321. The Hard Reality for International Climate Agreements in the United States

Abstract:
The release of the second installment of the Intergovernmental Panel on Climate Change's Fifth Assessment Report on March 31, 2014, provoked the usual calls for urgent and immediate action in response to climate change, including in particular at the international level in the form of a new climate treaty built upon domestic regulatory regimes. Irrespective of whether these calls for action are overly strident or carefully measured, the law plays a central role. In almost any discussion, the breadth and stringency of national and sub-national regulations and the extent to which a treaty can make them “legally binding” assumes paramount importance. But this emphasis on law is misplaced, because it runs headlong into the hard reality that would confront any international climate agreement in the US Senate. And given the soaring use of coal around the world, it also draws attention and resources away from far more achievable opportunities to develop and deploy advanced coal technologies that would allow the world's most abundant, accessible, and affordable energy resource to meet critical energy needs in balance with each country's environmental, economic, and security priorities.

Abstract:
The recent events in Ukraine have revived the question of European dependence on Russian natural gas. The security of Europe's natural gas supply has been a consistently important issue in Russian-European Union (EU) relations. Russia provided 34 percent of EU gas in 2012, and Russian policies can have a direct impact on EU supplies. After the West-Russian confrontation over Ukraine, a lot has been said about the 'US shale gas revolution' and the possibilities of the United States becoming an energy exporter for future European energy needs. Although US energy independence seems to promise new perspectives for future European energy security, as well as for the balance of power in the Middle East, this is not for this decade. We cannot expect that the European Union would be able to cut off all of its energy relations with Russia, but we can foresee–or at least agree–that the European Union should diversify its natural gas supplies.

Since the seizure of US hostages in Iran following the 1979 revolution, the US government has imposed a succession of economic penalties against the Islamic Republic. The complexity and severity of these sanctions intensified following Iran's resumption of a uranium enrichment program in 2006. However, there are a variety of ways to provide extensive sanctions relief should there be a deal placing long-term restrictions on Iran's nuclear activities.

Abstract:
In light of the ongoing discussion on the expert and scholarly level regarding the kind of regulatory regime for international relations that should be formed in the arctic – national (sectoral), regional or international, broad to the maximum degree possible – it is important to revisit the text of what is known as the Ilulissat Declaration, signed by the five arctic states in May 2008. It is of primary importance that the Declaration records the provision that an “extensive international legal framework” should be applied to the arctic ocean. The Declaration defines this “framework” as the law of the sea, which provides for important rights and obligations concerning the use and exploitation of the resources and spaces of this marine region. The law of the sea is regarded as a solid foundation for “responsible management” in the arctic. What is the significance of these formulations, what meaning did the authors of the Declaration assign to them, and what interpretations are possible here – these matters are considered in the present analytical overview.

Abstract:
The EU’s new energy and climate framework for 2030 is an exercise in reconciling Europe’s green agenda with its need for renewed competitiveness—as well as the domestic concerns of Member States. As the energy policies of Poland and Germany are shaped by EU policy, the 2030 policy proposal might serve as an opportunity for a shift towards bolstered bilateral cooperation. The conditions for this are twofold: mutual understanding and thinking outside the box. The publication is a part of the project “The German ‘Energiewende’ from Different Perspectives” carried out by the Polish Institute of International Affairs in cooperation with the Konrad Adenauer Foundation in Poland.

Abstract:
Over the last two decades, the European Union has put in place various policy and regulatory instruments to address climate change and ensure environmental protection. These European efforts, however, have been far from fully successful for a number of reasons, including the difficulty of achieving simultaneously the objectives set by the "2020 Climate and Energy Package" and the inefficient governance mechanisms to pursue them. For this reason, the 2030 policy framework for climate and energy agreed by the European Council in October 2014 proposes a new governance structure which introduces greater flexibility for governments in reaching the targets. While the new structure allows Member States to choose policies that are best-suited to their national energy mix and preferences, it will have to ensure that the commitments undersigned at EU level are respected and the overall targets set by the Commission are met.

South-Eastern Mediterranean gas fields are still under exploration and development. Meanwhile, the question of which route or routes such gas would take into the global markets remains unanswered. The various possible routes appear to be problematic either politically or financially, leaving development stifled. However, with the crisis between Russia and Ukraine deepening Europe's interest in diversification of supplies, and with gas field owners and developers eager to monetise the resources, Eastern Mediterranean gas could become a potential source for the European Union. This paper tries to answer whether the South-Eastern Mediterranean resources can be regarded as a considerable supply for Europe and, if so, what are the alternative routes that would benefit all the parties involved.

Energy is a key factor shaping relations between Europe and North Africa. Due to the Maghreb's strategic role for European energy security, in the last two decades the EU has attempted to promote deeper energy cooperation both with and within the region. The success of the EU's bilateral and multilateral initiatives, however, has been hindered by diverging interests between European countries and their North African counterparts. The upheaval in the region unleashed by the Arab awakening, along with critical socio-economic challenges like population growth and urbanization, are altering this picture. In this context, the EU should urgently rethink its energy cooperation models with the southern partners, seizing the opportunities engendered by the current moment of change in the region.

The aim of this paper is to analyze EU-Turkey relations from an energy perspective. Energy is of mutual strategic interest to Turkey and the EU, insofar as both face serious and multiple energy challenges. Both Turkey and the EU seek to bridge supply and demand, and to establish a more competitive, diverse, secure and sustainable energy system. Common challenges and complementary objectives offer an unparalleled opportunity for the EU and Turkey to intensify cooperation and deepen integration in this field. To that end, this paper discusses the growing relevance of energy in the EU-Turkey relationship, focusing on Turkey's increasing importance in enhancing EU energy security. It then examines how future energy challenges could be turned into opportunities. Turkey and the EU have a lot to gain from close cooperation and deeper integration in the field of energy. However, the full potential of such cooperation and integration can best met by opening the energy chapter in Turkey's accession negotiations.

This report explores how the relationships between food, water, and energy resources shape our world and its future, with emphasis on Africa and the transatlantic region. Called the food-water-energy “nexus,” the interdependencies between these resources are fundamental to all human endeavor on Earth. Understanding this nexus and managing it effectively is a critical challenge for policymakers and thought leaders in the transatlantic arena. Solving the challenges found on the African continent might present both the greatest task and the greatest reward. The potential pitfalls of failing to tackle Africa's foodwater- energy challenges are enormous, for Africans themselves and for all countries sharing the Atlantic Ocean space. But the potential downside is more than matched by the potential upside, and the gains to be had from solving nexus problems in Africa might prove as profound as any set of goals in the world.
