21. La captura del Estado peruano por el narcotráfico: el caso de los “cuello blanco del puerto” (The Capture of the Peruvian State by Drug Trafficking: the Case of «the White Collars of the Port»)

Abstract:
Desde los años ochenta el Perú es una pieza clave en el escenario internacional del tráfico de drogas. Segundo productor de cocaína del mundo y uno de los países donde se cultiva el principal insumo, la hoja de coca, el puerto de El Callao, siendo uno de los principales puertos de América Latina por su volumen, se presume que es desde donde salen importantes cargas de esa droga. La interceptación de las comunicaciones en 2018 para investigar el crimen organizado violento que se desarrollaba en esa Provincia, desveló una red de jueces, fiscales, congresistas, empresarios, que colaboraban con los narcotraficantes favoreciéndoles con la impunidad. No es el primer intento de captura del Estado peruano por el narcotráfico. En la década de los noventa, el gobierno de Fujimori-Montesinos, utilizó el dinero del narcotráfico –entre otros- para sobornar a las más altas autoridades del país: jefes militares, Corte Suprema, Fiscal de la Nación, medios de comunicación, empresarios, todos afines al gobierno. Los “narcoindultos” del segundo gobierno de Alan García son otro síntoma de la gravedad de la colaboración de autoridades de las más altas esferas del Estado con los poderosos narcotraficantes. Se pone en evidencia la “doble moral” de la Política Criminal peruana contra el tráfico internacional de drogas, fuerte para los débiles y débil para los fuertes: penas altas para los pequeños traficantes e impunidad para los que se encuentran en el vértice de las organizaciones criminales. Además, resulta preocupante la enorme capacidad corruptora del dinero proveniente del narcotráfico (blanqueo de dinero) para capturar miembros de los poderes del Estado: Ejecutivo, Legislativo y Judicial. El caso “cuellos blanco del puerto” es una muestra empírica de la intersección de la corrupción judicial –y sus adláteres- dentro del Estado peruano y las organizaciones del crimen organizado. Para conjurar estas alianzas, es preciso poner el acento en la punición de los delincuentes de cuello blanco del narcotráfico y sus colaboradores: abogados, jueces, fiscales, etc., que utilizan su profesión como tapadera para enriquecerse personalmente, en desmedro del bien común.

Abstract:
Current tensions between Mexico and the United States over migration—complete with divisive political rhetoric and unilateral U.S. actions affecting border communities—obscure an important reality: the migration challenges these two countries face are increasingly similar. Both are contending with large-scale mixed flows of humanitarian and other migrants from Central America, including many families and children travelling alone, and both have asylum systems struggling to keep up with a surge in requests for protection. They are also home to large numbers of each other’s nationals and grapple with similar policy questions when it comes to integrating these and other immigrants into local communities, schools, and economies. To build understanding of the changing migration landscape and begin to develop a shared vision for future cooperation, the Migration Policy Institute and El Colegio de México convened the Study Group on Mexico-U.S. Migration in late 2018 and early 2019. The group’s members include leading experts from government, academia, civil society, and the private sector. Informed by the study group’s discussions, this report begins with a snapshot of how migration patterns have changed—with the Mexican immigrant population in the United States shrinking since 2014, more Mexicans and their U.S.-born children moving from the United States to Mexico, and increasing numbers of Central Americans travelling to and applying for asylum in both countries. The report then explores policy options that could help Mexican and U.S. policymakers rethink key issues, including strategies for reforming asylum systems to enable timely and fair decision-making; and improving coordinated border management to facilitate the regular flow of goods and people, while preventing migrant smuggling, drug trafficking, and other illicit activities.

25. Preventing Diversion: Comparing ATT and African Measures for Importing States

Abstract:
The diversion of conventional arms from licit to illicit entities can occur at any stage of the arms transfer chain. Preventing diversion therefore requires varied measures that effectively tackle the issue along the chain. The Arms Trade Treaty Working Group on Effective Treaty Implementation (WGETI) compiled a paper on such prevention measures, which relied heavily on the experiences of major exporting states. Several African sub-regional instruments contain measures to prevent and detect diversion for states that are not major exporters. This Small Arms Survey Briefing Paper compares diversion prevention measures for importing states as identified in the WGETI paper and African sub-regional measures. It finds that the African instruments lack articles on post-delivery cooperation with the exporting state, compliance with assurances on re-export or retransfer, in addition to measures to address identified cases of diversion. However, it also finds that these instruments contain prevention measures that are not in the WGETI paper, including provisions on modes of transport and official entry points. Incorporating experiences from ATT states parties from Africa can help inform discussions on the role of importing states to prevent diversion.

This Briefing Paper from the Small Arms Survey maps cross-border arms trafficking in West Africa and the Sahel through case studies on Niger, Mali, Guinea-Bissau, and the two tri-border areas of Burkina Faso–Côte d’Ivoire–Mali, and Ghana–Côte d’Ivoire–Burkina Faso. The study reveals that highly organized trafficking networks move sizable arms quantities across large areas of land north of the Niger River. Arms trafficking south of the river is more characterized by lower-level arms flows and local intermediaries engaging in so-called ‘ant trade’. Actors range from long-established criminals, corrupt officials, and organized trafficking rings, to tribal networks and low-level transporters. Based on field research, The West Africa–Sahel Connection: Mapping Cross-border Arms Trafficking analyzes the links between illicit arms trafficking and other forms of trafficking and organized crime in the region. The study also looks into the impacts of such arms trafficking as well as the responses to it.

Abstract:
This online report studies the effects of EU migration policies and the externalisation of EU border control on Saharan migration routes and on practices in the border regions connecting Niger, Chad, Sudan and Libya. Authors Jérôme Tubiana, Clotilde Warin and Gaffar Mohammud Saeneen find that, in response to the obstacles and opportunities that border externalisation policies present for migrants, migration routes diversify and move to other countries. Beyond the fact that migration is a transnational phenomenon not linked to one particular route or itinerary, this continuous moving of routes is made possible by cross-border Saharan trade and trafficking networks that have put in place the necessary logistics to facilitate migration and which often fall outside government control. Pushed by EU efforts to curtail migration, states such as Niger, Chad and Sudan have shored up border patrols and anti-smuggling operations in the border regions under study here. The report shows that this has been done in a manner that is often not conducive to stability in the region and which contributes to the ‘militia-isation’ – the growing power of militias whose presence undermines the state – of the countries at issue.

29. Caught in the middle: A human rights and peace-building approach to migration governance in the Sahel

Abstract:
In recent years, the Sahel region has attracted the attention of European policy makers aiming to prevent Europe-bound irregular migrants from reaching the Libyan coastline. Policies implemented under this approach propose to address the root causes of irregular migration from non-EU countries, such as through support for socio-economic development of countries of origin, the dismantling of smuggling and trafficking networks, and the definition of actions for the better application of return policies. Does this approach to mixed migration governance take sufficient stock of the larger development and stability contexts within which irregular migration and human smuggling takes place? Does migration governance suffciently address the human rights consequences and destabilising effects that migratory movements and the policies that address them may have? And how could human rights and peace-building principles – that is, processes and measures that contribute to a society’s capacity to address conflict in a constructive manner – be incorporated to achieve more holistic and conflict-sensitive migration governance? In their report authors Fransje Molenaar, Jérôme Tubiana and Clotilde Warin address these issues and find that the implementation of migration policies in the Sahel has contributed to an increase in human rights abuses and risks for migrants and refugees, as well as rises in human trafficking and forced labour. They argue that national and sub-national institutions and capacities be supported to take the lead in comprehensive and sustainable migration management and migrant protection presenting the following recommendations: Contribute to the development of (sub)national migrant protection frameworks and structures; Ensure that migration governance benefits local communities and addresses the (perceived) negative effects of migration on host communities; Strengthen community security and ensure that securitised migration policies do not harm local communities. In their conclusion, the authors also offer concrete pointers to implement these recommendations.

Southern Libya after the fall of Qaddafi has become synonymous with lawlessness. For centuries, the area has been home to a shifting sea of ethnic groups who see the border as an imposition but not a barrier. The Tubu (or Teda) are one such group, whose presence stretches across southern Libya, Chad, and Niger. In Lost in Trans-Nation: Tubu and Other Armed Groups and Smugglers along Libya’s Southern Border, the Small Arms Survey explores the role of Tubu militias before and since the fall of the Qaddafi regime; the roles and alliances of Chadian and Sudanese combatants in the border area; the Agadez–Fezzan corridor, placing particular weight on recent changes in migrant smuggling and drug trafficking; and data and analysis of regional weapons flows. Authored by researchers Jérôme Tubiana and Claudio Gramizzi, Lost in Trans-Nation is a joint publication of the Small Arms Survey’s Security Assessment in North Africa (SANA) and Human Security Baseline Assessment (HSBA) projects, in cooperation with Conflict Armament Research, and builds on the 2017 report Tubu Trouble: State and Statelessness in the Chad–Sudan–Libya Triangle by the same authors and organizations.
