61. Claims to Legitimacy Matter: Why Sanctions Fail to Instigate Democratization in Authoritarian Regimes

Abstract:
International sanctions have been one of the most commonly used tools of Western foreign policy in the post‐Cold War era to instigate democratization globally. However, despite long‐term external pressure through sanctions imposed by the European Union, the United States and/or the United Nations, nondemocratic rule in cases such as Belarus, Cuba, Eritrea, Iran, North Korea and Syria has proven to be extremely persistent. In this paper, we analyze a new global dataset on sanctions from 1990 to 2011 and assess which international and domestic factors account for the persistence of nondemocratic rule in targeted regimes. The results of a fuzzy set Qualitative Comparative Analysis (fsQCA) of 120 episodes of sanctions provide new insights for the research on both sanctions and authoritarian regimes. Most significantly, sanctions strengthen nondemocratic rule if the regime manages to incorporate their existence into its legitimation strategy. Such a “rally‐round‐the‐flag” effect occurs most often in cases where comprehensive sanctions targeting the entire population are imposed on regimes that enjoy strong claims to legitimacy and have only limited linkages to the sanction sender.

As a consequence, the U.S. has one of the highest survival rates for cancers, excels at acute and trauma care, and has produced half of the world's Nobel laureates.

The U.S. government interferes with the market for foreign laborers by restricting the number and mix of immigrants and setting tight quantitative limits on foreign-born guest workers. This has created a mismatch between the demand for foreign workers from U.S. businesses and their supply, directly leading to the illegal immigration situation we confront today. The current system inefficiently limits the gains that our economy could achieve from employing larger numbers of foreign workers, and it disproportionately harms small U.S. businesses. The economic fears associated with increased guest workers or immigrants are unfounded. The current Senate immigration reform proposal would be a marginal improvement but does not go far enough. Red Card, an alternative guest worker proposal, would better coordinate labor markets. Ultimately, an immigration market free from government limitations and interference would be the most efficient solution.

Abstract:
Inward foreign direct investment (IFDI) represents an integral part of the United States (U.S.) economy, with its stock growing from US$ 83 billion in 1980 to US$ 3.5 trillion in 2011. The United States, which had earlier been primarily a home for multinational enterprises (MNEs) rather than a host for affiliates of foreign MNEs, has become a preferred host country for FDI since the 1980s. Foreign MNEs have contributed robust flows of FDI into diverse industries of the U.S. economy, and total FDI inflows reached US$227 billion in 2011, equivalent to 15% of global inflows, the single largest share of any economy. Inflows of FDI, with a peak of US$ 314 billion in 2000 and another of US$ 306 billion in 2008, have been an important factor contributing to sustained economic growth in the United States. The recent financial and economic crises negatively impacted FDI flows to the United States and opened a period of major uncertainty. The effectiveness of government policy responses at both the national and international levels in addressing the financial crisis and its economic consequences will play a crucial role for creating favorable conditions for a rebound in FDI inflows.

The United States has unique experience fighting violent hate crime and discrimination, and the protection of the rights of lesbian, gay, bisexual, transgender and intersex (LGBTI) people has become a signature human rights initiative of the Obama Administration. In 2009, Congress passed the Matthew Shepherd and James Byrd Hate Crime Prevention Act, with bipartisan support and the endorsement of a wide range of constituencies with differing views on LGBTI equality. The law--and the coalition that supported it--is a model of how to marshal the range of U.S. resources to improve responses to all hate crime, including acts of violence based on sexual orientation and gender identity bias.

The Obama Administration, as it embarks on its second term, should reaffirm U.S. leadership on the protection of refugees by repairing flaws in the U.S. asylum and resettlement systems. Many of these flaws have persisted for years, undermining U.S. leadership and leaving refugees in difficult and vulnerable situations. The White House should lead this effort and launch stronger mechanisms to safeguard protection throughout U.S. agencies. The administration should also look for opportunities to move some of these repairs forward in concert with broader immigration reform initiatives.

70. How to Repair the U.S. Immigration Detention System

As the Obama Administration embarks on its second term and recommits itself to immigration reform, it should prioritize its commitment to transform the immigration detention system . In 2009, the Department of Homeland Security (DHS) and Immigration and Customs Enforcement (ICE) committed to overhaul the U.S. immigration detention system and shift it away from its longtime reliance on jails and jail-like facilities. Since that time, ICE has taken steps to address some of the problems in the existing system. It has, for example, hired onsite detention service managers to improve oversight, implemented new parole guidance for arriving asylum seekers, and streamlined the process for detainee health care treatment authorization. It has also taken a number of steps towards a broader transformation of the system, such as opening a “model” civil detention facility in Karnes County, Texas, that offers conditions more appropriate for immigration detainees.
