2. Strengthening Implementation of the Uyghur Forced Labor Prevention Act

Abstract:
Since 2017, the Chinese Communist Party (CCP) has carried out a comprehensive campaign against the Uyghurs, a Muslim minority group predominately based in Xinjiang, China. Beijing is holding an estimated 1.8 million Uyghurs in political reeducation camps, subjecting more than 3 million to some form of forced labor, and seeking to reduce the Uyghur population through forced abortions and sterilizations. Because of this and other evidence, the United States issued an atrocity determination declaring that Uyghurs face ongoing genocide and crimes against humanity. The atrocity determination was incredibly important as it spurred follow-on action from the US and other governments. The passage of the Uyghur Forced Labor Prevention Act (UFLPA) was one of the more powerful actions following the US determination. The UFLPA created a “rebuttable presumption” stating that the government would bar all goods produced “wholly or in part” with Uyghur forced labor from entering US markets. The UFLPA was signed into law in December 2021 and enforcement provisions went into effect in June 2022. Now, more than two years after its passage, trendlines are emerging, and policymakers can now evaluate the law’s effectiveness and ascertain new means for mitigating Uyghur forced labor. The CCP has not stopped targeting Uyghurs, and in fact has subjected even more of them to forced labor. Today, the CCP operates what some analysts believe is the largest state-sponsored forced labor program in the world. Given the CCP’s ongoing exploitation, the onus is on the US and the international community to curtail this egregious practice. At a minimum, democratic leaders need to ensure that citizens of the free world are not inadvertently supporting the continuation of these abuses. For the UFLPA to be maximally effective, Washington should complement it with comprehensive sanctions implementation and a secondary sanctions regime that targets entities aiding and abetting in the CCP’s enslavement of Uyghurs. Moreover, other countries need to close their markets to goods produced with Uyghur forced labor. To that end, the US and other countries can coordinate better to implement strong measures similar to the UFLPA. Perpetrators of Uyghur forced labor need to pay financially for their crimes through fines and forfeiture. Finally, the US should offer financial remedies to help survivors of the CCP’s ongoing genocide and crimes against humanity. While the UFLPA was a notable development in the fight against Uyghur forced labor, more has to be done to ensure the end of Uyghur forced labor. The international community needs to join together to hold the CCP accountable and protect Uyghur rights.

Abstract:
Despite frequent disagreement on how to implement freedom of religion, the vast majority of Americans understand the basic religious protection offered by the First Amendment to the U.S. Constitution. Nearly nine in ten Americans (88%) agree that the U.S. government cannot establish an official religion or favor one religion over another, including 68% who completely agree with this statement. Only 11% of Americans disagree with the idea that the government cannot establish an official religion. Overwhelming agreement with this statement is consistent across all demographic groups. Large majorities of all religious groups agree that the U.S. government cannot establish an official religion or favor one religion over another, including white mainline Protestants (94%), white Catholics (90%), religiously unaffiliated Americans (88%), Protestants of color (84%), and white evangelical Protestants (82%).[1] All partisans are equally likely to agree with the statement that the U.S. government cannot establish an official religion or favor one religion over another, including 91% of Democrats, 88% of independents, and 86% of Republicans.

Abstract:
The Religious Freedom Restoration Act (RFRA) was passed by the United States Congress in 1993 to prohibit the federal government from burdening a person’s free exercise of religion. Currently, twenty-one states have also passed religious freedom restoration acts. The use of the RFRA in Burwell v. Hobby Lobby (2014) drew concerns about the law being used to permit discrimination against communities such as religious minorities, nonreligious people, people of color, women, and the LGBTQ community. In February 2019, Representative John Kennedy III and then-Senator Kamala Harris reintroduced the Do No Harm Act to ensure that the RFRA would not be used to permit discrimination.

The Inclusive America Project (IAP) is pleased to publish our new report, “The Politics of Vulnerability: Can Muslims and Evangelicals Find Common Cause in Religious Freedom?” Across all of the fault lines that are polarizing Americans today, one of the thorniest is the relationship between conservative White Evangelical Christians and Muslims, a relationship that has become tied up with broader ideological and political divides facing the country. “The Politics of Vulnerability” explores this relationship and asks how religious freedom can be used as a paradigm to bring Muslims and White Evangelical Christians into conversation with each other over their shared concerns about religious freedom. IAP Fellow for Religious Freedom Asma Uddin argues that the fight over religious freedom is ultimately a fight over America​n identity, and who gets to claim this identity. “The Politics of Vulnerability” summarizes the major findings of two closed-door convenings held by the Inclusive America Project in March 2020 that brought together experts in religious theology, religious freedom, and interfaith work. These meetings were a part of the larger Politics of Vulnerability Project, which seeks to use religious freedom as a framework to bring Muslims and Evangelical Christians in the United States into conversation around their constitutional religious freedom rights, the prominent challenges to those rights, and the impacts that deprivation of those rights would have on both communities and on all other Americans. The First Amendment and its promise of religious freedom protects people of all faiths and none, and is one crucial piece of the puzzle of American religious pluralism.
