671. The Dominican Republic's 2000 Presidential Election: The U.S. Role in Supporting the Process

Abstract:
Dominicans elected Rafael Hipólito Mejía Domínguez their president on May 16, 2000. He took office on August 16, 2000. Mejía, the candidate of the Dominican Revolutionary Party (Partido Revolucionario Dominicano — PRD), won 1,593,231 votes or 49.87 percent of the ballots cast in an essentially three-way race with Danilo Medina of the Party of Dominican Liberation (Partido de la Liberación Dominicana — PLD) and former President Joaquín Balaguer of the Social Christian Reformist Party (Partido Reformista Social Cristiano — PRSC). Medina won 24.94 percent of the vote (796,923) to finish second, with Balaguer only fractions of a percentage point behind, at 24.60 percent (785,926). Turnout, at just over 76 percent, was high by historical standards. Although two shooting deaths marred the campaign's closing days, relatively little violence accompanied the voting compared to previous Dominican elections. Since 1994, Dominican electoral law had called for a runoff between the top two vote winners if no candidate passed the 50-percent-plus-one mark, but Medina conceded on May 17, after Balaguer acknowledged that he could not deliver the entire PRSC vote to the PLD in a second round of voting. Balaguer announced, “For the good of the country, we waive our right to participate in a second round.” The country's Central Electoral Board (Junta Central Electoral — JCE) certified Mejía's victory on May 18, 2000.

672. The U.S. Engagement with Colombia: Legitimate State Authority and Human Rights

Abstract:
September 11, 2001, reshaped international relations and had a profound impact on the strategic equation in Colombia. The challenge of what U.S. Secretary of Defense Donald Rumsfeld called “draining the swamp” of terrorism with global links resonated deeply in Bogotá and among the insurgent forces: the Revolutionary Armed Forces of Colombia (Fuerzas Armadas Revolucionarias de Colombia — FARC), the National Liberation Army (Ejército de Liberación Nacional — ELN), and the paramilitaries, among them, the United Self- defense Forces of Colombia (Autodefensas Unidas de Colombia — AUC). Though these groups already appeared on the U.S. State Department's list of terrorist organizations, as of 9/11 they formed part of a broader international threat assessment. Two weeks into 2002, an ill-conceived “peace process,” initiated by President Andrés Pastrana with the FARC in 1999, was r esuscitated at the last minute before an impending military offensive by the government against the FARC was started. President Pastrana, “risking all for peace,” had extended himself, his negotiators, and his government's credibility as far as he could for three years — with nothing to show for such extensive efforts other than his administration's and the Colombian citizens' frustration and virtual surrender to the FARC of national sovereignty over a demilitarized zone ( despeje ) the size of Switzerland, located in San Vicente del Caguán, an area south of Bogotá.

First-quarter GDP grew by 5.8%, the US government announced on Friday, 26 April 2002. The high growth figure will provide sustenance for optimists and help support high stock market valuations. However, the contrast with high-profile corporate earnings disappointments, together with a closer look at sources of demand, suggests a far weaker performance in the rest of 2002 and in 2003.

Abstract:
The largest US-based pension fund last week listed 13 emerging markets that its fund managers will be allowed to invest in. Investment firms appointed by the California Public Employees' Retirement System (CalPERS) will actively manage up to one billion dollars in equity investments in 13 countries and unwind CalPERS' equity positions in markets outside them. As a large institutional investor, CalPERS' decisions have an important signalling role for a variety of institutional funds.

Abstract:
This paper assesses the impact of gender and race on judicial decisions on the federal Court of Appeals, paying particular attention to the institutional nuances of decision-making on three-judge appellate panels within circuits. Our central question is whether and how racial minority and women judges influence legal policy on issues thought to be of particular concern to women and minorities. Proper analysis of this question requires investigating whether women and minority judges influence the decisions of other panel members. We find that the norm of unanimity on panels grants women influence over outcomes even when they are outnumbered on a panel.

676. Building the Dual Earner/Dual Carer Society: Policy Developments in Europe

Abstract:
A new model of work and family life is emerging out of contemporary debates on social citizenship and the characteristics of the “woman-friendly” welfare state. The dual-earner/ dual-carer model refers to a social and economic arrangement in which men and women engage symmetrically in both paid work in the labor market and in unpaid work in the home. Parents' ability to balance family and market responsibilities, and to allocate employment and childcare-giving equally between mothers and fathers, could be facilitated by a package of state policies. Three areas of supportive policy – all invarious states of development across Europe – include: (1) family leave schemes that provide job protections and wage replacement for parents of young children; (2) affordable, high quality early childhood education and care, to a limited extent for very young children and to a much larger extent for children aged three to school-age; and (3) labor market regulations aimed at shortening the standard work week and strengthening re-muneration for reduced-hour employment. In this paper, we review European policy provisions, and then turn our attention to the United States case. We suggest that embracing the vision of the dual-earner/ dual-carer society may help to draw diverse but unified support for family policy development in the United States.

677. Continuity as the Path to Change: Institutional Innovation in the 1976 British Race Relations Act

Abstract:
Institutional innovation can, paradoxically, be a product of institutional continuity. New institutions often emerge in a bifurcated manner in which formal institutions (such as laws and written rules) are accompanied by informal institutions (such as ideas that motivate and help determine the precise nature of specific policies). When informal institutions include ideas that track policy developments in other spheres or other countries, they can influence innovations in formal institutions. The development of the 1976 British Race Relations Act illustrates this dynamic. When British race institutions were established in the 1960s, they reflected the prevailing idea that British policies should incorporate lessons learned from North America. When Britain revisited its anti-racism provisions in 1976, policy experts looked again to North America and found that much had changed there in the interim. They subsequently altered Britain's formal institutions to include U.S.-inspired “race-conscious” measures.

678. Church and State: Leaders and Legitimacy, A Theoretical Review

Abstract:
This paper represents an introductory and partial review of the literature on elite politics and their use of myths and symbols for legitimacy. My full project will explain the connection (or relationship) between religious elites and political elites, the use of religious myths, symbols or ritual to generate nationalism, and political legitimacy. This project requires that I bring together a number of different fields that examine elites and nationalism, as well as the literature on myths and symbols. This includes work in international relations, comparative politics, culture/ethnicity, and religion. The starting point of most of the literature that looks at elite politics and nationalism (whether this is stated or not) is that politics becomes problematic when political institutions are weak. I will provide an overview of this broad literature to start with; then I will give a condensed look at some other positions that examine why competitive elite politics may generate nationalism; where nationalist symbology comes from; and the different roles religious elites may play in nationalist conflict; and finish with a description of how I see the relationship between religion, politics, myths and nationalism. You will see that my position is unique, yet combines elements from the other fields of inquiry.

679. A Model of Electoral Competition with Two-Year Terms

Abstract:
This paper will shed some light on the legislative voting literature by using a standard median voter model, however, the legislator's term is split into two distinct voting years. This allows us to analyze in more detail the voting decisions made by Congressmen. We estimate a voting record based on constituency variables and calculate the residual. We find that a higher first-year residual on the part of a congressman causes a lower probability of being reelected. In addition, we find that the first-year residual plays the key role in this lower reelection probability. The second-year residual lacks any consistent significance with regards to the reelection probability. In this paper, we also analyze two different effects that have been predominant in the literature: the sorting effect and the tenure effect. Using our comprehensive data set, from 1983-1996, we find that both effects do exist. Moreover, older congressmen (those closer to retirement) had lower residuals. For the years 1983 to 1992, the two effects counteracted each other and caused no net impact on the first-year residual. For the years 1993-1996, the sorting effect dominated the tenure effect and showed that members with higher tenures had lower first-year residuals.

680. Institutional Investors, Corporate Ownership, and Corporate Governance: Global Perspectives

Abstract:
We examine the role of institutional investors in financial markets and in corporate governance. In many countries, institutional investors have become the predominant players in financial markets and their influence worldwide is growing, chiefly due to the privatization and development of pension fund systems. Moreover, foreign institutional investors are becoming a significant presence, bringing their trading habits and corporate governance preferences to international markets. In fact, we argue that the primary actors prompting change in many corporate governance systems are institutional investors, often foreign institutional investors. In other countries the role of institutional investors is limited. Instead, large blockholders, often in the form of individuals, family groups, other corporations, or lending institutions are the dominant players. We present the theoretical arguments for the involvement of investors in shareholder monitoring and a brief history of institutional ownership and activism in the United States and other countries. We also discuss studies of the efficacy of such activism.
