801. The Kosovo Advisory Opinion of the International Court of Justice and its Political Consequences

Abstract:
Ever since NATO's Operation Allied Force in 1999 resulted in a withdrawal of Serb forces from Kosovo and the establishment of governance arrangements for the province that included an important external presence (with UN, EU, NATO and OSCE missions) as well as Kosovo's own Provisional Institutions of Self Government, the precise future status of Kosovo has been in doubt. Two extreme options were favoured by Serbia and Kosovo, respectively: either for Kosovo to continue as a part of Serbia or for it to achieve independent status (most likely by attaining statehood). On 17 February 2008, a group of Kosovo leaders issued a Declaration of Independence. Serbia responded with a request that the UN General Assembly seek an opinion on the legality of Kosovo's action from the International Court of Justice (ICJ). The Court delivered its Opinion on 22 July 2010. What did the Court say and what are the political consequences of its Opinion?

802. The Effect of Civilian Casualties in Afghanistan and Iraq

Abstract:
A central question in intrastate conflicts is how insurgents are able to mobilize supporters to participate in violent and risky activities. A common explanation is that violence committed by counterinsurgent forces mobilizes certain segments of the population through a range of mechanisms. We study the effects of civilian casualties in Iraq and Afghanistan to quantify the effect of such casualties on subsequent insurgent violence. By comparing uniquely detailed micro-data along temporal, spatial, and gender dimensions we can distinguish short-run 'information' and 'capacity' effects from the longer run 'propaganda' and 'revenge' effects. In Afghanistan we find strong evidence that local exposure to civilian casualties caused by international forces leads to increased insurgent violence over the long-run, what we term the 'revenge' effect. Matching districts with similar past trends in violence shows that counterinsurgent-generated civilian casualties from a typical incident are responsible for 1 additional violent incident in an average sized district in the following 6 weeks and lead to increased violence over the next 6 months. There is no evidence that out-of-area events—errant air strikes for example—lead to increased violence, nor is there evidence of short run effects, thus ruling out the propaganda, information, and capacity mechanisms. Critically, we find no evidence of a similar reaction to civilian casualties in Iraq, suggesting the constraints on insurgent production of violence may be quite conflict-specific. Our results imply that minimizing harm to civilians may indeed help counterinsurgent forces in Afghanistan to reduce insurgent recruitment.

803. Development Assistance and Conflict in Sri Lanka: Lessons from the Eastern Province

Abstract:
Violence, political instability and the government's reluctance to devolve power or resources to the fledgling provincial council are undermining ambitious plans for developing Sri Lanka's Eastern Province. The east continues to face obstacles to economic and political progress and offers lessons for development agencies and foreign donors considering expanding their work into newly won areas in the Northern Province. While there is still potential for progress in the east, it remains far from being the model of democratisation and post conflict reconstruction that the government claims. Donors should adopt a more coordinated set of policies for the war-damaged areas of Sri Lanka, emphasising civilian protection, increased monitoring of the effects of aid on conflict dynamics and collective advocacy with the government at the highest levels.

804. China's Growing Role in UN Peacekeeping

Abstract:
Over the past twenty years China has become an active participant in UN peacekeeping, a development that will benefit the international community. Beijing has the capacity to expand its contributions further and should be encouraged to do so. China's approach to peacekeeping has evolved considerably since it assumed its UN Security Council (UNSC) seat in 1971, when it rejected the entire concept of peacekeeping. Now, with over 2,000 peacekeepers serving in ten UN peacekeeping operations worldwide, China's motivations for supporting and participating in peacekeeping have led it to adopt a case-by-case approach that balances those motivations against its traditional adherence to nonintervention. This pragmatic policy shift paves the way for China to provide much-needed personnel as well as political support and momentum for peacekeeping at a time when both conflicts and peacekeeping operations are becoming more complex. China's involvement also further binds it to the international system.

Abstract:
After several years of continuous expansion, reform and resiliency, in 2008 global peacekeeping was pushed to the brink. This publication warned in 2006 that peacekeeping faced a risk of overstretch. In 2007 it highlighted the mounting pressures on peacekeeping organizations, while stressing that peace operations had shown surprising resilience. By 2008 peacekeeping was spread increasingly thin, in many respects the victim of its own success. Our thematic review that year was by Lakhdhar Brahimi and Salman Ahmed. It cautioned that we risked unlearning the central lesson of the Brahimi Report: that peacekeeping is not a substitute for an effective political process.

The May 2008 thematic debate in the UN Security Council debate identified three primary weaknesses in international performance to support stabilization and early recovery from conflict: A strategic gap – there was no evidence of strategy that encompassed political, security, development and humanitarian tools across bilateral and multi-lateral actors, and no framework for prioritization. A financing gap – the instruments of international assistance are neither flexible nor dynamic enough. Further, and specific gaps were identified for: standing capacity for strategic planning at country level; support to political processes and implementation of agreements; funding that is realistic, flexible and responsive; there is a gap in the ability to spend development money early. A series of capacity gaps – in leadership and implementation, in sheer availability of civilian resources, and in purposeful training.

In the last sixth months, NATO and the UN have both confronted the possibility that their largest individual peace operations may fail. In Afghanistan, NATO troops have struggled to contain the Taliban. In the Democratic Republic of Congo (DRC) the UN was unable to halt rebel attacks that displaced as many as 250,000 people last September.

The deployment of peacekeepers is increasingly becoming a reflex solution to crises, often in the absence of viable political agreements. The cluster of peace operations in the Broader Horn of Africa – stretching from Central African Republic and Chad, through Sudan, to Eritrea, Ethiopia and Somalia – epitomizes both practices. Moreover, though the conflicts in the region are deeply inter-linked, the peace operations there are not, nor do they form part of a broader regional strategy. Lack of a regional strategy compounds pre-existing problems of weak commitment and slow implementation. The results have been unsurprisingly poor, at great human cost.

810. The Purposes of Peace Operations

Ever since the United Nations started asking its member states, in the late 1940s, for military officers to observe cease-fires and, in the 1950s, for armed troops to monitor borders and supervise force separations, the purposes of these activities have been dictated case by case, heavily influenced by prevailing global and regional politics and by the national interests of countries on the UN Security Council—the five permanent members in particular. Peacekeepers have been deployed to act as fair witnesses (observing and reporting the facts but without the duty or ability to alter the situation on the ground other than through such reporting); as referees of a peace accord (judging compliance but relying on larger powers to enforce it); as “police” (impartially enforcing an accord through their own authority and means in the short term, using force as necessary, minimally and proportionately, but leaving the long-term verdicts and results to others); as state-builders (in collaboration with the local parties, shifting primary emphasis from security to development as circumstances and local capacity permit); or as state surrogates (responsible for reconstruction of the apparatus of governance, and for governing until such apparatus, and the human capacity to run it, can be prepared to supplant such outside support).
