31. ASEAN’s Response to the Myanmar Military Coup: From Non-Intervention to Responsibility to Protect

Abstract:
This article examines how ASEAN has reacted to the military coup in Myanmar. The February 1, 2021 coup was appalling because Myanmar was progressing toward democracy especially since Suu Kyi’s National League for Democracy (NLD) won a landslide victory in the 2015 general election. This article shows that although ASEAN tries to adopt ‘constructive engagement’ towards Myanmar, its approaches remain ineffective because it basically still maintains the principle of non-interference in the internal affairs of its member states. ASEAN must recognize that regional stability depends on respect for democracy, human rights, and rule of law within each member states. This article argues that ASEAN needs to transform its ineffective approaches toward more active response by gradually internalizing the new concept of ‘Responsibility to Protect’ (R2P) and actively put pressures on the military to restore democracy in the country.

Abstract:
The Association of Southeast Asian Nations (ASEAN), has faced an unprecedented challenge since the military junta seized power in a coup in Myanmar in 2020. Departing from its initial premise of ‘non-interference’ in the domestic policies of its member states, the regional group decided to ban Myanmar’s military representatives from meetings and summits. The five-point plan for consensus was supported by most members, however, Cambodia’s tenure as Chair of this organisation has brought the plan’s efficacy and longevity into question. At a time when Europe stands united against Russian actions in Ukraine, with a coherent and consistent response from states across the continent, can ASEAN do the same as it seeks to find a peaceful solution in the case of Myanmar?

33. South Korea’s New Southern Policy as an Open Regime: A View from Southeast Asia

Abstract:
There are four ways on how the NSP Plus could be further improved. First, to avoid policy limitations and maximize the room for supply chain resiliency and functional cooperation, the coverage of the NSP countries can be expanded apart from ASEAN and India. Second, South Korea can employ the concept of Third-Party Market Cooperation (TPMC) or the pursuit of joint ventures or partnerships with other countries in maximizing capacity-building in third countries (NSP countries). Third, South Korea can help strengthen ASEAN institution-building, regionalism and internal balancing by applying a similar policy framework to the Brunei-Indonesia-Malaysia-Philippines East ASEAN Growth Area (BIMP-EAGA) just as it does to the Mekong Region. Fourth, there needs to be more reciprocity or two-way interaction in the NSP so as to not make it seem that ASEAN is only on the receiving end of South Korean generosity. Finally, it is important to note that a change in the South Korean administration does not necessarily spell the end of the NSP just as the US’ Pivot or Rebalance to Asia of the Obama Administration was remodeled to the Indo-Pacific under the Trump administration.

Abstract:
It is clear that the NSP started off with the right messages and many Southeast Asian countries have been receptive to the initiatives. Despite the pandemic bringing a lot more challenges in implementing the policy initiatives, the NSP Plus has envisioned an innovation-oriented cooperation by transforming the traditional face-to-face operations to electronic and digitalized management. Public health cooperation is understandably the immediate focus, but such cooperation should be also seen as long-term fulfilment of the cooperation on the People pillar in the NSP. Infrastructure connectivity and South Korea’s cooperation in the building of an evolving East Asian regional architecture respectively enhance the Prosperity and Peace pillars. With patience, dedication, and commitment, the NSP Plus will be a long-lasting foreign policy legacy of Moon that brings benefits to Korea, ASEAN, and regional stability.

Currently, Dr. Tung is Vietnam Ambassador to South Korea. During this virtual “homecoming” and book launch, Ambassador Quy introduced Ambassador Tung who presented the findings of his book. This event was organized by the Weatherhead East Asian Institute and cosponsored by the Vietnam Studies Program at Columbia University and the New York Southeast Asia Network.

Human rights in Southeast Asia have deteriorated along with democratic freedoms. Don Emmerson will give an overview of human rights issues in Southeast Asia and look at how Chinese foreign policy in Southeast Asia affects, and is affected by, the more despotic character of ASEAN’s mainland compared with its maritime member states. He will address how much or how little influence China has in the region. Sarah Cook will then address the issue from the other side; looking at China’s internal political dynamics and rights abuses and how China’s foreign policy towards Southeast Asia is affected by those domestic conflicts. While many of the conflicts that have unfolded in Indonesia have been somewhat resolved, the conflict revolving around separatist movements in Papua remains unresolved. Upon its dawn, the Papua conflict has claimed thousands of lives, most of which are those of civilians. In this Issue Briefing, Gabriel Lele, Senior Lecturer at Universitas Gadjah Mada, explains the paths Indonesia has taken to resolve conflicts both in the domestic and regional realms. From a domestic standpoint, the author claims that the Indonesian government has failed to properly diagnose the conflict and that its measures have been futile as it was unable to take an accommodative approach towards the issue. From a regional standpoint, Indonesia utilized two strategies – litigation and dialogue. While the latter strategy contributed to sustainable political stability in the region, it has failed to yield significant progress towards conflict resolution. In this regard, the author claims that Indonesia should design more approaches that are more accommodative and apply more critical engagement.

Abstract:
The rapidly unfolding Myanmar crisis is presenting Southeast Asia with one of its most severe security and stability threats in the past three decades. While the region is certainly familiar with military coups and violent changes of government, the ongoing crisis in Myanmar carries risks far more acute than previous coups d’etat in the region. One of them is the risk to the sustained modus operandi of the region’s key institution—the Association of Southeast Asian Nations (ASEAN). The outcome of ASEAN’s involvement in the Myanmar crisis is consequential not only for the Myanmar people, but also for the association’s ability to credibly lead efforts to preserve peace and security in the region into the future. In this report, we assess the security situation in Myanmar, ASEAN’s collective response and the individual roles of key ASEAN member states in the mediating process. We focus on the effect that the Myanmar crisis has on the overall ASEAN political and security situation, and highlight Indonesia’s leadership, and limitations, in the process. We also detail the legal instruments and responsibility of ASEAN—in the form of the ASEAN Charter—to uphold the rule of law. The report concludes with some policy implications for the wider region, particularly Australia.

39. Strategic Trade Controls in Southeast Asia: A Pandemic Update

The Pacific Forum, with support from the US State Department’s Export Control and Related Border Security Program, held a virtual Seminar on Strategic Trade Controls in Southeast Asia on July 27-28, and August 5-6, 2020 via Zoom. Over 90 people from the Indo-Pacific region representing relevant government departments and ministries, private sector, industry associations, academia, and civil society organizations joined the seminar. Following the conference, several experts in attendance were invited to submit short analytical commentaries for compilation into this volume. Key themes from this conference, along with a summary of each paper contribution, are outlined below. The seminar focused on four substantive topics: (1) the adoption of Strategic Trade Controls (STCs) for nonproliferation and internal security; (2) post-COVID-19 supply chains and trade facilitation; (3) ASEAN and STC; (4) the World Customs Organization, STC, and the exploration of maturity models. Following presentations and discussions on these topics, representatives from several Southeast Asian countries—Philippines, Malaysia, Singapore, Thailand, Vietnam, Cambodia, Laos, Myanmar, and Indonesia—offered updates on the adoption of STC in their respective jurisdictions. Panelists discussed the uneven STC implementation within the Southeast Asian region as evidenced by Singapore, Malaysia, Philippines, and Thailand’s recent adoption or calibration of regulations while others, such as Vietnam, Cambodia, and Brunei have been slower to implement a more robust system. The region’s history of non-alignment, past experience with export controls as a coercive mechanism, prioritization of economic growth, and the view that STC can be used for technological denial fuels skepticism. ASEAN is a late entrant to the development of free trade zones and regional economic integration. Although it seeks to attract international investment, relaxed oversight, susceptibility to smuggling, and a lack of transparency inhibit growth. Some participants suggested connecting STC with the World Customs Organization Authorized Economic Operator scheme as it can exist without a national STC system already in place.

40. Natural Gas in South-east Asia: Key Trends and Long-term Outlook

Abstract:
Given the increasing gas demand and declining domestic supply, countries in South-east Asia are bracing themselves to become net gas importers and are studying ways to enhance their security of supply. LNG will be the preferred source of gas, thanks to its flexibility and widespread availability at competitive prices in global markets. However, concerns related to excessive gas import dependency might reduce appetite for additional gas usage in South-east Asia. This could mean that coal would have a larger role, which is bad news for climate change. Countries in the ASEAN region need policies to achieve balanced, reliable, secure and cost-effective energy supply, a pre-requisite for the region’s ambitious economic development plans. A combination of solid local policies, investment by international players in the region and stability in global gas markets would enable gas to play a positive role in South-east Asia, which is a fast-growing region and an increasingly important catalyst of global energy market developments.
