201. Who's Afraid of the International Criminal Court?

Abstract:
Last February, soon after Libyan leader Muammar al-Qaddafi unleashed his forces against civilian protesters, the United Nations Security Council unanimously voted to refer the situation in Libya to the International Criminal Court. Days later, the ICC's chief prosecutor, Luis Moreno-Ocampo, announced the launch of an investigation of members of the Qaddafi regime, promising, "There will be no impunity in Libya." With the UN Security Council injecting the court into one of the year's biggest stories, the ICC may seem to have become an indispensable international player. It already is looking into some of the gravest atrocities committed in recent decades -- in the Democratic Republic of the Congo, Sudan, and Uganda, among others -- and its investigation into the 2007 election-related violence in Kenya is shaking up that country's elite. But a closer look suggests that the ICC's sleek office building on the outskirts of The Hague houses an institution that is still struggling to find its footing almost a decade after its creation. The court has failed to complete even one trial, frustrating victims as well as the dozens of governments that have contributed close to $1 billion to its budget since 2003. The ICC's first trial was nearly dismissed twice. Its highest-profile suspects -- Sudanese President Omar al-Bashir and Joseph Kony, the leader of the Lord's Resistance Army (LRA), the rebel group that has terrorized northern Uganda and neighboring areas -- have thumbed their noses at the court and are evading arrest. And with all six of the ICC's investigations involving abuses in Africa, its reputation as a truly international tribunal is in question.

202. Oil for Uganda – or Ugandans? Can Cash Transfers Prevent the Resource Curse?

Abstract:
In 2009, commercially exploitable reserves of oil were found in the Albertine Lakes Basin in Uganda. Along with a number of new oil exporters, Uganda now faces the challenge of using the new resources to advance its development agenda, while avoiding the corrosive effects oil often has on governance. This paper considers the tradeoffs and potential impact of alternative uses of the oil rent. It argues that alternative approaches towards absorbing rents should be judged from two perspectives – the direct impact on growth and living standards, and the indirect effect on governance. The Ugandan authorities favor using the oil revenues to build much-needed infrastructure; while this could have very large benefits, evidence of Uganda's already deteriorating governance and mounting corruption raise questions about its capacity to wisely invest the oil revenues. This paper considers an alternative—distributing oil rents to the population through cash transfers—as a potential tool to mitigate some of the governance risks associated with oil revenues by giving Ugandan citizens a stake in their own resource wealth, and considers the strengths and limitations of such an approach.

203. Political Trends in the African Great Lakes Region

Abstract:
Despite recent elections in Burundi, Rwanda, and Uganda and upcoming elections in the Democratic Republic of Congo (DRC), the Great Lakes region shows worrying trends toward electoral authoritarianism and political fragmentation, with new divisions that intensify the potential for confrontation. A shrinking political space and a tight grip on the state by the ruling elites and their parties are signs of authoritarianism in the region—a cause of concern since armed conflict in all four countries has been strongly linked to a history of exclusion under autocratic regimes. New divisions beyond previous alignments in armed conflicts also have occurred and already led to serious confrontations, flight, and at times violence. An increasing political fragmentation has become visible, and splits embroil intraparty conflicts in the political landscape instead of resolving them. The two trends—electoral authoritarianism and political fragmentation—are mutually reinforcing within and across the countries of the region and risk jeopardizing economic and social progress in Uganda and Rwanda as well as an emerging vibrant civil society in Burundi and the DRC. In light of the history of conflict and autocratic regimes in the region, these trends have to be a serious concern for local and international actors. The preference for stable leadership, economic performance, and security considerations regardless of political conduct has been a fatal miscalculation before in the Great Lakes region. Rather, acting early and using pressure constructively, the international community should do what it can to support a more open and less fragmented political sphere in the Great Lakes countries.

204. The European Union Training Mission in Somalia: Lessons Learnt for EU Security Sector Reform

The European Union's mission to contribute to the training of the Somali Security Forces is the first military training mission launched by the EU. Deployed in April 2010, EUTM is nearing the end of its mandate: the training of the recruits will be completed by mid-July 2011. The mission was carried out in close coordination with the US, the African Union and the Ugandan army, and contributed to the EU's visibility in East Africa. However, given the overall feebleness of Somalia's Transitional Federal Government (TFG) and its inability to implement reform, the political effectiveness of the mission is doubtful. In the current context, EUTM should not be extended beyond its original mandate. The EU and other donors should instead support more functional local administrations and make future assistance to the TFG contingent upon tangible progress towards completing transitional tasks, a normalization of political life, and restoring the provision of public services.

206. The Lord's Resistance Army: End Game?

The Lord's Resistance Army (LRA) remains a deadly threat to civilians in three Central African states. After a ceasefire and negotiations for peaceful settlement of the generation-long insurgency broke down in 2008, Uganda's army botched an initial assault. In three years since, half-hearted operations have failed to stop the small, brutally effective band from killing more than 2,400 civilians, abducting more than 3,400 and causing 440,000 to flee. In 2010 President Museveni withdrew about half the troops to pursue more politically rewarding goals. Congolese mistrust hampers current operations, and an African Union (AU) initiative has been slow to start. While there is at last a chance to defeat the LRA, both robust military action and vigorous diplomacy is required. Uganda needs to take advantage of new, perhaps brief, U.S. engagement by reinvigorating the military offensive; Washington needs to press regional leaders for cooperation; above all, the AU must act promptly to live up to its responsibilities as guarantor of continental security. When it does, Uganda and the U.S. should fold their efforts into the AU initiative.

If, like me, you hold that art is a necessity of ardent living, then experiencing art is one of the most crucial aspects of your life. And just as food is not meant only to be looked at in magazines but eaten—so too paintings and sculptures are not meant merely to be looked at in books, but devoured in person. This requires visiting museums, where most great art is housed. Photo credit: Lee Sandstead My favorite museum, after years of travel and thousands of hours spent in museums, is the West Building of the National Gallery of Art (NGA) in Washington, D.C. Although there are larger museums with bigger collections—most notably the Metropolitan Museum of Art in New York City—the NGA has a first-rate collection, a top-notch preservation policy, and a spectacular architectural setting. In America, museums on the East Coast have the strongest collections. Those such as the NGA, Met, and Museum of Fine Arts (MFA), Boston—recipients of the generosity of America's 19th- and early-20th-century collector-industrialists—contain the largest, most-diverse group of masters and masterpieces. Museum collections in the western and southern parts of the country tend to consist more of second-tier artists and artworks. The J. Paul Getty Museum in Los Angeles, for instance, is a well-endowed museum with a large but relatively weak collection. It has no original Vermeers, merely a copy of one. Likewise, its A Young Girl Defending Herself Against Eros is not the original by 19th-century master William Bouguereau, but rather a much smaller reproduction done mostly by his assistants. Although the Getty does have a Raphael, it is a minor, early portrait, rather than one of his celebrated Madonnas. The museum's Canaletto is not one of his giant panoramas of Venice, but a minor painting of the Arch of Constantine. By contrast, the NGA has four Vermeers, five Raphaels, and nine paintings by Sir Peter Paul Rubens; no West-Coast museum comes close to having masterworks on this scale. Leonardo da Vinci, Ginevra de' Benci, ca. 1474/1478. Housed at the NGA, this is the only painting by da Vinci in the United States. Although only in his early twenties when he painted Ginevra de' Benci, Leonardo was at his innovative best in this painting, placing the sitter in an outdoor setting, positioning the body in a three-quarter pose, and using a new medium—oil painting. Created by an act of Congress in 1937, the NGA was formed largely from the donated collections of Andrew Mellon and Samuel Kress, and it features a robust collection of Renaissance, Baroque, rococo, neoclassical, Romantic, and American art. It houses the only painting by Leonardo da Vinci in the United States and important works of several masters, including Rembrandt, Boucher, Fragonard, David, and Bierstadt. . . .

This essay addresses the Palestine question within a European context. After reflecting on why Palestine has been widely embraced as a “universal cause,” the author explores its relationship to the “Jewish question” in the changed context following World War II: Whereas prior to the war it was the Jews who were perceived as a threat to European civilization, today it is the Muslim immigrants who have the scapegoat role. Also discussed are philosemitism (and its manifestations in the West) and anti-Semitism (as it relates to the Arab world), and how these phenomena have been impacted by the ongoing Palestinian-Israeli conflict. The essay concludes with “utopian musings” on possibilities for a future Palestinian-Israeli peace.

The Africa Climate Change Resilience Alliance (ACCRA) was established in 2009 with the aim of understanding how development interventions can contribute to adaptive capacity at the community and household level, and to inform the design and implementation of development planning by governments and non-governmental development partners to support adaptive capacity for climate change and other development pressures. This paper is based on an analysis of three country studies conducted by national research teams in eight research sites in Ethiopia, Uganda, and Mozambique for ACCRA. It describes the Local Adaptive Capacity framework developed for this project, its application during the research, and the evidence found about the impact of development interventions on the adaptive capacity of people and communities.

210. Doing Justice to the Political. The International Criminal Court in Uganda and Sudan: A Reply to Sarah Nouwen and Wouter Werner

This article is a reaction to Sarah Nouwen and Wouter Werner, 'Doing Justice to the Political. The International Criminal Court in Uganda and Sudan', 21 EJIL (2010) 941. It takes issue with attempts to understand international law and particularly the workings of the International Criminal Court in terms of Carl Schmitt's thesis on the political as distinguishing between friend and enemy. My contention is that parties to a violent/ political conflict may try to mobilize the law in their struggle, but that the structure of the law itself escapes the logic of the political: law cannot be 'political' in the Schmittian sense. The unexpected upshot of this is that Schmitt's notion of the political may operate as a normative criterion for testing whether legal officials are still respecting the constraints of their practice. If legal authorities are indeed in the business of defining the enemy of mankind, then they are not doing this through or with the help of the law. They may simply act against the law. To substantiate this point, the article thinks through the difference between conventional and absolute/real enemies and contrasts these notions with the characteristics of (international criminal) law.
