441. Bridging the Planning Gap: Incorporating Cyberspace Into Operational Planning

Abstract:
Cyberspace operations have a far-reaching, permanent impact on military operations. At the conceptual level, the U.S. Department of Defense (DoD) now recognizes five warfighting domains: land, maritime, air, space, and cyber.1 While there are examples of how cyberspace support to military operations have advanced over the past decade, one gap has not been addressed in detail—operational planning. It is clear that in U.S. military operations, the land, maritime, air, and space domains rely heavily on cyberspace. Therefore, cyberspace operations must be viewed in the context of all domains and be included as part of the overall operational scheme of maneuver. For if a commander postures his or her command to fight an adversary in the first four domains but ignores cyberspace, not only will that commander have ceded the cyberspace domain to the adversary, but the adversary can then proceed to undermine that commander’s effectiveness in the other four domains.

Abstract:
The Army has been involved with space-based military operations for well over a half-century. During this time, space operations have changed from a realm exclusive to scientists and engineers, to highly classified activities largely unknown to the general population, to the unveiling of space-based communication, imagery, surveillance, and environment capabilities that have become a foundation for all modern warfare. Today, such support is so ingrained into daily operations that most soldiers, sailors, airmen, and marines assume it has been, and always will be, available for their use. But with such reliance comes vulnerability that potential adversaries may try to exploit. The evolution of Army space operations is well documented in many sources, thus this monograph serves not as a comprehensive history or detailed critique of the myriad accomplishments. Rather, it serves as a primer for current and future space-based operations to provide senior policymakers, decision-makers, military leaders, and their respective staffs an overall appreciation for existing Army space capabilities and the challenges, opportunities, and risks associated with their use in joint operations.

Abstract:
An analysis of weapons-based confidence-building measures shows how academics can work together to self-police their research for national security implications, socialize new members of the academic community into the importance of considering security issues, and develop and disseminate norms regarding what is and is not a moral and ethical use of these technologies. It may be possible for academics and policymakers to come together to work for a ban or build-down on cyber weapons patterned on international efforts to ban chemical and biological weapons and implement export regimes to control the export of code which may form the components of cyber weapons. If we conceptualize cyberspace as territory, we can also learn from the example of territorially-based confidence-building measures such as those implemented along the Indo-Pakistan border. This approach stresses the importance of developing notification procedures to prevent misperceptions and the escalation spiral, as well as communicating regularly to establish trust between all parties. The case studies presented here illustrate the promises and pitfalls of each approach and offer valuable warnings to policymakers seeking to implement such measures in cyberspace. They show what happens when not everyone in a regime is equally committed to a specific outcome by illustrating the difficulties of monitoring compliance in confidence-building regimes, and show the ways in which doctrines and confidence-building measures may not be perfectly aligned.

444. The Enduring Importance of Family Wealth: Evidence from the Forbes 400, 1982 to 2013

Abstract:
The social science literature proposes two competing explanatory frameworks for the existence and longevity of super-fortunes: superstar or winner-take-all mechanisms, suggesting an increased dominance of new self-made billionaires; and mechanisms focusing on inherited advantages, suggesting an enduring importance of old family fortunes. Using panel data from the USA’s annual Forbes 400 ranking (1982–2013), this study analyzes factors that increase or decrease the likelihood of remaining listed among the American super-rich. We find initially that the percentages of self-made entrepreneurs among the highest wealth echelons of US society have increased significantly since 1982. Sectors that improved the most are finance (including hedge funds and private equity), new technology and mass retail. The decline of inheritance as a source of wealth and the rise of new tech and finance fortunes suggest low reproduction rates among superrich property owners. Family wealth, however, plays an important role if the longevity of fortunes is considered. While the literature predicts family fortunes to be taxed away, divided among a large number of heirs, or lost through incompetence, we find that scions of inherited great wealth (mostly up to the third generation) are more likely to remain listed in the Forbes 400 roster than self-made entrepreneurs. We conclude that even though entrepreneurship increasingly matters for becoming super-rich, it is first and foremost the ability of rich family dynasties to retain control over corporations and to access sophisticated financial advice that makes fortunes last.

445. Reclaiming the Grassland for the Cheetah: Science and Nature Conservation in India

Abstract:
The role of scientists in influencing the aims and priorities of biological conservation in developing countries has been a topic of debate and needs elucidation. The Asiatic cheetah reintroduction plan in India sparked much discussion on the pros and cons of attempting to revive the population of a large carnivore that had been missing from the landscape for over half a century. This paper traces the history of cheetah reintroduction with the aim of exploring the relationships amongst the constituencies of scientists, politicians, local communities and the bureaucracy. This paper suggests that the decision to reintroduce the Asiatic cheetah in India was motivated by political symbolism and had little grounding in scientific rigour. Science was used as a legitimizing tool for a politically influenced conservation goal which had little space for socio-economic constraints or academic rigour. While there are many strands of wildlife conservation emerging in India, the dominant paradigm upheld by biologists continues to be negligent of both scientific and social concerns.

As the military integrates cyber into its structures, gradually more nations are recruiting and educating personnel to serve as "cyber officers". Tech-savvy men and women from ‘Generation Y’ grew up in the post-modern era, recognized not only by its individualism and erosion of overarching, coherent maxims, but also by the fact that technology is taken for granted. Thus, in the situation of the cyber officer a particular generation gap occurs, one in which the characteristics of postmodernity, military command structures and the inter-disciplinarity of cyber pull in conflicting directions. This friction creates a peculiar situation as technology and cyber contribute to sharpen the generation gap that necessarily exists between the young generation of cyber officers, and their superiors in the military. I explore this quandary through an examination of cyber officers’ testimonies. In particular, I focus on the cyber officers’ conceptualization of “cyber” and how this resonates with that of their superiors’. The data is ethnographic, based on interviews with cyber officer students at the Norwegian Defence Cyber Academy.

Abstract:
This article investigates some of the reasons behind the events that led to a recent shift in international relations towards the global geopolitical and a renewed competition between the great powers. The aim is to point out important ideas of authors and put them to dialogue between each other. It calls attention to the possibility of an alternative political and economic bloc being built around China against a decline of US power. These points are deepened when it is identified other key features of the current system that involves the discussion about classes. The current configuration of class alliances and states involves the complex dynamics of the working classes in the Global South, the use of debt as a means of domination by the economic and financial world, as well as the new professional middle class - that give values to knowledge, technology and democracy. It is these relationships and their interface with the existing political power that permeate the revival of the global geopolitics, influencing not only current events, but also any possibility of thinking an alternative for governance and international framework - or even the failure of this and a consequent and possible new conflict worldwide.

Abstract:
With innovation in the genetic engineering now being rewarded in the form of intellectual property rights, there are new things that are beginning to count as property and as objects of human invention – plant varieties, seeds, germplasm, genetic sequences, DNA and so on. To bring the realm of “biology” within the ambit of intellectual property, to juridify aspects of the biological as products of human invention is to bring new epistemic objects into visibility. While these are revealed through practices of biotechnology, law translates it into a capacity for monopolistic appropriation for biotech innovators. The new correlatives of innovation and intellectual property re-engineer not just the biology of an organism, but the very categories that organized property and intellectual property. What instrumentalities of technology and law co-produce biotic property? I examine these instrumentalities in a two paper series: while the first paper seeks to lay out the work of technology in the creation of new biological artefacts, and consequently new economic spaces and property claims, the second paper would seek to examine the role of law in translating inventive claims as property claims.

449. North Korea: The Myth of Maxed-Out Sanctions

On December 19, 2014, President Obama publicly blamed North Korea for the cyberattack against Sony Pictures and for the subsequent cyberterrorism against the American people, and promised to "respond proportionally." Almost immediately thereafter, one could hear a familiar narrative repeated, typified by New York Times correspondent David Sanger, who wrote that "North Korea is under so many sanctions already that adding more seems futile." One could have heard similar arguments in 2006, after North Korea's first nuclear test, and in 2013, after its third nuclear test. A variation of this argument is that “Washington … can do little ... without the cooperation of China.” ​ For years, journalists have quoted “experts” who insisted that U.S. sanctions options against North Korea were exhausted and had failed as an instrument of policy. As a matter of both fact and law, however, that is false; it even suggests that these experts have not read and understood the sanctions authorities. Why does this view persist, then? Some scholars may accept and propagate it because they oppose sanctions as a matter of policy. Others have simply ceased to question a myth that has entered the received wisdom. A true understanding of the potential effectiveness of sanctions first requires an understanding of what these sanctions are, what they are not, and how they work. This article will first summarize the sanctions authorities – U.N. Security Council resolutions, and the U.S. sanctions that should be an important part of the effective enforcement of the measures that the U.N. Security Council has adopted. It will also explain the role of the Treasury Department in regulating the international financial system, and the power this gives the United States to isolate the North Korean government from that system. It will explain which U.S. and U.N. sanctions against North Korea have succeeded and failed, and why. Finally, it will explain what current U.S. national sanctions do, and what they do not do. Only after one understands how little the current sanctions do – and how much they could do – can one begin to understand how to strengthen them into an effective part of a coherent foreign policy... ​

450. China’s Development of Space Warfare and Its Operational Applications

Abstract:
As early as March 2011, the journal Aerospace America featured an article with the title “China’s Military Space Surge,”[1] which warned that there had been a rapid increase in China’s capability to conduct warfare in space. Such capabilities would then in turn threaten and jeopardize the ability of the carrier battle groups of the United States to conduct operations in the Pacific. This article was soon translated into Japanese and published in Space Japan Review. This and other high profile articles highlight the anxieties on the part of the U.S. and Japan about China’s increasing ability to militarize space, and also their concerns about its implications for the peace and security of East Asia and the entire Pacific Asia region. On December 31, 2015 China announced the creation of three new branches of armed forces to be added into the reformed People’s Liberation Army (PLA): Army General Command, Strategic Support Force, and the PLA Rocket Force. While the PLA Rocket Force replaced the old Second Artillery Corps, what is even more intriguing is the mission of the new Strategic Support Force. According to Chinese media, the Strategic Support Force will be responsible for overseeing intelligence, technical reconnaissance, satellite management, electronic warfare, cyberwarfare, and psychological warfare. It is no coincidence that Gao Jin (高津), the newly appointed commander of the Strategic Support Force, is also an expert on rocket science, which has further fueled media speculations that the Strategic Support Force has been created for the purpose of conducting future space warfare.[2] In fact, China has been increasing the focus on the military applications of space since the end of Persian Gulf War in the 1990s. During that war, the United States mobilized dozens of satellites to aid the American-led coalition forces, enabling them to defeat Iraqi forces with extraordinary efficiency and ease. The Persian Gulf War greatly shocked PLA observers at the time, and served as a reminder that the conduct of modern warfare had been transformed by the arrival of a new generation of technology. Chinese military theorists then began to study the concept of “space warfare.” The most influential was Chang Xian-Qi (常顯奇), who categorized space warfare into three distinct phases based on his observations of U.S. planning: the “Entry into Space,” the “Utilization of Space,” and the “Control of Space.” “Entry into Space” is represented by the delivery of a military-purpose spacecraft into its designated orbit path. “Utilization of Space” is to harness the power of existing space assets to aid military operations across the land, naval, and air domains. For example, such power can manifest in the forms of using space sensors to conduct surveillance and gather intelligence for Anti-Access/Area Denial (A2/AD) against potential foes, to provide ballistic missile early warning, satellite navigation and communications, among other purposes. The “Control of Space” phase focuses on establishing “space superiority” with the missions of: (1) increasing survivability of one’s own military satellites and systems; (2) disrupting, sabotaging, or destroying opposing countries’ satellites and their systems when necessary; and (3) directly using space-based weapons to aid in combat operations on the ground.[3]...
