21. Whistleblowing: an effective tool in the fight against corruption

Abstract:
Whistleblowing is increasingly recognised as an important tool in the prevention and detection of corruption and other malpractice. By disclosing wrongdoing in an organisation, whistleblowers can avert harm, protect human rights, help to save lives and safeguard the rule of law. The clandestine nature of corrupt behaviour means that it may never come to light unless cases are reported by people who discover them in the course of their work. But reporting can come at a high price: whistleblowers often expose themselves to great personal risks in order to protect the public interest. As a result of speaking out, they may lose their jobs, dampen their career prospects, and even put their own lives at risk. To provide a safe alternative to silence, TI recommends policy and legal measures to provide: Effective legal protection of whistleblowers against retaliation with full compensation in case of reprisals; Adequate mechanisms in public, private and not-for-profit organisations to ensure that disclosures are properly handled and thoroughly investigated; Public research, data collection, information and training to inform about the public benefit of whistleblowing.

22. The DISCLOSE Act, Deliberation, and the First Amendment

Abstract:
The United States Supreme Court decided in Citizens United v. Federal Election Commission that Congress may not prohibit spending on political speech by corporations. President Obama and several members of Congress have sharply criticized Citizens United, and Sen. Charles Schumer and Rep. Chris Van Hollen have proposed the DISCLOSE Act in response to the ruling. DISCLOSE mandates disclosure of corporate sources of independent spending on speech, putatively in the interest of shareholders and voters. However, it is unlikely that either shareholders or voters would be made better off by this legislation. Shareholders could demand and receive such disclosure without government mandates, given the efficiency of capital markets. The benefits of such disclosure for voters are likely less than assumed, while the costs are paid in chilled speech and in less rational public deliberation. DISCLOSE also prohibits speech by government contractors, TARP recipients, and companies managed by foreign nationals. The case for prohibiting speech by each of these groups seems flawed. In general, DISCLOSE exploits loopholes in Citizens United limits on government control of speech to contravene the spirit of that decision and the letter of the First Amendment.

23. Reforming the Inter-American Defense Board

Abstract:
The Western Hemisphere's delegations to the Inter-American Defense Board (IADB) should represent and be responsible to ministers of defense or their equivalents, rather than to the armed forces, as is the case in most countries in the Americas today. This breakthrough reform would bring the Board in line with democratic constitutional practices, strengthen Organization of American States (OAS) support for democracy, and help implement the 2003 Mexico City “Declaration on Security in the Americas,” which adopted a broadened multidimensional view of security. The reform could be accomplished without change to the March 2006 statutes and would bring the Board into the OAS General Secretariat associated with the Secretariat on Multidimensional Security.

24. Has the Fed Been a Failure?

Abstract:
As the one-hundredth anniversary of the 1913 Federal Reserve Act approaches, we assess whether the nation's experiment with the Federal Reserve has been a success or a failure. Drawing on a wide range of recent empirical research, we find the following: (1) The Fed's full history (1914 to present) has been characterized by more rather than fewer symptoms of monetary and macroeconomic instability than the decades leading to the Fed's establishment. (2) While the Fed's performance has undoubtedly improved since World War II, even its postwar performance has not clearly surpassed that of its undoubtedly flawed predecessor, the National Banking system, before World War I. (3) Some proposed alternative arrangements might plausibly do better than the Fed as presently constituted. We conclude that the need for a systematic exploration of alternatives to the established monetary system is as pressing today as it was a century ago.

25. Polyphonic Country: A Peace Zone in Georgia and South Caucasus

Abstract:
Since the breakup of the Soviet Union the South Caucasus region has been plagued with ethnic conflicts—some of them remnants from Soviet times. Armenia and Azerbaijan are in- volved in a lengthy confrontation over the region of Nagorno-Karabakh, and Georgia struggles with Russia over the two separatist regions of Abkhazia and South Ossetia. These conflicts have caused multiple military confrontations between different parties and are still unresolved even today. In June 1997 Johan Galtung, founder of Peace Research Institute of Oslo (PRIO), vis- ited three South Caucasian countries in his tour to promote the “Transcend Method” of conflict transformation and to conduct collaborative workshops with the students of Tbilisi State Univer- sity, Georgia; Yerevan State University, Armenia; and Khazar University, Azerbaijan. He held a large meeting with civil society representatives at the Caucasian Institute for Peace and Demo- cratic Development (CIPDD) in Tbilisi. It was at that roundtable discussion, chaired by CIPDD director Dr. Ghia Nodia, that Galtung proposed creating a Peace Zone and a new international airport at the border area between Georgia, Azerbaijan and Armenia—namely at the Red Bridge area, one of the centers for regional trade for the last fifty years of the 20th century. Dr. Galtung has suggested that creating a Peace Zone in the South Caucasus was the only viable alternative to the continuous state of war and ethnic conflict. Three years later, Ambassador John W. McDonald, Chairman and CEO of the Institute for Multi Track Diplomacy, attended a conference in Tbilisi, Georgia organized by the Georgia- America Business Development Council. At the conference, Ambassador McDonald also sug- gested creating a Peace Zone in Georgia, around the Baku-Tbilisi-Ceyhan pipeline, as a way of protecting Western energy interests through peace-building and economic development. Throughout the following nine years Ambassador McDonald continued to work with different Georgian governments on the formation of Peace Zones in Abkhazia and South Ossetia. In 2003 the Vice-Speaker of the Georgian Parliament, Vakhtang Rcheulishvili, came to Washington, DC to support the idea of Peace Zones in conflict regions. He met various U.S. officials like Senator Tom Harkin, Congressman Dennis Kucinich, and Matthew Bryza of the National Security Coun- cil at the White House. In 2004 the new Prime Minister of Georgia, Zurab Zhvania, endorsed Ambassador McDonald’s plan for Peace Zones in conflict regions. State Minister Bendukidze and former Minister of Conflict Resolution Khaindrava were also very much supportive of this plan. After the Rose Revolution, when nonviolent protests brought down the corrupt government of Eduard Shevardnadze in November 2003, the idea of Peace Zones became a grassroots con- cept popular with certain segments of civil society and university students in Georgia. Proposals for establishing Peace Zones faced a setback when the militaristic policies of Georgian, Russian, and separatist governments led to renewed violence, and in August 2008, a full war between different parties in South Ossetia. They still remain however, one of the most promising means of breaking the cycle of violence in the South Caucasus. The purpose of this paper is to present the case for a Peace Zone in Georgia.

Abstract:
This essay argues that the climate of intimidation and fear surrounding a more critical discussion of the Israeli-Palestinian conflict in the United States has begun to change. Despite the obstacles that still remain, a counterdiscourse challenging dominant conceptualizations and understandings of the conflict, particularly Israel's role, has not only emerged but also gained growing legitimacy and weight. These changes can be found in academia (at all levels of the educational hierarchy), civil society, and policy circles. Some of the most dramatic changes have occurred within the U.S. Jewish community in which an oppositional movement-in part, generational-has grown increasingly strong and well organized, ending any notion of a Jewish consensus on Israel.

Abstract:
The First Amendment to the U.S. Constitution recognizes a laissez-faire policy toward speech and the press. The Framers of the Bill of Rights worried that the self-interest of politicians fostered suppression of speech. In contrast, some constitutional theorists have argued that the Constitution empowers, rather than restricts, the federal government to manage speech in order to attain the values implicit in the First Amendment.

28. Fairness 2.0: Media Content Regulation in the 21st Century

Civil libertarians feared that a change of administrations would herald a revived Fairness Doctrine, a policy that previously permitted the government to oversee broadcast news coverage for "balanced views." A return to the Fairness Doctrine, however, now seems unlikely. It is very likely, however, that politicians from both the left and the right will try to extend government control over the media beyond current policies. New rules adopted or proposed by the Federal Communications Commission suggest that the agency may be poised to enforce the most intensive government oversight of broadcast programming in decades—perhaps even in the history of the agency. The FCC voted last year to require each broadcast licensee to file quarterly "enhanced disclosure" reports—highly detailed information regarding its programming and editorial choices. This information will be used by organized groups to file complaints to pressure broadcasters to air programming that the complainants prefer. The FCC is also formulating programming guidelines based on the enhanced disclosure reports purporting to ensure that broadcasters meet local needs. This "broadcast localism" effort may also require broadcasters to appoint local boards to oversee their performance and their editorial decisions. As the FCC seeks to expand regulation of broadcast media, the traditional justification for its authority—spectrum scarcity—has lost credibility, and the agency's new efforts are likely to run afoul of the First Amendment.

On February 9, Turkey's ruling Justice and Development Party (AKP) passed two constitutional amendments legalizing a specific women's headscarf on college campuses. The Turkish turban -- not to be confused with the South Asian male turban -- first emerged in the country in the 1980s and has long represented an extremely divisive political issue. Turkey's European-style secularism, which keeps religion and its symbols out of government and education, considers the headwear a political symbol -- a sentiment with which AKP prime minister Recep Tayyip Erdogan seemed to agree in public remarks he made on January 15. For nearly two decades, the secular view had led Turkish courts to ban the turban in certain public contexts. Now that the headwear is permitted on campuses, what will happen next in Turkey? And what implications might this legislation hold for the United States?

Far from protecting the environment, most rail transit lines use more energy per passenger mile, and many generate more greenhouse gases, than the average passenger automobile. Rail transit provides no guarantee that a city will save energy or meet greenhouse gas targets.
