Abstract:
A few weeks ago, Montenegro—a NATO member—was hit with a cyber attack that targeted government servers. Montenegro’s outgoing Prime Minister, Dritan Abazovic, initially hedged about potential responsibility for the attack, stating on August 26: “We do not have clear information about the organizers… Security sector authorities couldn’t confirm that there is an individual, a group, a state behind [the attack].” Nevertheless, later that same day officials from Montenegro’s national intelligence agency attributed the attack to Russia. They also implied that the attack was related to Montenegro’s support for Ukraine and push for membership in the European Union. Yet, the extent of Russian involvement in the cyber attack remains ambiguous, which poses significant political and strategic challenges.

92. Implications of the European Union’s Digital Regulations on U.S. and EU Economic and Strategic Interests

Abstract:
In recent months, the European Union has adopted several sweeping digital regulations, such as the Digital Services Act (DSA) and Digital Markets Act (DMA), while proposing a number of new measures—including the Data Act, the Artificial Intelligence Act, and the Media Freedom Act. These regulations will shape, likely quite dramatically, the environment for doing digital business in Europe and beyond. They will have profound implications on the leading U.S. digital service providers designated by the European Union as “gatekeepers”—large digital services providers that are expected to adhere to regulatory requirements—as well as these companies’ hundreds of millions of transatlantic European business and individual customers. By impacting primarily U.S. companies instead of Asian or European ones, Europe’s digital policies will also shape U.S. and European global strategic and national security interests. This study will assess the potential implications of new and proposed EU digital acts on U.S. digital service providers, on their customers in Europe and the United States, and on the EU and U.S. economies and exports.

93. Software Power The Economic and Geopolitical Implications of Open Source Software

Abstract:
Open source plays a central role in software development, both in parallel with proprietary software and increasingly intertwined with it. It has become a major factor for companies’ innovation processes and for the success and popularity of their products. For users, using open source software can alleviate risks stemming from proprietary solutions, including data privacy concerns or trade restrictions. Beyond that, open source is the foundation of critical software bricks and Internet languages and protocols. However, open source is a victim of its own success. It suffers of a lack of resources dedicated to the maintenance of open source components, even though vulnerabilities in open source code can have serious consequences, as illustrated by the Log4Shell vulnerability in December 2021. For these reasons, private companies are investing ever more money and human resources in the development and maintenance of open source software, and acquiring structuring roles in the governance of the ecosystem. This support, however, is not without risk for the open source ecosystem, which is increasingly shaped by the private interests of Big Tech companies. Meanwhile, governments are getting increasingly concerned with the cybersecurity implications of open source software, and with risks not only of accidental vulnerabilities, but also manipulation of codes by criminals and foreign agents. The interest of governments in open source is not new, but it is evolving: governments are no longer only seeking to adopt open source or to develop software solutions, but also to contribute to the financing or even the governance of open source ecosystems, at the national and/or global level. An analysis of the United States, Chinese and European cases show that government involvement in open source is not only pragmatic; it is increasingly politicized, and serves to uphold governments’ ambitions for national security, international influence, or digital sovereignty. The study highlights the dilemmas that emerge, for public authorities, from the tensions between the desire to secure universally used, critical open source components, the desire to develop “sovereign” technologies, and the risk of encroaching on the horizontal and decentralized functioning of open source.

94. Is South Korea vulnerable to EU and US carbon border restrictions?

Abstract:
South Korean exports, especially carbon-intensive products like steel, are increasingly vulnerable to both the European Union’s proposed carbon border adjustment mechanism (CBAM)—set to begin on January 1, 2023—and the proposed Clean Competition Act (CCA) before the US Congress. Schott and Hogan caution that Korean exporters should not count on Korea’s decade-old EU and US free trade agreements (FTAs), nor on the multilateral trading rules of the World Trade Organization (WTO), to protect them from new carbon-based import barriers in key foreign markets. The WTO and the FTAs have broad and loosely defined exemptions for environmental protection. Nor is Korea likely to be shielded by its own cap-and-trade emissions trading system (the K-ETS), because of extensive use of free allowances and large differences between EU and Korean carbon prices. While the threat the EU CBAM poses to Korean exports is imminent, passage of the CCA faces major legislative obstacles. But US imports of Korean steel and other carbon-intensive goods are still subject to climate-related duties at the US border under US unfair trade statutes. The US Department of Commerce has ruled that free allowances issued under the K-ETS (and EU ETS) are implicit subsidies that can be offset by countervailing duties. These charges are in addition to the harsh tariff-rate quotas on imported Korean steel applied under the “national security” authority of Section 232 of US trade law, which are more restrictive than measures imposed against European and other steel exporters. The authors suggest relaxing these US barriers, as they have been for shipments from Europe, in return for Korean participation in the nascent US-EU talks to establish a “Global Arrangement on Sustainable Steel and Aluminum.”

95. Engaging the Pacific Islands is no longer about the why, but about the how

Over the past year, US and European engagement in the South Pacific has noticeably accelerated. Wooing these islands away from Chinese influence is clearly a priority but there are many dimensions to this. The “Blue Pacific” is more than a consortium of scattered islands. They see themselves as large ocean states, which collectively make up the second-largest Exclusive Economic Zone in the world. While they are important as we game out Taiwan scenarios, the peoples of the South Pacific want their region to remain immune from “great-power games.” This calls for a subtle Transatlantic strategy emphasizing partnership. This report acknowledges the mistakes of past engagement strategies, which didn’t approach the region as a coherent whole, lacked sustained and continuous effort, and always came second to other priorities in the Indo-Pacific region.

96. Europe and the Geopolitics of 5G Walking a Technological Tightrope

Abstract:
The acute Sino-American tensions which started in 2018 have been coupled with controversies around 5G technology, exemplified by the spotlight placed on Chinese equipment manufacturer Huawei and the security risks associated with its use. For Europe, the 5G challenge at the international level is drawing a very complex landscape. Just like artificial intelligence, 5G materializes a very strong geopolitical sensitivity around the control of critical technologies. 5G is indeed critical because of its expected quasi-ubiquitous use, the gradual shift towards network technologies based entirely on software, and the potential strengthening of already dominant players (including digital platforms via cloud services). The United States-China rivalry is limiting the European Union’s room for action, against a backdrop of security considerations and low levels of investment. The continent’s various players (the European Commission, the main European powers, private players such as Nokia and Ericsson) have not adopted a uniform stance, reflecting an entanglement of technological dependencies on China and the United States. Meanwhile, the issue of semiconductors, symbolizing both the technological decline and the renewal of the EU’s ambitions, is fully integrated into the development of 5G. These chips constitute the "muscle" of the system and trigger new geo-economic challenges in which Europe must still find its place.

97. The European Union renews its offensive against US technology firms

Abstract:
The European Union's proposed Digital Markets Act (DMA) contemplates extensive regulation of "gatekeeper" digital platforms—firms that perform a "core platform service" in the European Union (defined as online intermediation, online search, social networking, video sharing, electronic communication, cloud services, or online advertising), have a significant impact on the EU internal market, serve as an important gateway between business users and end-users, and enjoy an entrenched and durable position. Although at least one European firm could qualify as a gatekeeper, Hufbauer and Hogan say, the DMA discriminates against American technology firms by singling them out for the label of "gatekeepers." The European Commission’s proposed DMA targets both US tech giants such as Google, Amazon, Facebook, Apple, and Microsoft and smaller (albeit huge) US tech firms such as Airbnb and PayPal. The authors say the EU goal is to confer competitive advantage on European digital firms, breaching the EU commitment to national treatment of foreign firms, violating their intellectual property rights, and imposing high expenses on the "gatekeepers." At the same time, France is planning to enact its own steep barriers against US and other foreign cloud services.

Abstract:
Eight months after the Russian invasion of Ukraine, the US has spent almost three times as much in ‘lethal aid’ to the Ukrainian armed forces than the EU institutions and Member States combined. Beyond the headline figures presented in well-known indices, data are hard to come by in a disaggregated manner. This lack of transparency is problematic both from a public accountability perspective as well as from efforts to ensure greater complementarity in Member States’ support for the needs identified by Ukraine. Therefore, integrating publicly available sources into a more refined dataset of the weapons systems and military-related support promised by Member States to Ukraine is of utmost importance. This CEPS Policy Brief aims to complement the existing narrative regarding the lagging military aid concretely delivered by the EU Member States in comparison to the aid sent by the US and the UK, and to offer possible solutions on where – and how – the EU can plug the shortfalls.

Predictably, this has revived rhetoric on competing political systems and norms, giving rise to a flurry of reporting contrasting Western democracy’s support for the “rules-based international order” vs an informal “alliance of autocracies” led by Russia and China which embrace military might or economic and political blackmail in “a bid to make the world safe for dictatorship”, as recently opinionated the Washington Post.
