On December 29, 2014, the US President and Secretary of Defense announced the formal end to Operation Enduring Freedom, its combat mission in Afghanistan, which had begun in the aftermath of the September 11, 2001 attacks. They also stated that the US would begin its follow-on mission, Operation Freedom's Sentinel, at the start of 2015.

392. Syria Calling: Radicalisation in Central Asia

Abstract:
Growing numbers of Central Asian citizens, male and female, are travelling to the Middle East to fight or otherwise support the Islamic State (IS, formerly ISIL or ISIS). Prompted in part by political marginalisation and bleak economic prospects that characterise their post-Soviet region, 2,000-4,000 have in the past three years turned their back on their secular states to seek a radical alternative. IS beckons not only to those who seek combat experience, but also to those who envision a more devout, purposeful, fundamentalist religious life. This presents a complex problem to the governments of Central Asia. They are tempted to exploit the phenomenon to crack down on dissent. The more promising solution, however, requires addressing multiple political and administrative failures, revising discriminatory laws and policies, implementing outreach programs for both men and women and creating jobs at home for disadvantaged youths, as well as ensuring better coordination between security services.

393. The Limits of Legality and the United Nations Security Council: Applying the Extra-Legal Measures Model to Chapter VII Action

Abstract:
The United Nations Security Council (UNSC) is, in many ways, a unique institution. It exercises legislative, judicial and executive powers; operates with few legally binding checks and balances and has even been described as being ‘unbound by law’. The Council has broad powers to maintain international peace and security, most notably under Chapter VII of the UN Charter, and its decisions are binding on UN members. At the same time, some of the Council’s actions have been labelled as ultra vires and the lack of a binding, legal oversight mechanism to reign in Council action has been decried. Accepting that there is a difficulty in imposing legally binding checks and balances on the UNSC, this article argues that approaching the Council’s Chapter VII powers as a form of emergency powers may help to illuminate the role that non-legal restraints can play in curbing its power. In particular, this article uses Oren Gross’ ‘extra-legal measures model’ to conceptualize the Chapter VII regime and restraints upon it. It shows how the extra-legal measures model offers a descriptive account of UNSC action under Chapter VII and then builds on the gaps in the application of the model to the Council to highlight areas for the development of better restraints, in particular, in areas that may be missed by a traditional legal analysis.

In ‘The Limits of Legality and the United Nations Security Council: Applying the Extra-Legal Measures Model to Chapter VII Action’, Devon Whittle analogizes the United Nations Security Council’s Chapter VII powers to domestic emergency powers. He then seeks to apply the extra-legal measures (ELM) model of emergency powers, which I developed some 20 years ago, to exercise by the Council of its Chapter VII powers. This brief comment seeks to expand the discussion of ELM in international affairs beyond the collective security system by exploring the application of ELM in the setting of unilateral humanitarian intervention.

Abstract:
A large literature assumes that alliances entangle the United States in military conflicts that it might otherwise avoid. Since 1945, however, there have been only five cases of what might be characterized as U.S. entanglement—the 1954 and 1995–96 Taiwan Strait crises, the Vietnam War, and the interventions in Bosnia and Kosovo in the 1990s—and even these cases are far from clear-cut. U.S. entanglement is rare because the United States, as a superpower with many allies, is capable of exploiting loopholes in alliance agreements, sidestepping commitments that seriously imperil U.S. interests, playing the demands of various allies off of each other, and using alliances to deter adversaries and allies from initiating or escalating conflicts.

396. A U.S.-China Grand Bargain? The Hard Choice between Military Competition and Accommodation

Abstract:
Despite the intense focus on China's rise, the United States has yet to confront the most challenging question posed by this power shift: Should it pursue a strategy of limited geopolitical accommodation to avoid conflict? U.S. policy continues to focus almost entirely on preserving the geopolitical status quo in Northeast Asia. Given the shifting power balance in Asia, however, there are strong theoretical rationales for considering whether significant changes to the status quo could increase U.S. security. A possibility designed to provide the benefits of accommodation while reducing its risks is a grand bargain in which the United States ends its commitment to defend Taiwan and, in turn, China peacefully resolves its maritime disputes in the South China and East China Seas and officially accepts the United States' long-term military security role in East Asia. In broad terms, the United States has three other options—unilateral accommodation, a concert of Asian powers, and the current U.S. rebalance to Asia. Unilateral accommodation and the rebalance have advantages that make the choice a close call, but all things considered, a grand bargain is currently the United States' best bet.

Abstract:
This article examines certain questions and challenges pertaining to the Russian Federation’s illegal annexation of Crimea in the domains of security and the violation of both property rights and human rights, abuses of which are systemic in the region. The issues I will discuss, pertaining to the illegal nationalization of private and state property in the annexed region of Ukraine, are problems that entangle the Russian Federation in complex land relations, which have the potential to fuel conflict. This article examines human rights violations linked with the annexation of the Crimea. Problems have arisen concerning the persecution of different ethnic and national groups—namely, Crimean Tatars and Ukrainians—by Crimean and Russian authorities. Currently, both Ukraine and the international community lack significant opportunities to influence Crimea’s politics and economy.

On April 14, 2015, a Japanese court ordered a halt to the government’s plan to restart the Takahama Nuclear Power Plant. The ruling cited safety fears, whereas the Japanese nuclear regulatory watchdog had given the opera on its consent. There are currently 48 commercial reactors in Japan, all of which remain offline a er the Fukushima nuclear accident in 2011. The Japanese government has been cri cized for its insistence on viewing nuclear energy as an important base‐load power source despite its official policy of reducing dependence on nuclear energy. But restar ng nuclear reactors—assuming that they meet the revised safety requirements—does not necessarily contradict that policy inasmuch as the transparency of the safety review process is guaranteed. Moreover, the issue is intertwined with broader concerns that extend beyond Japan’s borders, including U.S.‐Japan rela ons and the interna onal nonprolifera on regime. It is this interna onal context, o en overlooked in Japan and elsewhere, that makes it unrealis c and rather dangerous for Japan to immediately abandon nuclear energy altogether.

The security risks of post-Soviet Central Asia are pronounced and therefore pres- ent on the agendas of most international actors, including the US, Russia, and China. The EU is also concerned, although it has hitherto not been known for political success in the region, especially in terms of security. Indeed, the EU’s approach to the region – oriented toward transformation, liberalization, and de- mocratization – has been largely labeled a failure, with minimal impact and prog- ress. Against this background, this article will review and discuss the nature of the threats to Central Asia’s security, establish the extent of the EU’s actual “failure” by examining the distinct characteristics of the EU’s security approach, and, finally, reflect on how European policy can have an impact on the local security situation in the future.

Abstract:
After Turkish fighter jets shot down a Russian warplane 24 November 2015, tensions between the two countries came to a head, particularly given their very different political positions on the Syrian issue. With Russia an ally of the Assad regime, and Turkey an ally of the opposition, the downed Russian jet has been the latest in a string of incidents that have threatened otherwise growing economic and trade cooperation between the two countries. This position paper argues that escalation of the tension between the two sides will have ramifications not only for the two parties involved, but also for the Syrian crisis.
