Abstract:
Residents of the beleaguered country desperately need electricity, but a U.S.-Arab scheme carries complications that could benefit Syria's Assad regime. The Lebanese people have endured painful reductions in electricity over the last two years, and now the lights are on for just hours a day. To address this dire situation—and counter a Hezbollah initiative to import Iranian energy products to Lebanon—the United States and its Arab partners are pursuing a complex two-part scheme, with the first involving excess Jordanian electricity and the second, although not yet public, relying on natural gas originating in Egypt and Israel. But both components would involve energy transiting Syria and potentially benefiting the Assad regime, which is under heavy U.S. and international sanctions for its wartime abuses. In this timely Policy Note—richly illustrated with maps—former U.S. State Department senior advisor and NSC director Andrew J. Tabler and his Washington Institute coauthors disentangle the current U.S.-Arab proposal, including how it might interact with the anti-Assad sanctions regime. They also offer alternative avenues that avoid Syria altogether, such as using offshore LNG platforms and delivering to Lebanon sustainable energy systems, from solar panels to geothermal technology.

Tax avoidance by multinational corporations has become a central feature of the world economy. After decades of opposition, the US wants to set a global minimum corporation tax rate and limit tax avoidance, but it will need all of Europe to stand behind it. A historic 130-country OECD tax agreement is giving some hope but both sides of the Atlantic will need to confront deeply rooted interests if they want to implement the deal and build a new cooperative tax reform framework.

Abstract:
Managing and adapting to flood risk is an increasing concern of policymakers globally, as anthropogenic climate change contributes to sea level rise and the rising intensity and frequency of coastal storms. Moreover, it is critically important that policymakers design and implement equitable adaptation processes that are based in environmental justice principles. In the United States, the primary instrument for flood risk management is the National Flood Insurance Program (NFIP)—but the program already suffers from debt, low participation rates, outdated flood risk assessments, and myriad other structural issues. By integrating several models of policy development, this analysis offers explanations for why NFIP reform attempts of the past decade have repeatedly failed and offers the present moment (in the early months of the Biden Administration and as the pandemic crisis continues) as a potential policy window for realigning reform efforts. Achieving true NFIP reform remains crucial to ensuring that all coastal residents have affordable options for low-risk housing, despite the expected growth in high-risk flood zones.

Gary Clyde Hufbauer (PIIE) Policy Brief21-5 March 2021 Photo Credit: REUTERS/Denis Balibouse One economic argument for government subsidies is that they are necessary to compensate firms and industries for benefits they provide to society at large but cannot capture in the prices they charge for goods or services. For example, subsidies to renewable energy are defended because renewable energy limits carbon emissions. When a major economy subsidizes extensively, however, its trading partners are drawn into the game, with losses all around. As the prisoner’s dilemma suggests, a better outcome would entail mutual restraint. But the goal of mutual restraint is no less difficult in international trade than it is in international arms control. Both the European Union and the US federal system try, in different ways, to regulate industrial subsidies. Hufbauer examines efforts to contain unjustifiable subsidies and proposes modest improvements, bearing in mind that as countries struggle to overcome the global economic downturn resulting from the COVID-19 pandemic, there is little appetite for restoring a free market economy—one in which firms compete with minimum government assistance or regulation. Selective upgrading of the rulebook may nevertheless be possible.

35. Making a Better Open Skies Treaty

Abstract:
The US withdrawal from the Treaty on Open Skies was motivated by ideological considerations within the Trump Administration. In response, Russia announced its intention to withdraw on January 15, but has not yet notified the depositaries of the treaty to begin the six-month clock. If the treaty is to be sustained, its two main members must reconsider these decisions. This paper proposes ideas as to how the Biden Administration may wish to re-join the treaty, how Russia may be persuaded to stay in it, and also steps that the other treaty members can take to facilitate these objectives. Going further, the paper argues that the treaty, which is now almost 30 years old, could be strengthened in its operations and applied in other contexts. Proposals are advanced in the paper as to how all of this might be done in a phased manner, with basic steps required to sustain the treaty coming first and then more ambitious reforms being considered over time.

Abstract:
This report examines Chinese views about the military balance of power between China and the United States in the Western Pacific. It argues that while there is no single “Chinese” view on this topic, Chinese analysts tend to agree that 1) the gap between the two militaries has narrowed significantly in recent years, 2) the Chinese military still lags in important ways, and 3) Chinese military inferiority vis-à-vis the U.S. increases the further away it operates from the Mainland. In terms of specific areas of relative strength, the Chinese military has shown the greatest improvements in military hardware, but has farther to go in the area of jointness, training, and other military “software.” Nevertheless, despite continued criticism from senior civilian leaders, training quality has likely improved due to a greater focus on realism, and recent military reforms have, to a degree, improved the prospects for jointness.

Many may recognize me as the Black diplomat who ultimately fled the State Department after being harassed by U.S. Customs and Border Protection officials while crossing the border into the country where I was born. At the age of 26, I was diagnosed with debilitating mental health conditions and left traumatized. But I am not my trauma— I am a friend, sister, daughter. A person. I am now 28 years old. This year has been bittersweet for me. My grief, disappointment, rage, and sadness are not just personal, but as a Black woman in America, I’ve grappled with the question of how do I grieve a personal loss that is also systemic?

38. The Fall of Chile

Following the failed Marxist experiment of Chilean President Salvador Allende, a free‐​market revolution led by the so‐​called Chicago Boys in the 1970s and 1980s created the conditions necessary for the country to experience an “economic miracle” that captured worldwide attention.1 As Nobel laureate economist Gary Becker (1997) put it, Chile became “an economic role model for the whole underdeveloped world.” This performance, said Becker, “became still more impressive when the government was transformed into a democracy.” Along the same lines, Nobel laureate economist Paul Krugman argued that the reforms introduced by the Chicago Boys “proved highly successful and were preserved intact when Chile finally returned to democracy in 1989” (Krugman 2008: 31). Indeed, from 1990 to 2010 a left‐​wing coalition called “Concertación” came to power. Despite having been comprised of opponents to the military dictatorship and by many former members of Salvador Allende’s government, Concertación kept in place the foundations of the free‐​market system. A pragmatic view prevailed, leading to the recognition and adoption of the economic legacy of the Pinochet years.

39. Qualified Immunity: A Legal, Practical, and Moral Failure

Abstract:
Qualified immunity is a judicial doctrine that protects public officials from liability, even when they break the law. The doctrine has no valid legal basis, it regularly denies justice to victims whose rights have been violated, and it severely undermines official accountability, especially for members of law enforcement. Accountability is an absolute necessity for meaningful criminal justice reform, and any attempt to provide greater accountability must confront the doctrine of qualified immunity. This judicial doctrine, invented by the Supreme Court in the 1960s, protects state and local officials from liability, even when they act unlawfully, so long as their actions do not violate “clearly established law.” In practice, this legal standard is a huge hurdle for civil rights plaintiffs because it generally requires them to identify not just a clear legal rule but a prior case with functionally identical facts.

2020 is the 75th anniversary year of the United Nations (UN), and it has already shaped up to be a year of unprecedented international shocks and potential for transformation, from COVID-19’s impact to the current mobilization for racial justice in many areas of the world. What does this mean for global trust in international cooperation and multilateral institutions? This briefing by Karina Gerlach and Robert Kang examines recent global polling data, finding a growing demand for international cooperation but diminished trust in international institutions to play a role in the response to COVID-19. It also looks at shifts in member state leadership and perceptions of United States-China rivalry, arguing that middle power alliances and regional networks offer a path forward for international cooperation even in difficult circumstances.
