Abstract:
The purpose of this Policy Brief is to recommend a framework for humanitarian emergencies that would enable the Australian government to provide a streamlined, equitable, predictable and effective response to assist people facing a real risk of persecution, extreme danger or other serious harm to find safety and protection in Australia. It is informed by Australia’s practices over time, as well as comparative practices internationally. The framework is designed with the Australian context in mind, but it could also be used as a model for other countries.2 It encompasses both legal protection (visas and access to support) and physical protection (evacuation and reception). In a crisis, moving away from danger is a natural and rational human response. Whereas some people will have the financial resources, immigration documentation and networks to facilitate their rapid departure, others may be unable to move or find themselves ‘trapped’ by their circumstances. They may have acute protection needs that cannot be addressed unless they can reach a place of safety. In some cases, evacuations will be a necessary first step; in others, people will be able to move on their own. In all cases, non-citizens will require visas and identity documents to move lawfully. As such, this Policy Brief has a particular focus on visa pathways, since they are the gateway to everything else. Four recent conflicts in Afghanistan (2021–), Ukraine (2022–), Sudan (2023–) and Gaza (2023–) have seen large numbers of people unable to leave dangerous situations. In each case, Australia’s humanitarian response has been different. For some groups, acquiring a visa to escape and travel to Australia has been relatively easy; for others, it has been impossible. Varying visa entitlements also mean that, even among those who do manage to escape, some people have work rights, health entitlements and access to a wide range of services, while others are barely surviving. Concerns have been expressed by the refugee sector, affected communities, experts and Parliamentary inquiries about these divergent and, at times, inadequate approaches. As the Refugee Council of Australia has observed, ‘the measures have been uneven, unpredictable and in some cases, created significant gaps in critical support including access to health, education and employment’.3 This Policy Brief proposes a framework for humanitarian emergencies which could be activated in whole or in part, depending on the circumstances. The framework would be additional and complementary to Australia’s existing Refugee and Humanitarian Program, and it would provide an equitable and robust foundation to enable agile responses that could be quickly tailored to specific conditions. It envisages both physical and legal mechanisms to facilitate people’s safe and swift departure; clear lines of authority; processes for consultation across different levels of government and with relevant stakeholders; identified reception facilities for evacuees (if physical evacuation is necessary); and a visa with appropriate supports and pathways to durable solutions,4 including for affected individuals who are already in Australia when a humanitarian emergency is declared.5 To be effective, the framework would require multi-sectoral engagement, planning and coordination, particularly in terms of facilitating arrivals and ensuring that people in Australia are properly supported. Its implementation must be human-centred and supported by trauma-informed approaches that recognise and promote people’s dignity, agency and human rights, with special attention given to those with particular needs or in vulnerable circumstances.6 While existing frameworks, such as the federal Australian Government Crisis Management Framework (AGCMF)7 and state-based DISPLANS may be instructive, none provides an adequate template for present purposes (see Recommendations 2 and 3). The recommendations in this Policy Brief align with and complement proposals by other key actors in the refugee sector, most notably the Refugee Council of Australia and Settlement Services International, and we thank them for their positive engagement and insights. Australia has an opportunity to envision a bold, dynamic and forward-looking framework to protect people in humanitarian emergencies. It is a chance to build upon good practices from historical and comparative responses, signalling Australia’s clear commitment to international solidarity and responsibility-sharing.8 Furthermore, as a leading resettlement state, Australia has the capacity to demonstrate how States can respond to humanitarian emergencies in a timely, well considered and compassionate manner.

14. Protected areas, indigenous communities, deforestation and the role of institutions: evidence for the lowlands of Bolivia

Protected areas and indigenous communities play a crucial role in controlling deforestation, which is responsible for carbon emissions related to land use and land use change, contributing to global warming and climate change. However, the effectiveness of protected areas is conditioned by their administration and the quality of the institutions in their countries. In this paper, I will analyze the effectiveness of protected areas (Both at the national and sub-national levels) and indigenous territories and the institutions' role in the case of Bolivia's lowlands. I computed deforestation rates for four different periods between 1986 and 2021 to test the impact of institutions on different types of protected areas by using satellite images at 30m resolution and combining them with official data on protected areas and indigenous communities, which includes specific locations and dates of creation. Using a spatial regression discontinuity design, the results show that protected areas at the national level are the most effective in controlling deforestation, particularly after the creation of institutions taking care of them. Departmental protected areas have some impact on preventing deforestation, while municipal ones have no influence. For indigenous communities, there was a significant effect on reducing deforestation with the first reservations created, but the effect wears off over time. Regarding mechanism, being close to cities and routes is a threat for indigenous communities and departmental PAs, while it is an advantage for national PAs. Finally, protected areas and indigenous communities show, in general, greater levels of deforestation when they are exposed to cattle ranching settlements, mines, and oil wells.

15. Smart Operations: Rethinking Operational Art To Effectively Protect Civilians

The changing nature of armed conflict, where most of the victims are civilians accompanied by the devastation of civilian objects, requires rethinking the elements of operational art, which are adversary-centric at the expense of noncombatants who are ubiquitous in present-day battlefields. Respect for, and compliance with International Humanitarian Law (IHL) is a panacea to violations against noncombatants in contemporary warfare. The principle of distinction is a sine qua non for the protection of civilians. The rules of targeting are at the heart of IHL, while the principle of distinction is the keystone in targeting guided by rules of engagement as the practical application of the legal constraints to combat. As such, the cognitive skills of the military in IHL are vital to the prevention of civilian death, mitigate incidental injury, and limit collateral damage in hostilities. This paper addresses the issue of how to mitigate civilian harm in contemporary hostilities through discourse analysis and a desktop survey. It is noted that the failure to master IHL at the operational and strategic levels in professional military education—as evidenced by doctrinal gaps in the application of operational art and military decision-making processes—renders the integration of humanitarian norms utopian. The oversight also reinforces the reticence to mitigate civilian harm in modern-day conflicts. This paper, inspired by prospect theory in military decision-making processes, posits that effective civilian protection requires smart operations involving a framework for enhanced risk analysis and mitigation of civilian harm in military decision-making processes. In executing smart operations, belligerents demonstrate effective integration of IHL into strategy, operations, and tactics, thereby enhancing prospects of return to peace.

Over the last decade, UN peacekeepers and their beneficiaries have been the targets of threats from hostile actors armed with small arms and light weapons, rockets and mortars, IEDs, and related weapons. Assessing and countering these threats requires peacekeepers to have the capacity to focus on hostile actors’ access to and (mis)use of weapons and the destabilising effects of arms proliferation. Exploiting Evidence, Improving Protection: Weapons Technical Intelligence in UN Peace Operations is a new Briefing Paper from the Small Arms Survey’s Security Assessment in North Africa (SANA) project. The paper discusses the current and possible future deployment of weapons technical intelligence (WTI) roles and activities in UN—as well as hybrid and non-UN—peacekeeping operations. It also examines the contributions that WTI could make, if leveraged, for situational awareness, force protection, and mandate implementation, including the protection of civilians and human rights investigations.

Femicide and insufficiently addressed gender-based violence represent major security concerns in Kosovo, yet they have not been adequately prioritized as immediate issues by the full spectrum of state mechanisms. Activists in Kosovo have consistently demanded that gender-based violence be declared and treated a national emergency, a plea that state institutions have not taken into consideration. Within just five days in April 2024, two women in Kosovo were victims of femicide, murdered by their partners. Gender-based violence and femicide pose significant security threats to women. From January to March 2024, 698 cases of gender-based violence were reported to the police, compared to 2,638 cases reported throughout 2023. Despite the high number of reported cases, many cases remain unreported due to the complex socio-economic challenges’ women face across different regions of Kosovo. There are several reasons highlighting the inadequacies in addressing the prevention of gender-based violence. Recent research conducted by the Kosovo Centre for Security Studies elaborates on several problems concerning gender-based violence in Kosovo. There are some of them: Women’s trust in security and justice institutions is critical for reporting gender-based violence. However, the leniency of the judicial system towards perpetrators and the prolonged duration of domestic violence cases discourage women from seeking justice. There is a lack of sensitivity and expertise among law enforcement authorities, especially in rural areas, to handle genderbased violence cases effectively. The absence of property ownership among women is a significant barrier to their economic independence and security. Despite legal provisions for equal property rights, women often relinquish their inheritance, leaving them with limited resources and options when facing violence. This lack of financial autonomy leaves women in a troubling situation where they may feel compelled to return to their abusers. Many women withdraw their complaints of gender-based violence due to third-party interventions, often under family pressure. There is a tendency among family members and officials to blame women for reporting abuse, further discouraging them from seeking help. Women reporting domestic violence often endure double discrimination from institutions, society, and their families. There is limited information about rights and available support services for victims of gender based violence in Kosovo. The lack of awareness intensifies feelings of vulnerability and exacerbates the sense of helplessness when seeking solutions. There is also insufficient investment in support services for victims and consequences for perpetrators. Insufficient and unstable funding for shelters poses a significant challenge to supporting survivors of domestic violence. Without adequate resources, shelters struggle to maintain essential services and meet the increasing demand for their services. There is also a lack of sustainable institutional support for victims, leading some to return to their abusers. Addressing gender-based violence and femicide requires a holistic approach from all institutions involved in handling cases arising from diverse circumstances. In this analysis, we aim to examine the shortcomings in implementing protection orders for victims and the physical protection of shelters and the Centre for Social Work (CSW) from perpetrators.

20. Collective Protection for Communities and Rights Defenders at Risk: Lessons from Grassroots Advocacy in Colombia

Rights defenders around the world face unrelenting violent reprisals for their work protecting marginalized communities and their territories. Some governments respond by committing to protect these citizens at risk—mainly with individualized, police-style safeguards. Colombia’s government has Latin America’s largest protection agency by far and has gone beyond its many individual measures to also promise collective protection to communities at risk. In Colombia, the Community Council of the San Juan River region (ACADESAN), defends the rights of its 72 Afro-Colombian communities in areas affected by armed conflict. It has worked to hold the government accountable for delivering on its legal and policy commitments to protect communities at risk by providing comprehensive, collective measures. This Accountability Note describes ACADESAN’s breakthrough advocacy campaign for collective protection. It shares insights relevant for efforts to protect rights defenders and communities that go beyond conventional measures. It is based on the story told in Spanish by Mauricio Parra Bayona, ACADESAN human rights advisor, in his Accountability Working Paper, and the prefaces to that paper by former ACADESAN representative Elizabeth Moreno Barco and Jonathan Fox of ARC. Parra reflects on how collective protection must further be adjusted to better serve other at-risk communities and organizations in Colombia.
