Abstract:
In ‘The Limits of Legality and the United Nations Security Council: Applying the Extra-Legal Measures Model to Chapter VII Action’, Devon Whittle analogizes the United Nations Security Council’s Chapter VII powers to domestic emergency powers. He then seeks to apply the extra-legal measures (ELM) model of emergency powers, which I developed some 20 years ago, to exercise by the Council of its Chapter VII powers. This brief comment seeks to expand the discussion of ELM in international affairs beyond the collective security system by exploring the application of ELM in the setting of unilateral humanitarian intervention.

In the media, news commentators continue to refer to Srebrenica as a lesson that should never be repeated again. Indeed, such “never again” statements have re-emerged in light of current events unfolding in Syria, as the international community debates what type of intervention should be used to stop further violence. The media have gone so far as to call the Syrian regime's possible use of chemical weapons against its population a “Srebrenica moment” — that is, a moment when moral outrage of civilian deaths leads to a push for military intervention (Lerman and Lakshmanan 2013). While little action has materialized in the case of Syria, the Srebrenican “never again” lesson is also far from being either agreed upon or learned from in Bosnia itself.

Abstract:
Since the chemical weapons (CW) attacks on the Ghouta district just outside Damascus on 21 August, political developments have taken several unexpected twists leading Syria to become the 190th party to the Chemical Weapons Convention (CWC). Russia and the United States reached agreement on a framework for the dismantlement of Syria's chemical warfare capacity, in which the Organisation for the Prohibition of Chemical Weapons (OPCW) as well as the United Nations will play central roles. Western threats of military force – although they undeniably contributed to Syria's acceptance of the deal – have receded for the time being. And while the deferral of international justice regarding the Ghouta strikes will frustrate many parties, the emphasis on disarmament may actually open up the prospect of a negotiated end to the conflict.

We are proud to present the Goettingen Journal of International Law's first issue of 2012. After the successful three issues of last year, GoJIL can now turn to its new and exciting projects of 2012! Since our last issue in January 2012, several events of global importance have filled the newspapers, confronting the global community with the need for new judicial and political solutions. The Arab Spring movement still continues, with the situation in Syria aggravating further, which has led to the UN Security Council to authorize the establishment of the United Nations Supervising Mission in Syria (UNSMIS).

Abstract:
The 1982 Convention on the Law of the Sea—the instrument that created the overarching governance framework for nearly three-quarters of the earth's surface and what lies above and beneath it—has been signed and ratified by 156 countries and the European Community, but not by the United States. The Law of the Sea Convention, with annexes (hereafter in this report referred to as the “convention”), and the 1994 agreement on its implementation have been in force for more than a decade, but while the United States treats most parts of the convention as customary international law, it remains among only a handful of countries—and one of an even smaller number with coastlines, including Syria, North Korea, and Iran—to have signed but not yet acceded to the treaty.
