121. An Ironic Outcome: The United States — Even under Trump — Is Closer to Meeting Its Emission Targets Than Canada

Abstract:
Even though US President Donald Trump has pulled the United States out of the Paris Agreement, the country remains much closer to hitting the 2020 emission targets pledged by the previous administration of Barack Obama than Canada is of meeting the targets originally proposed by the government of Stephen Harper. The significant difference in emission performance is the result of the very different trajectories of energy-related emissions in the two countries. In the United States, such emissions have fallen steadily over the last decade as natural gas has usurped coal’s once dominant role in the US power sector. North of the border, oil sands emissions continue to be the fastest-growing source of emissions in Canada as emission-intensive in situ oil sands production continues to increase despite unfavourable economics.

Abstract:
Participants from academia and various levels of government gathered in Ottawa to discuss the often underappreciated interplay between the international climate agenda and the global trade system. The trade system has traditionally supported open flows of goods and services by disciplining tariffs, as well as trade-distorting subsidies and regulations. But there is an emerging tension between this approach and the desire of governments to address climate change through potentially trade-distorting domestic regulations and green subsidies. The challenge for policy makers is how to maintain relatively free, undistorted trade, while still giving countries sufficient policy space to implement effective measures to combat climate change.

Abstract:
The North American Arctic (NAA) is a distinct subregion of the Arctic, with vast territories, extreme environmental conditions, small and remote communities, complex governance and significant resource constraints. There is an urgent need for stronger east-to-west cooperation among regional and national governments, Indigenous organizations, business, academia and other stakeholders to build the region’s prosperity. In February 2018, working closely with the Labrador North and Baffin Regional Chambers of Commerce, the Centre for International Governance Innovation hosted the “CIGI Summit of North American Arctic Leaders” — two special panel discussions exploring ways to foster this cooperation and strengthen dialogue among stakeholders. These panels occurred during the Northern Lights 2018 Business and Cultural Showcase, a four-day event in Ottawa bringing together more than 1,200 participants from across the country and around the world. The first panel featured the political leadership of the NAA; the second brought together experts in marine development and infrastructure. This conference report describes the summit’s key themes, priorities and takeaways.

124. From Fisheries Subsidies to Energy Reform under International Trade Law

Abstract:
Economic, environmental and other international regimes are jointly facing a wicked climate problem. Climate change impacts on human activity and ecosystems have the potential to jeopardize attaining shared goals of these different regimes, and yet can only be addressed by overcoming the division and occasional conflict between their different stakeholders and areas of focus. Discussions have begun in the hallways on how trade law could best be leveraged to bring the international community together to prevent climate-related harms. This paper argues that World Trade Organization (WTO) fisheries subsidies negotiations should be a priority area for those practitioners and researchers building links between trade and climate law. It is submitted that successful fisheries subsidies reform will directly contribute to the implementation of the Paris Agreement and to the delivery of Sustainable Development Goal (SDG) 13 (“Take urgent action to combat climate change and its impacts”), given the important synergies that exist between the transformation of fisheries subsidies and climate mitigation and adaptation. Furthermore, fisheries subsidies negotiations are of crucial importance for international climate law because they can provide a case study to learn from and increase chances of success with fossil fuel subsidy reform. This paper provides a brief historical overview of trade law negotiations aiming to reduce and reform fisheries subsidies, and shows the important synergies that exist between reforming fisheries subsidies and implementing the Paris Agreement as well as the SDGs. The paper then extracts five drivers for success that can be observed from the current process of fisheries subsidies reform: leadership of key countries and of the WTO Secretariat itself; meticulous academic, scientific and policy background analysis; commitment by civil society and the private sector; the development of alternatives to those subsidies that encourage overfishing; and inter-regime learning. Lastly, the paper discusses the transferability of these drivers for success to prevent climate harms and to address more general challenges encountered in both the climate and trade regimes.

Abstract:
Pope Francis addresses the intersecting concerns of environmental responsibility and authentic human development in the June 2015 papal encyclical Laudato Si’: On Care for Our Common Home. Pope Francis extends Catholic environmental ethics to advocate for those at the margins of social consciousness who are most vulnerable to rapid environmental changes—the global poor and future generations. Pope Francis’ active collaboration with leading experts in climate science and development economics and his perspective as the first non-European Pope strengthens his contributions to ethical discourse on inter- and intra-generational justice, the preferential option for the poor, carbon mitigation policies, and common but differentiated responsibilities in international climate negotiations. His advocacy efforts in 2015 anticipated critical convocations of world leaders, including the UN General Assembly’s ratification of the Sustainable Development Goals in September 2015 and the UN Climate Change Conference in Paris in December 2015, culminating in a unanimous decision among 195 governments to adopt the Paris Agreement. Pope Francis’ contribution to discourse on international climate policies and sustainable development objectives inspired political cooperation leading up to pivotal international agreements.

126. Greening Peacekeeping: The Environmental Impact of UN Peace Operations

Abstract:
The 2010 cholera outbreak in Haiti, triggered by the UN mission there, killed more than 9,000 people and affected nearly 807,000. This disastrous case drew attention to the negative effect UN peace operations can have on the surrounding communities and environment—something peacekeepers had started paying attention to with the deployment of new large-scale operations in the 2000s. As operations have grown in size, so too has the size of their environmental footprint. This report looks at the environmental impact of peace operations and how the UN has responded, including through policies and guidelines, dedicated staff, and training material. In particular, it assesses the challenges the Department of Field Support faces in implementing its Environment Strategy. Based on this assessment, which includes a detailed examination of the UN mission in Mali, the report puts forward a series of short-, medium-, and long-term recommendations. It concludes that a UN presence should not be a source of stress but should improve local environmental sustainability and build resilience.

127. Closing the Enforcement Gap: Community-led Groundtruthing of Environmental Violations in Mormugao, Goa

Abstract:
The Mormugao Port is located at Vasco bay in the Mormugao taluka of Goa at the point where the Zuari river meets the Arabian Sea. This region is home to thousands of fisherfolk from the Karvi community who live along the beaches of Mormugao, Salcete and Tiswadi talukas. It is a natural harbour that provides safe haven for ships and fishing vessels during storms, like it did in 2017 when cyclone Okchi hit this coast. The lives and livelihood of these fisherfolk are intrinsically linked to the activities of Mormugao port as they have had to share their customary livelihood areas – the sea and the beaches – with the port. This has resulted in them competing for space for their daily activities like fish landing, boat parking, net mending, and even housing with the port and its infrastructure development on the landward side, and competing with larger shipping vessels for navigation space and access to certain parts of Vasco bay. It was in this backdrop, that a community led groundtruthing study was initiated in April 2018 by Old Cross Fishing Canoe Owners Co-op Society Ltd, Baina Ramponkar, Fishing Canoe Owners Society, Destierro Fisherman Association – Vasco, Goenchea Raponkarancho Ekvott (GRE) and the Centre for Policy Research (CPR)-Namati Environmental Justice Program with support from concerned citizens of Vasco and the Federation of Rainbow Warriors.This groundtruthing study is also an attempt by the affected community members to understand the environmental impacts of these berths, link them to the regulatory requirements and then push for compliance of the same.

128. Building Regulations For Faecal Sludge Management: Review of Building Regulations From Indian States

Abstract:
Getting approvals under the various building regulations applicable to any particular jurisdiction is often the first step in construction and development. The Report ‘Building Regulations for Faecal Sludge Management: Review of Building Regulations from Indian States’ seeks to understand how these building regulations address on-site sanitation, what kind of standards do they impose on developers, and how well do they incorporate mechanisms to enforce these standards. In this report, we look at six states: Andhra Pradesh, Odisha, Rajasthan, Tamil Nadu, Maharashtra, and Uttar Pradesh. We also look at other standards that are applicable to on-site containment of Faecal sludge, and the manner in which these standards get incorporated into the building regulations. We find that context-specific attention to On-Site Containment of Faecal Sludge is only given in very few states, at least within our sample size. Usually, Building Regulations seem to rely on already existing standards such as the National Building Code, 2016. Additionally, the inconsistencies within the bye-laws exhibit a lack of understanding on the issue of FSM, amongst the policy-makers. As Faecal Sludge Management is an issue at the interface of environment, sanitation, and public health, a lack of convergence between various departments of the government is also noticed.

129. Swachh Bharat Mission (Urban): Need vs Planning

Abstract:
This paper analyses the effectiveness of the Swachh Bharat Mission (Urban) by analyzing the financial and physical progress of the mission and the manner in which funds have been allocated and sanctioned to different activities in various states. It examines the planned allocation of central funds (i) between the SBM (Urban) and the rural component, SBM (Gramin) (ii) among the various components of SBM-U, i.e., Construction of Individual Household Latrines and Community Toilets (IHHLs and CTs), Solid Waste Management (SWM), Information, Education and Communication (IEC) and Capacity Building (CB) and (iii) across different states and UTs. It finds that the disparity in funding between the SBM-U and SBM-G does not reflect the risk-adjusted need of urban areas, given their complexities of urban congestion and poverty that lead to higher health and environmental risk. The allocation of funds between the various components of SBM-U undervalues the need for proper solid waste management, IEC and Capacity Building and appears to ignore their effect on sanitation practices, the importance of building capacity to properly manage waste from the increasing number of toilets constructed and more organized solid waste disposal. Finally, the pattern of the allocation of funds between states does not benefit states that need it the most, in terms of states that have a lower share of in-house toilets, because the funds were allocated on the basis of the share of urban population and statutory towns. The paper concludes with recommendations to rectify some of these shortcomings.

130. Caring for the coast- Building regulatory compliance through community action

Abstract:
Across the globe, the “development experience” of communities varies depending on their socioeconomic and political backgrounds. As a result of advancing developmental projects, a few communities are invariably made to pay a disproportionate share of the environmental costs in the form of exposure to toxic waste, loss of livelihood, and restrictions on mobility or access to common resources. This injustice, more than often not, is an outcome of active noncompliance and violation of environmental regulations by the projects . The Centre for Policy Research–Namati Environmental Justice Program is an effort towards closing this environment regulation enforcement gap. We have created a network of community-based paralegals, called as enviro-legal coordinators (ELCs), who work with affected communities using an evidence-based legal approach. As a part of this approach, the ELCs combine their understanding of the law, negotiation and mediation skills, and understanding of local contexts to assist affected communities in the use of the law to resolve environmental conflicts. They help the communities to understand relevant laws and environmental regulations and support them in engaging with institutions using these laws for better enforcement of regulatory compliance on the ground. This approach also develops a collaborative space for institutions and citizens to craft practical and sustainable remedies for the impacts that communities experience. This publication is a compendium of a few cases undertaken by the CPR–Namati Program’s ELCs working across the coastal belt in Gujarat and North Karnataka. These case stories capture the process of our work and illustrate the systematic, evidence-based legal approach followed by the ELCs along with the affected coastal community members to resolve conflicts arising from noncompliance or improper implementation of environmental regulations. These case stories are divided into three major thematic sections as follows: Section 1: Establishment and Activation of Gujarat’s District-Level Coastal Committees (DLCCs) as per Coastal Regulation Zone (CRZ) Notification, 2011: This section includes case studies from Gujarat, where ELCs worked towards establishing or activating District-Level Coastal Committees, an institution set up for better implementation of CRZ regulations and protection of rights of traditional coastal communities. Section 2: Securing Housing Clearances for Coastal Communities under Coastal Zone Regulation Notification, 2011 in North Karnataka: This section includes case studies from Uttara Kannada, a district in North Karnataka, where ELCs supported members of coastal communities in securing housing clearances under the coastal protection law. Section 3: Legal Empowerment in Practice: Two Case Stories: This section has two case stories from our field sites in Gujarat that illustrate the process and outcomes of legal empowerment though our work with communities.
