Abstract:
Sudan urgently needs to embark on a national dialogue and reform process that is led by Sudanese and supported by the international community. The process should be broadly inclusive, involving elements of the current regime, Islamists, and all armed and unarmed opposition groups. Any meaningful process will be lengthy, likely requiring years to complete. If a genuine, inclusive process is underway, elections in 2015 may need to be delayed. The African Union High-Level Implementation Panel has a critical role to play in advocating for and guiding such a process.

92. Sudan: Preserving Peace in the East

Abstract:
The situation in Sudan’s forgotten East – without deadly conflict since the 2006 Eastern Sudan Peace Agreement (ESPA) – stands in contrast to the fighting besetting the country’s other peripheries. But this peace is increasingly fragile. Seven years after the ESPA’s signing, the conflict’s root causes remain and in some respects are more acute, due to the failure to implement many of the agreement’s core provisions. Mirroring elsewhere in the country, with no sign of genuine efforts by Khartoum to address the situation, conflict could erupt in the East again and lead to further national fragmentation. All ESPA stakeholders urgently need to reconvene and address the deteriorating situation; the leading sign atories need publicly to concede that the promises of the original agreement have not met expectations and reach a consensus on remedial measures.

93. Linking People, Crossing Borders: A Conversation with Mo Ibrahim

Born in northern Sudan at the end of World War II, educated in England with a Ph.D. in engineering and mobile communications, Mo Ibrahim returned to Africa in 1998, bringing cellular technology with him. At the time of his arrival, there were barely three million landline telephones on the entire continent—the bulk of them in North Africa and the nation of South Africa. Most of sub-Saharan Africa was all but inaccessible to terrestrial telephone lines. The Democratic Republic of Congo had only 3,000 phones to serve its population of about 55 million. Seeing demand for mobile phones and with little competition from landlines, Mo Ibrahim created Celtel, beginning in Kenya, branching quickly into Uganda and Tanzania. The company allowed millions of mobile subscribers to roam freely across borders, recharging with local cards as they went. Quickly, Celtel expanded across Gabon, the Democratic Republic of Congo, the Republic of Congo, Malawi, Zambia, and finally his native Sudan—a vast pan-African territory almost devoid of telecommunications boundaries. By the time he sold Celtel five years ago, he had linked 24 million people—a number that was growing exponentially.

Abstract:
This article examines the conflict emerged in the Sudan’s states of Southern Kordofan and Blue Nile between the Government of Sudan and the Sudan People’s Liberation Movement/Army - North (SPLM/A-N) in the aftermath of the Referendum for self-determination that led to the separation of South Sudan from Sudan. It makes the point that the conflict in the so-called Two Areas - the North/South border regions of Sudan that fought alongside the SPLM/A during the country’s second civil war - is the direct result of the failure of the Comprehensive Peace Agreement (CPA) to address Sudan’s issue of sovereignty beyond the north/south divide, both in its design and implementation. As a result of the CPA, neither peace nor democracy was reached in Sudan. The analysis also looks at the question of liberal peacebuilding and its flawed application in the country.

Abstract:
Serious shortcomings in Sudanese laws and practices contribute to the lack of protection of victims of rape in Sudan. There is need for comprehensive legal reform, particularly of Sudan's Criminal Law of 1991. The categorisation of rape as a form of adultery does not result only in the virtual impossibility of convicting a rapist, but may even lead to the incrimination of the female victim of rape instead. This is particularly problematic considering the widespread use of sexual violence in the Darfur conflict. One of the encouraging consequences of the international attention on war rapes in Darfur is that women activists are increasingly positioning sexual violence against women as a concern on the national political agenda. Several legal reform initiatives are under way within the country among both state and non-state actors alike. The comprehensiveness of the reforms suggested differs in substance, but there is a consensus among both government and civil society actors that there is a need to differentiate between rape and adultery in current law. This consensus is extremely important, especially considering the sensitive and increasingly politicised and polarised debate on the topic. Although women face serious challenges in the Sudanese legal system, it is important to highlight how women activists are launching reform initiatives in order to bring justice to rape victims and to end the system of impunity for rapists. International donors can contribute a great deal in terms of supporting these reform initiatives and facilitating dialogue forums.

The history of warfare is marked by national armed forces, paramilitary fighters, and rebels across various eras and cultures who have committed sexual assault with impunity. Social norms have changed dramatically since ancient times, but it can be shocking to realize that even some well respected leaders of the past once approved of such crimes. For instance, Moses apparently gave orders to his warriors to “kill every male among them, and kill every woman that hath known man by lying with him. But all the women that have not known a man by lying with him, keep alive for yourselves.”1 This may not have been an overt sanction of sexual assault, but it certainly implies that the enemy's virgins should be kept as sexual companions. Furthermore, as Susan Brownmiller describes, “Among the ancient Greeks, rape was socially acceptable behavior well within the rules of warfare, an act without stigma for warriors who viewed the women they conquered as legitimate booty, useful as wives, concubines, slave labor or battle-camp trophy.”2 Joshua S. Goldstein similarly points out that “The most common pattern in warfare in the ancient Middle East and Greece was to literally feminize a conquered population by executing the male captives, raping the women, then taking women and children as slaves. The pattern…recurs even today.”3 In the last century, sexual assault has accompanied armed conflicts in countries all around the world, including Bosnia, China, France, Germany, Italy, Russia, Rwanda, and Sudan.

97. Sudan: Major Reform or More War

The “Sudan Problem” has not gone away with the South's secession. Chronic conflict, driven by concentration of power and resources in the centre, continues to plague the country. The solution is a more inclusive government that addresses at least some of the peripheries' grievances, but pledges to transform governance remain unfulfilled. A key hurdle – though not the only one – is President Bashir, who has further concentrated authority in a small circle of trusted officials and is unwilling to step aside. Many hope for regime change via coup but have not considered the dangers. The goal should be managed transition to a government that includes, but is not dominated by his National Congress Party (NCP). He might be willing to go along if he concludes greater disorder or even a coup is growing more likely, but only if the right incentives are in place. The international community should contribute to these provided a credible and inclusive transitional government, a meaningful national dialogue on a new constitution and a roadmap for permanent change in how Sudan is governed are first put firmly in train.

Discussions about the most effective, efficient, and sustainable approach to resolving complex crisis situations have a long historical tradition, even if ongoing debates among politicians and researchers may suggest otherwise. the discussions about developments in Iraq, Sudan, Somalia, and Afghanistan, as well as evaluations of the disasters in Haiti and Pakistan, call for all participants to find new solutions in response to obvious deficits and the looming prospect of failure. This holds especially true with regard to the question of when, where, and how the military instrument should be integrated with the activities of all the other actors involved in the resolution of complex crisis situations based on an overall political rationale.

100. Learning from Sudan's 2011 Referendum

Numerous predictions asserted that the referendum on the secession of southern Sudan would lead to renewed civil war. Despite ongoing violence in many parts of Sudan and South Sudan, the referendum process was largely peaceful. This unanticipated result may prove a relatively rare instance of documented success in conflict prevention. Warnings of impending violence came from many sources. They were timely but tended to be vague. Whether they were overly dire because of faulty assumptions about the conflict dynamics deserves scrutiny. Two prominent narratives explain why the referendum process was peaceful: one that emphasizes domestic factors and another that focuses on international intervention by Africans and westerners. It is highly likely that both contain important explanations for the peaceful referendum. People in Sudan and South Sudan tend to emphasize the domestic narrative; members of the international community tend to focus on international engagement. Several lessons for global conflict prevention can be drawn from the Sudan referendum experience: Preventing conflict in what seems like dire circumstances is possible. Coordinated outside actions should support local conflict-mitigating dynamics. Technical actions, such as election or referendum logistics, can have a significant positive impact on political processes. International actors need to be receptive to taking preventive action. Focusing on successes, as well as failures, is critical.
