81. The future of the CWC in the post-destruction phase

At the 17 th Conference of the States Parties to the Chemical Weapons Convention (CWC) held in November 2012, the subject generating the most debate concerned the place of non-governmental organisations (NGOs) in CWC meetings and whether their role should be rather passive (i.e. 'attend') or be characterised by more active involvement (i.e. 'participate'). The latter option would allow them to address States Parties at meetings or organise side events within (rather than outside) the conference building. Addressing one of the core functions of the disarmament treaty, Libya, Russia and the United States reported in detail on progress and issues affecting the destruction of their respective chemical weapon (CW) stockpiles. Despite the fact that all three countries had missed the ultimate destruction deadline of April 2012, no state raised its flag to comment, question or protest about the delays. When the negotiators of the CWC concluded their business in September 1992 and decided to forward the treaty text to the UN General Assembly (UNGA) for assent, missing the destruction deadlines was universally viewed as one of the worst possible breaches of the CWC. In practice, a robust verification regime combined with permanent in - formation sharing, voluntary transparency beyond the requirements in the Convention, and dialogue over the years yielded commonly approved decisions to extend the destruction deadlines with strict monitoring and reporting requirements. Confident that the holders of the three largest declared CW stockpiles have no malicious intent, States Parties can continue with the implementation of all dimensions of the CWC without recriminations or deadlock.

Here's how to make the case for that approach and why it makes sense: A nuclear-armed Iran is unacceptable. Sanctions are working—they are wrecking the Iranian economy—but they need more time to have their full impact. We can blunt Iran's capabilities by strengthening our allies' missile defense systems. Military strikes now could exacerbate the problem, but all options must remain on the table.

Iran has never had what the West would regard as free, fair, and competitive elections. Some would point to the brief periods following the 1906 Constitutional Revolution and between the end of World War II and 1953, when a CIA-backed coup re-installed Shah Mohammad Reza Pahlavi, as possible exceptions to this rule. The upcoming presidential elections this June will be no such exception, with candidates restricted to eight proven loyalists to the regime. Nevertheless, the vote will be an important barometer of the stability and durability of an embattled regime that is increasingly unpopular domestically and isolated internationally. The elections will also produce a new turn of the kaleidoscope within Iran's shrinking political elite, as existing factions break apart and regroup. The next president is likely to be more moderate in tone, if not in policy, and more competent and less divisive than the outgoing Mahmoud Ahmadinejad. This could have important implications not just for the country's domestic course but for Iran's confrontation with the United States and the international community over the nuclear question.

There is a high risk that someone will use, by accident or design, one or more of the 17,000 nuclear weapons in the world today. Many thought such threats ended with the Cold War or that current policies can prevent or contain nuclear disaster. They are dead wrong--these weapons, possessed by states large and small, stable and unstable, remain an ongoing nightmare. Joseph Cirincione surveys the best thinking and worst fears of experts specializing in nuclear warfare and assesses the efforts to reduce or eliminate these nuclear dangers. His book offers hope: in the 1960s, twenty-three states had nuclear weapons and research programs; today, only nine states have weapons. The possibility of Israeli military action against the Iranian nuclear program has existed since at least 2002. However, beginning in the fall of 2011, Israeli rhetoric and international concerns about military action against Iran have reached unprecedented levels. Israeli Prime Minister Benjamin Netanyahu and Defense Minister Ehud Barak began to proclaim that Iran was nearing a “zone of immunity” to Israeli attack and therefore Israel would have to act soon. In contrast, former heads of Israel's foreign and domestic intelligence services question the utility of such an attack.

Herman Kahn was one of the most eminent nuclear strategists of the early Cold War period. He advised Presidents Eisenhower and Kennedy while working at the RAND Corporation, and also wrote one of the most controversial bestsellers of the era, Thinking about the Unthinkable. Reading it is shocking even today, as one encounters the concepts Kahn made famous, such as megadeath (a nuclear war killing tens or hundreds of millions of people); escalation dominance (threatening to blow up the world if an adversary does not relent); the doomsday machine (US-Soviet nuclear arsenals that, if used, would blow up the world, no matter what leaders might desire); and use 'em or lose 'em (striking first in a nuclear war to destroy the enemy's forces). No wonder the title role in Stanley Kubrick's black satiric film Dr. Strangelove (1964) is reportedly based on the real Herman Kahn. But Kahn himself always said he was merely being realistic, facing directly the terrifying new reality created by the existence of the ultimate weapon.

International diplomacy efforts dealing with Iran's nuclear program continue to fill the daily news headlines. The efforts of P5+1, the International Atomic Energy Agency (IAEA) and the United Nations Security Council (UNSC) have tried, in various formats, to encourage and enforce Iran to comply with the provisions of the Non-proliferation Treaty (NPT) and its Comprehensive Safeguards Agreement (CSA) to ensure that Iran's nuclear program is not used as a cover for the development of nuclear weapons. The challenge of discovering what has taken place as well as currently with Iran's nuclear ambitions is difficult not only because of Tehran's obstructionism, but also because the same nuclear technologies, particularly uranium enrichment and spent fuel reprocessing, can be used for both civilian and military purposes.

Abstract:
U.S. grand strategy, the calculated relationship between means and large ends, needs to be developed and implemented in an international legal context because of the nature of U.S. society and values, and the overriding requirement to prevent nuclear war. Since World War II, successive administrations have conceived of U.S. alliances, partnerships, arms control agreements, and international actions more generally as grand strategy. A central component of U.S. success has been creating, leading, and sustaining a minimum world order that all states have come to see as representing their core interests. International law cannot be and has never been far from U.S. policymaking because Americans have believed that it is essential to the maintenance of the minimum world order necessary for peace and the prevention of nuclear war insofar as it is possible to achieve these goals.
