baghdad over the disputed territories. Economically, it includes a general downturn combined with serious financial disputes with Baghdad. Socially, it includes deteriorating popular satisfaction with the quality of rule and life in Kurdistan. In this report Erwin van Veen and al-Hamzeh al-Shadeedi analyse four factors that could drive future (in)stability in western Iraqi Kurdistan: 1) geopolitical tensions; 2) further clashes over the disputed territories; 3) growing dissatisfaction with the KDP and 4) protracted displacement. On balance, it does not consider the risk of immediate crisis or violence as being very high, but the report does note that many elements are in place that could easily trigger violent incidents with the potential of escalation. For each factor, the report proposes restraining factors, developments to monitor and trigger events. While international influence on the domestic politics of Iraqi Kurdistan is limited, coupling an offer of international (UN) mediation to facilitate resolution of the disputed territories with the development, or strengthening, of a dedicated fund that can rapidly initiate the reconstruction of the Greater Mosul area (including some of the disputed territories) would be a valuable intervention to further the peaceful development of Iraqi Kurdistan.

310. Under the gun: Resource conflicts and embattled traditional authorities in Central Mali

Abstract:
In the Mopti region of Mali, the livelihoods of most people depend on agriculture and pastoralism. Here, a variety of socio-professional groups - such as herders, farmers and fishers - coexist amidst the great natural richness of the inner Delta of the river Niger. Over recent years, poor resource management and subsequent conflict over access to these resources has threatened the livelihoods of virtually every community in central Mali. Formal and traditional justice mechanisms have each often proven incapable of mediating conflicts effectively and bringing justice to the victims and disputants. Moreover, the increase in communal conflicts in central Mali has created a fertile breeding ground for radical, armed groups. These groups have become actively involved in the regulation of access to natural resources, as well as in the mediation of related conflicts, to help create local legitimacy for their rule. That these groups could exploit conflicts to consolidate their power demonstrates that fighting them will not be enough to stop destabilisation in the Mopti region. Only solutions that address the underlying drivers of instability will enable sustainable peace to emerge. This report explores the lack of governance as a structural driver of resource conflict in the region and identifies a mix of short- and long-term measures to increase the legitimacy of the Malian state.
