Abstract:
After more than two decades of UN negotiations, global greenhouse gas emissions continue to rise, with current projections indicating the planet is on a pathway to a temperature increase of approximately 3.2°C by 2100, well beyond what is considered a safe level. This has spurred scientific and policy interest in the possible role of solar radiation management and carbon dioxide removal geoengineering activities to help avert passing critical climatic thresholds, or to help societies recover if global temperatures overshoot expectations of safe levels. Marine geoengineering proposals show significant diversity in terms of their purpose, scale of application, likely effectiveness, requisite levels of international cooperation and intensity of environmental risks. This diversity of marine geoengineering activities will likely place significant new demands upon the international law system to govern potential risks and opportunities. International ocean law governance is comprised of a patchwork of global framework agreements, sectoral agreements and customary international law rules that have developed over time in response to disparate issues. These include maritime access, fisheries management, shipping pollution, ocean dumping and marine scientific research. This patchwork of oceans governance contains several bodies of rules that might apply in governing marine geoengineering activities. However, these bodies of rules were negotiated for different purposes, and not specifically for the governance of marine geoengineering. The extent to which this patchwork of rules might contribute to marine geoengineering governance will vary, depending on the purpose of an activity, where it is conducted, which state is responsible for it and the types of impacts it is likely to have. The 2013 amendment to the London Protocol on ocean dumping provides the most developed and specific framework for marine geoengineering governance to date. But the capacity of this amendment to bolster the capacity of international law to govern marine geoengineering activities is limited by some significant shortcomings. Negotiations are under way to establish a new global treaty on conservation of marine biodiversity in areas beyond national jurisdiction, including new rules for area-based management, environmental impact assessments and capacity building/technology transfer. A new agreement has the potential to fill key gaps in the existing patchwork of international law for marine geoengineering activities in high-seas areas. However, it is also important that this new treaty be structured in a way that is not overly restrictive, which might hinder responsible research and development of marine geoengineering in high-seas areas.

62. The Evolving Singapore Agrifood Ecosystem

Abstract:
The Singapore agrifood ecosystem is fast changing from one focused primarily on food security to one which also addresses a new economic sub-sector for export of processed food and “disruptive technologies”. Recently there has been a marked convergence of various technologies including FoodTech, AgTech, FinTech and MedTech. In 2019, exciting initiatives were announced which included the development of a new 18 ha AgriFood Innovation Park (AFIP), a new food security strategy of 30% food self-sufficiency by 2030, the launch of the Enterprise Singapore backed Seeds Capital investment for several new AgriFoodTech Accelerators and the launch of the new Singapore Food Agency (SFA) under the Ministry of Environment and Water Resources (MEWR). All these have come at a time when there is an increasing number of new startups and commercial enterprises engaged in farming and food processing, including indoor plant factories growing a range of fruit and vegetables and land-based fish farms. How do all these developments compare with similar ecosystems in successful agrifood countries like the Netherlands? Building on a previous NTS INSIGHT on developing a successful urban food cluster, this INSIGHT will explore ways to successfully integrate the key elements such as research and development; retail and consumers; human resources and education; financing; and policy. It concludes with some foresighted insights on the future direction of the ecosystem.

Abstract:
International garbage disputes are rare. Lately, however, the world witnesses waves of newsworthy trash saga. From the Philippines shipping containers of rubbish back to Canada, to Malaysia planning to return tons of garbage back to countries of origin, to China’s near-total ban of plastic waste import, it is hard not to wonder whether this is a real sign of rising environmentalism. Have countries begun to think that the environment is worthy of a similar priority as the economy? This Insight argues that behind the seemingly growing pro-environment attitudes, it still remains to be seen whether this trend is sustainable in the long run. Considering that the global waste trade is a multi-billion dollar industry, the balance may tip to favour the economic activities again once the dust has settled back. The paper first looks at a brief description of the global waste trade industry. It then discusses some of the contemporary development in the global waste industry particularly on the issues of waste smuggling and China’s plastic waste import ban. It describes related experiences in Indonesia, Malaysia, Vietnam, the Philippines and Thailand.

64. The Amazon Is a Carbon Bomb: How Can Brazil and the World Work Together to Avoid Setting It Off?

Abstract:
The fires in Brazil’s Amazon rainforest in the summer of 2019 represent a government policy failure over many years, especially recently, as Brazilian public agencies that are supposed to curb man-made fires have been deliberately weakened. In keeping with his far-right nationalist campaign promises, President Jair Bolsonaro’s government has intentionally backed away from efforts to combat climate change and preserve the environment, which has emboldened farmers, loggers, and other players to engage in predatory activities in the rainforest. De Bolle calculates that if the current rate of deforestation is maintained over the next few years, the Amazon would be dangerously close to the estimated “tipping point” as soon as 2021, beyond which the rainforest can no longer generate enough rain to sustain itself. The tragic fires have demonstrated that protecting the Amazon rainforest is a global cause. The international attention provides an opportunity for the governments of Brazil and the United States to stop denying climate change and cooperate on strategies to preserve the rainforest and develop ways to sustainably use its natural resources. The international community should revive and expand the Amazon Fund to invest in ways to reduce deforestation through the possible use of payments for environmental services. Brazil should adopt and enforce regulations on land use in the Amazon region while cracking down on illegal uses, such as logging and mining, and should restore conditional rural credit policies to fight deforestation.

Abstract:
Although in June, Estonia along with Poland, the Czech Republic, and Hungary blocked a political consensus statement in the European Council regarding the EU’s goal to achieve climate neutrality by 2050, in October, the country accepted the deadline. Estonia, despite relying on burning oil shale, has decided to embark on a difficult energy transition. This means that, among the EU Member States, support for ambitious EU climate policy is growing.

66. Free Willy! Japan Resumes Commercial Whale Hunting

Abstract:
In late 2018, Japan announced that it would withdraw from the International Convention on the Regulation of Whaling and leave the International Whaling Commission. It did so due to its disapproval of the ban on commercial whaling, which has been in force for the Parties of the Convention since 1986, and to its decision to resume whalle hunt since the summer of 2019. This reflection first gives an overview of the evolution and the structure of the international legal regime related to whaling and of the history of Japan’s relationship with this regime. It then shows that the Japan’s attempt to justify the resumption of commercial whaling by the principle of sustainable use of living marine resources cannot be successful for both practical and normative reasons.

Abstract:
States face the challenge of developing institutions to govern the activities of social actors when an area under their control becomes the target of increased extractive activities. National and local public regulations safeguarding the environment, the assignment of extractive rights to individuals or companies, and handling of ensuing conflicts are developed in an institutional gray zone. This paper analyzes how informal institutions developed in early period become hybrid institutional entanglements that depend largely on configurations of power. It does so by looking at two cases in Peru: Water extraction in Ica, mostly by large companies and gold mining in Madre de Dios, mostly by small scale miners. Taken together, these cases show the institutions resulting from state governance of extractive activities depends heavily on the agency and political leverage of the state but also of other social actors.

Abstract:
EuroPACE is an innovative tool designed to make home renovation simple, affordable and reliable for all Europeans by combining affordable financing with people-centric technical assistance. EuroPACE offers 100% up-front financing that can be repaid over a long term of up to 25 years. The innovation lies in the collection and repayment mechanism – financing is attached to the property and is repaid regularly with charges linked to a property. Homeowners are offered logistical and technical support throughout the process and access to trained and qualified con-tractors. Thus, EuroPACE overcomes the main barriers to home renovation – lack of financing, technical knowledge and complexity of the works. The concept of EuroPACE is inspired by the success of a financing model called Property Assessed Clean Energy (PACE), launched in California in 2008. In the United States (US), the PACE market reached over USD 6 billion in funded projects, including the retrofit of over 220,000 homes, which resulted in more than 50,000 new local jobs and the creation of hundreds new companies.EuroPACE combines the best practices from the US PACE market with project partners’ substantial experience in improving energy efficiency in European buildings. EuroPACE is a three-year project that intends to assess market readiness, deploy a pilot programme in Spain and scale across Europe to four leader cities. A two-phase research (firstly – legal & fiscal readiness, and secondly – market demand) has been carried to assess the overall readiness for adaptation of this model across the European Union (EU). This document is the second phase of the EuroPACE readiness assessment developed to identify European countries most suited for EuroPACE implementation. It complements the legal and fiscal assessment by focusing on the “demand dimension” by analysing local needs for energy efficiency (EE) and renewable energy sources (RES) in residential building renovation of seven selected countries. Based on the results of legal and fiscal analysis of the EU28 MS, in October 2018 the Steering Committee Group of the EuroPACE Horizon2020 (H2020) project chose seven countries: Austria, Belgium, the Netherlands, Italy, Poland, Portugal, and Romania, for the second phase of evaluation. These countries were selected based on the scoring outlined in D2.1 and two additional considerations developed by the Steering Committee Group. First, a diverse geo-graphical distribution of the countries was an important element for the selection of these seven countries. Secondly, the knowledge and expertise of the Steering Committee Group about the national potential market opportunity was taken into consideration during the selection process. While in Austria a similar mechanism has already been tested but was unsuccessful, the country still has been chosen for further analysis. In Belgium, despite being a federal state, there is a strong local and regional interest in new financial mechanisms designed to upscale residential retrofits across the country. In the Netherlands, asset-based financial instruments are currently being discussed at the national level, which opens a window of opportunity for EuroPACE to be tested in the country. As for Italy, although the property-taxation system is far from stable, potential synergies with successful programmes like Ecobonus or Sismabonus should be explored. In Poland, nearly 70% of the 6-million residential buildings need significant energy efficiency overhaul; these buildings contribute to some of the worst air quality across the EU leading to approximately 47 thousand premature deaths annually. Portugal, given its Mediterranean climate, proves a great potential not only for EE, but also prosumer RES development, given that current incentives are far from sufficient. Romania has been chosen mainly because of its highest home-ownership rate across the EU and the most institutionalised property-related taxation, possibly setting a stable base for EuroPACE being collected alongside existing charges.

70. Historical injustice and “Bogus” claims: Large infrastructure, conservation and forest rights in India

Abstract:
This essay examines the role of India’s 2006 Forest Rights Act in the procedures that regulate transfer of forest land to large infrastructure projects. Specifically, it shows the gap between the legally mandated requirements and how these are implemented in project approval processes. This is illustrated through a case study of the coal mining approvals in the Hasdeo Arand forest region in the central Indian state of Chhattisgarh. The essay also outlines the different actors who have influenced the discourses on forest rights of Adivasi and other forest dwelling communities and what they identify as factors that challenge the implementation of this law on the ground. It juxtaposes this analysis in the context of the recent decision of the Supreme Court of India on eviction of forest dwellers and examines whether that would bring in any structural change in the way the law is implemented.
